ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS

The meeting was called to order by Chairman Duer at 7:00 p.m.

CONSIDERATION OF MINUTES OF APRIL 24, 2003
APPROVED
Ken Sapp, seconded by Jim Kemp, motioned to approve the minutes of
April 24, 2003. The motion was approved unanimously (5-0).
CHAIRMAN DR. TOM DUER EXPLAINED THE VOTING REQUIREMENTS OF
THE ZONING BOARD OF ADJUSTMENT. ANY REQUEST THAT GOES
BEFORE THIS BOARD MUST RECEIVE A SUPER MAJORITY (75%). THIS
BOARD IS A 5 MEMBER VOTING BOARD. FOR ANY VARIANCE TO PASS
IT MUST RECEIVE 4 AFFIMATIVE VOTES.

BA 2003-06
PUBLIC HEARING TO CONSIDER A REQUEST FROM PUL TE HOMES FOR
A VARIANCE TO NORTH RICHLAND HILLS ZONING ORDINANCE NO. 1874:
ARTICLE 4, SECTION 410.D.6. THIS SECTION REQUIRES A MINIMUM OF
22.0' BETWEEN A SIDE OR REAR PROPERTY LINE OF A RESIDENCE AND
THE ENTRANCE TO A GARAGE. THE APPLICANT IS PROPOSING TO
BUILD A HOUSE WITH A GARAGE ENTRY APPROXIMATELY 20' FROM
THE SIDE PROPERTY LINE. THE APPLICANT IS REQUESTING A
VARIANCE OF 2' FROM THE SETBACK REQUIREMENT. THE SITE IS
LOCATED AT 6508 ABERDEEN DRIVE

Donna Jackson, City Planner, summarized the case. The applicant, Pulte
Homes, is asking for a variance on the vacant corner lot located at 6508
Aberdeen Drive in the Glenwyck Addition. The corner lot is required to have a
22-ft. setback on the side as well as the front. The variance request involves the
minimum distance between the side or rear property line. In October 2001 when
the property was originally platted, the minimum setback for the side entry
garage was 20 % -ft. However, the minimum has changed from 20% -ft. to 22-ft.
since August 12, 2002. The applicant is requesting the original setback of 20 %-
ft. instead of the current 22-ft. setback. The applicant is proposing to build a
single-family home with a side-entry garage and the entrance would be located
on the north side of Aberdeen Drive. The garage would be positioned on the
front of house, but it will still be a side-entry garage, as the ordinance currently
requires. The applicant is also requesting that the garage be on the north side
instead of the east side, due to the controversy with the traffic on Glenview.
Chairman Duer opened the public hearing and asked if anyone would like to
speak in favor of this case.
Keith Merz, Pulte Homes, came forward. Mr. Merz stated that he was present if
the Board had any questions or comments.
Chairman Duer asked if anyone else would like to speak in regards to BA 2003-
06. There was no one and the Chairman closed the public hearing. Chairman
Duer called for questions or comments from the Board. There were none and
the Chairman called for a motion.
Beth Davis, seconded by Fonda Kunkel, motioned to approve BA 2003-06
based on the fact that a hardship does exists due to the change in the
zoning ordinance, which takes into consideration public safety and welfare.
The motion was carried unanimously (5-0).
