Chair Duer opened the public hearing and called for Planning Director Clayton Comstock to introduce the request. Mr. Comstock introduced the request. Chair Duer called for the applicant to present the request and be sworn in prior to speaking. Norberto Saez, 8117 Beverly Drive, North Richland Hills, Texas, was sworn in by Chair Duer and presented the request. Mr. Saez discussed how the location of the detached garage and house on the property impacted the developable area in the rear yard. He stated that the costs associated with placing a pool in the rear yard were increased due to this layout and that these costs would not be present if the pool was placed in his side yard. He also discussed how the curve of Grand View Drive affected the shape of his lot and left a large side yard. Chair Duer called Planning Director Clayton Comstock to present the staff report. Mr. Comstock presented the staff report. Chair Duer called for anyone wishing to speak for or against the request to come forward. Randy Huzenlaub, 8304 Shady Oaks Drive, North Richland Hills, Texas, came forward to speak. Mr. Huzenlaub stated that he is the president of the neighborhood's homeowners' association and shared his concerns regarding the maintenance of the pool. He also shared his concerns regarding code enforcement within the Shady Oaks neighborhood. Mr. Comstock discussed the process for inspections and code enforcement within the city. Sandra Huzenlaub, 8304 Shady Oaks Drive, North Richland Hills, Texas, discussed her experience with code enforcement cases in the neighborhood and also state her concerns regarding the maintenance of the pool. Chair Duer, Mr. Comstock, and Mrs. Huzenlaub discussed code issues and actions on properties in the Shady Oaks neighborhood. There being no one else wishing to speak, Chair Duer closed the public hearing. Chair Duer clarified that the pool would be constructed in-ground. Chair Duer, Board Member Kemp, and Mr. Comstock discussed fencing requirements for pools. Mr. Saez stated that he planned to build an additional fence around the pool for safety. Board Member Gibbs and Mr. Comstock discussed the standards for irregularly shaped lots. A MOTION WAS MADE BY BOARD MEMBER GIBBS, SECONDED BY CHAIR DOER, TO APPROVE ZBA22-0005 WITH THE CONDITION THAT A SECOND FENCE AND GATE BE CONSTRUCTED INTERIOR TO THE PROPERTY TO FURTHER PROTECT THE SWIMMING POOL AREA. Mr. Husband discussed item C.1. Board Member Koons asked Mr. Husband if a carport would satisfy the parking requirements of the ordinance. Mr. Husband stated that this would not satisfy the requirements as it is not enclosed. Chair Duer and Mr. Husband clarified the location of Mackey Creek and noted the houses located in the floodway. Joseph Johnson, 4513 Mackey Drive, North Richland Hills, Texas, was sworn in by Chair Duer and presented the request. Mr. Johnson discussed how he purchased the house 11 years ago, and that the main selling point was the large converted garage, which acted as living and entertaining space. He stated that he has no intention to rebuild the fireplace in the converted area. Leah Chance McCann, 4512 Mackey Drive, North Richland Hills, Texas, spoke in favor of the request. Mrs. McCann stated that she hasd lived across from the subject property her entire life and that she remembered when the garage conversion was completed. She discussed her experience with Mackey Creek and how it has not caused problems in her time living at the property. She stated there were no parking issues at the subject property and that the driveway accommodated the parking needs. Kenneth Kelley, 612 Shawnee Road, Waxahachie, Texas, spoke in favor of the request. Mr. Kelley discussed the layout of the house and how it does not accommodate living space and a garage. He asked if there was an ordinance preventing conversions when it was completed. Chair Duer clarified that the request does not concern garage conversions, but the parking standards in the Zoning Ordinance. Greg McCann, 4512 Mackey Drive, North Richland Hills, Texas, spoke in favor of the request. Mr. McCann stated that there are no parking issues on the property and that overflow parking is accommodated by the dead end at Mackey Drive. Jamara Kraatz, 6809 Briley Drive, North Richland Hills, Texas, spoke in favor of the request. Dale Morrow, 4516 Mackey Drive, North Richland Hills, Texas, spoke in favor of the request. PRESENTER: Clayton Husband, Principal Planner SUMMARY On behalf of Deidre Cummings (owner), Lauralee Chitty is requesting approval of a variance to the residential parking requirements to allow a garage conversion to remain without providing two covered parking spaces on the property. The property is located at 6400 Dorchester Trail. BACKGROUND INFORMATION The neighborhood area is located north of Mid-Cities Boulevard and west of Little Ranch Road. The property is located on the east side of Dorchester Trail. The lot is 61 feet wide, 117 feet deep, and 7,137 square feet in area. The lot is zoned R-3 (Single-Family Residential). The house was constructed in 1972 and has approximately 1,526 square feet of living area, which includes 399 square feet in the enclosed garage area. Deidre Cummings purchased the house in July 2008. The house was remodeled by a previous owner, and the two-car garage was converted into living space. The garage doors were removed as part of the conversion, and the area does not appear to be used as a bedroom or sleeping area. Photos of the interior and exterior of the house are attached. A search of City records does not show that a permit was applied for or issued for the garage conversion. In addition, the construction in the space was not inspected for compliance with building and life safety codes. Due to the garage conversion, the house does not meet the current zoning standard that requires two covered parking spaces located behind the front building line. This standard is required bycaiip„i 111111 ( „) of the zoning ordinance. Garage conversions are permitted if an alternative location for the required covered parking is provided. The owners have applied for a variance from the parking standard to allow the garage conversion to remain without converting the space back to a garage or providing covered parking elsewhere on the property. They indicate in the application that there is not a feasible location to construct a detached garage on the site. The distance between the house and the side property line is approximately six feet on both sides of the house. Literal enforcement of the controls will create an unnecessary hardship or practical difficulty in the development of the affected property. b. The situation causing the hardship or difficulty is neither self-imposed nor generally affecting all or most properties in the same zoning district. c. The relief sought will not injure the permitted use of adjacent conforming property. d. The granting of the variance will be in harmony with the spirit and purposes of these regulations. OPTIONS FOR BOARD CONSIDERATION The Zoning Board of Adjustment has the following options regarding this application. 1. Approve the variance as presented. This action would allow the garage conversion to remain and require certain modifications to the area in order to comply with life safety and building code standards. 2. Approve the variance with conditions. This action would allow the garage conversion subject to conditions as directed by the Board. 3. Deny the variance.
