APPROVED Acting Chair Rodriguez opened the public hearing and called on Director of Planning Clayton Comstock to introduce the item. Mr. Comstock informed the Board the applicant is requesting a variance to Chapter 106 (signs) of the North Richland Hills Code of Ordinances. Specifically to the size and location standards of the sign. Located at 8360-8380 Davis Boulevard being 11.59 acres. This is the B&B Theatres property and the address includes five (5) pad sites. Mr. Comstock provided site photos of the property. Applicant representative Travis English, 5024 Ranch View Road, Fort Worth, Texas, presented the item. Mr. English information the Board he has been working with Bill Sandlin, the owner of the five (5) pad sites in front of B&B Theatres. The applicant has agreed to a sign easement with the Tarrant County and is proposed on the southern pad site. B&B Theatres will have 50% of the sign and the five (5) pad sites will have opportunity to have name on the panel. The variance request is to build a sign that property features B&B Theatres and the pad sites. Mr. English was available to answer questions. Mr. Comstock presented staff's report. There will be five signs along Davis Boulevard and each tenant would be allowed sign space on the monument sign. Lot 2R 7R would relinquish its rights for another monument sign. Current sign regulations are 50 square feet message area; 75 square feet structure size; and seven (7) structure height. The proposed sign is 73 square feet; 120 square feet structure size; and a structure height of 12 feet. Mr. Comstock informed the Board the sign resembles the Kroger Marketplace signage. Mr. Comstock provided 50' x 50' triangle sight visibility photos and stated the January 23, 2023 Sign Review Board Meeting Minutes Page 2 of 3 driveway is also a fire lane, access, sidewalk, drainage, water and sewer easement. Mr. Comstock reviewed options for consideration. The Board may approve the request as presented, approve the variance with conditions, or deny the variance. The Board, applicant and staff discussed language on the sign; sign language modifications based on tenants; and being lit internally. Acting Chair Rodriguez asked the City Secretary to call on those who completed a public meeting appearance form to speak during the public hearing. There being no forms submitted, Acting Chair Rodriguez asked if there was anyone in the audience wishing to speak on the item to come forward. There being no one wishing to speak, Acting Chair Rodriguez closed the public hearing. PRESENTER: Clayton Comstock, Planning Director SUMMARY: On behalf of Hwy 67 Dealership Joint Venture, Accent Commercial Real Estate is requesting a permit for nonconformity in conjunction with an existing pole sign on the property. The site is located at 6601 Boulevard 26. GENERAL DESCRIPTION: The property under consideration is on the north side of Boulevard 26 between Rufe Snow Drive and Bonzer Street. The property is developed with a 29,236-square-foot retail building constructed in 1975. Past tenants in the building included a bowling alley, a non- profit agency, a thrift store, and several retail stores. The building is currently occupied by RG Wholesale Furniture and VIPcare Texas, a medical office. A pole sign is located on the property. The pole sign was constructed in 1995 in association with Thrift Town moving into the building. The sign included tenant panels for other businesses located in the building. The sign is approximately 30 feet tall with a sign message area of approximately 110 square feet. At the time it was constructed, pole signs were permitted on all commercial properties. However, in July 2002, the City Council adopted Ordinance 2640, which revised the sign regulations in part to limit the locations where pole signs were permitted to the freeway overlay zone. As a result, the existing pole sign became a nonconforming sign. Section 106-10 of the sign regulations allows for the replacement of sign panels on nonconforming multi-tenant pole signs if no other structural changes are made to the sign. In April 2023 the furniture store tenant modified the message area on the sign by converting both tenant panels into a single tenant sign for the business. The tenant did not apply for or receive a sign permit, and the work was done without permission from the property owner. The tenant and property owner were sent a notice of violation of the sign regulations since the sign was modified without a permit. Additionally, this modification changed the sign from a nonconforming multi-tenant pole sign to a single-tenant sign, which results in loss "K NOKTH KICHLAND HILLS of the nonconforming status provided by Section 106-10. This modification also results in the pole sign being ineligible for re-use. Due to the unauthorized change by the tenant, the property