MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF
ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS
FEBRUARY 21, 2002

CALL TO ORDER
The meeting was called to order by Dr. Tom Duer at 7:00 p.m.

CONSIDERATION OF MINUTES
Chairman Dr. Tom Duer asked for approval on the December 20, 2001 minutes.
Bill Schopper, seconded by Leslie Jauregui motioned to approve the minutes of
November 14,2001. The vote carried unanimously (4-0).
Chairman Dr. Tom Duer explained the voting requirements of the Zoning
Board of Adjustment. Since there are four members present this evening,
a super majority of four affirmative votes will result in approval of the
applicant's request.

BA-2002-01
PUBLIC HEARING TO CONSIDER A REQUEST BY LARRY ANDERSON FOR
A VARIANCE TO NORTH RICHLAND HILLS ZONING ORDINANCE NO. 1874:
ARTICLE 10, SECTION 1020 GENERAL SCREENING WALL AND FENCE
REGULATIONS TO ALLOW A CHAIN LINK FENCE TO REMAIN WHICH
ENCROACHES INTO THE REQUIRED SIDE YARD SETBACK.

THE PROPERTY IS KNOWN AS LOT 11, BLOCK 2, WINDCREST ADDITION,
AND IS LOCATED AT 7056 GREENRIDGE TERRACE.
Cathy Horton, Zoning Administrator, presented the case to the board by stating
that the residence is zoned R-2 and there is a 25' front and a 25'side setback
requirement. The applicant did not apply for a fence permit before putting up the
fence and it encroached the required 25' setback. The variance is for 25'.
Bill Schopper asked the applicant if he was the owner or leasing.
Applicant answered that he was leasing.
Chairman Dr. Tom Duer opened the public hearing.
Applicant Mr. Larry Anderson presented his case before the board stating that he
needed more room for his large dogs and presented pictures to the board of the
old wood fence falling down, the new fence, and pictures of his dogs.
Chairman Dr. Tom Duer asked the applicant who put up his fence.
The applicant answered back that Sav On Fence put the fence up.
Chairman Dr. Tom Duer commented that contractors know they have to get a
permit for a fence and at that time the contractor would have been told where the
fence could and could not be built. He stated that Sav On Fence needs a letter
written by the City to remind them of the requirements for permits.
Mr. and Mrs. Weiss, 7041 Daleview Trail, directly behind the applicant spoke in
favor of the applicant's request.
Chairman Dr. Tom Duer closed the public hearing.
Cathy Horton commented that if the applicant installed slats in the fence it could
cause a visibility problem.
Chairman Dr. Tom Duer made a motion to approve BA 2002-01 with a 10'
encroachment from the side setback building line, Jim Kemp seconded. Bill
Schopper voted against the motion to approve. The motion failed (3-1-0) due to
the lack of super majority vote.
Bill Schopper made a motion to deny BA 2002-01 due to no hardship, Leslie
Jauregui seconded. The motion to deny carried (4-0) unanimously.

Leslie Jauregui motioned to give the applicant until April 1, 2002 to have the
fence put back to its original place. Jim Kemp seconded the motion. The motion
carried (4-0) unanimously.
Cathy Horton told the Zoning Board Members about the COG training in
Arlington on February 26,2002 from 8:30 a.m.- 12:30 p.m. She told them to let
her know if they would like to attend.