owner is requesting approval from the Sign Review Board to continue use of the pole sign as a nonconforming multi- tenant sign. A statement from the owner is attached, which explains the request and the lease agreements regarding signage for the property. The request is being processed as a permit for nonconformity. Approval would be associated with a sign permit for the modification of the tenant panels on the pole sign to convert it back to a multi-tenant sign. The approval would not run with the property in the same manner as a variance. If future improvements were proposed to the sign, compliance with the standards would be evaluated again at that time. A public hearing is not required for consideration of a permit for nonconformity. Explain any unique circumstances, if applicable, not considered by the Sign Regulations. 1 am the managing venturer of HWY 67 DEALERSHIP JOINT VENTURE, the entity that owns 6601 Boulevard 26. 1 was recently informed that our sign was cited for non-compliance from a third-party sign vendor hired by a tenant without our authorization. 1 called the permitting office yesterday, Ultimately, HWY 67 DEALERSHIP JOINT VENTURE is not responsible for third parties violating North Richland Hills sign policies. We were never involved and most importantly ever authorized any changes to our sign. One of our tenants made changes to our sign without our knowledge or authorization. Stated in the leases, we demand that our tenants to obtain landlord approval,meet all city code requirements, and get proper permits for installation. 1 will include the leases that state that language. The first lease with Vladimir Garcia Infante(RG Furniture)states in Section 10 A and B that any signs would be approved by the Landlord and comply with any laws,restrictions,zoning ordinances,and any governmental order. Most importantly the Tenant was to have written consent by the Landlord to install any signage. HWY 67 DEALERSHIP JOINT VENTURE, the owner, was never given sign proposals to approve and was unaware of the Tenant doing any work on our property/sign. The second lease is with FLORIDA MEDICAL ASSICIATES LLC dba VIP CARE. This lease addressed signs in Section 11 and Exhibit B. It's clear that HWY 67 DEALERSHIP made leases with their tenants to conform with North Richland Hills sign ordinances. The sign was to remain a multi-tenant sign and all signs that were installed by any tenant were to be approved and meet the cities requirements. PRESENTER: Clayton Comstock, Planning Director SUMMARY: On behalf of Rossmore Enterprises (owner) and Chick-fil-A (tenant), EZZI Signs is requesting a variance to Chapter 106 (Signs) of the North Richland Hills Code of Ordinances. The site is located at 6645 NE Loop 820. The applicant is requesting a variance from the off-premises advertising standards for a pole sign. GENERAL DESCRIPTION: The property is located in the northwest quadrant of NE Loop 820 and Rufe Snow Drive. The site is presently developed with an Applebee's restaurant, and the developer proposes to redevelop the side for a new Chick-fil-A quick service restaurant. City Council approved a special use permit for the new restaurant on May 8, 2023 (Ordinance 3787). The developer proposes to remove the existing Applebee's pole sign and replace it with a new pole sign. The design and appearance would be similar to the pole sign constructed for property at the northwest corner of Rufe Snow Drive, which includes Mod Pizza, Black Rifle Coffee Company, AT&T, and ATI Physical Therapy. The new sign would provide advertising for the new Chick-fil-A restaurant as well as the future tenant of the existing Chick-fil-A building at 5131 Rufe Snow Dr. In discussions with the sign contractor for the new sign, it was noted that advertising for an off-site tenant was not permitted by the sign regulations. The developer and owner decided to seek a variance to allow the sign as proposed. The variance application and supporting materials are attached. The materials include a copy of the application explaining the reasoning for the variance request and other relevant documents. An analysis of the request and relevant codes is below. ANALYSIS The variance request is related to standards for off-premises advertising, which are contained in .Sec!ii!..o2 ,11,0,E„-, , of the sign regulations. The sign is proposed to be constructed on the north side of the NE Loop 820 frontage road on the existing Applebee's lot and would be adjacent to the easternmost driveway "K NOKTH KICHLAND HILLS into the shopping center site. The message area includes two tenant panels. One panel would provide signage for the new Chick-fil-A restaurant site. The second tenant panel would be for use by the future tenant of the current Chick-fil-A building at 5131 Rufe Snow Dr., which is considered an off-premises sign.
