MINUTES OF THE PRE-SESSION MEETING OF THE ZONING BOARD OF
ADJUSTMENT OF THE CITY OF NORTH RICHlAND HillS, TEXAS

Staff presented a brief summary of the following case:
SA 2000-02 Request of Jack Ziegler to allow carport to encroach side building
line and to very from ordinance requiring columns to be masonry.
The Board, after a few brief questions, closed the Pre-Session Meeting and
retired to the City Council Chambers to begin the Regular Meeting.

CONSIDERATION OF MINUTES OF FEBRUARY 17, 2000
APPROVED
Leslie Jauregui, seconded by Kyle Bacon, moved to approve the minutes of the
February 17, 2000 meeting. The motion carried unanimously.
Chairman Duer explained that this Board consists of five voting members and it
Requires four affirmative votes in order for a variance to pass.

BA 2000-02
PUBLIC HEARING TO CONSIDER THE REQUEST OF JACK ZIEGLER FOR
VARIANCES TO NORTH RICHLAND HILLS ZONING ORDIANCE NO. 1874,
ARTICLE 6, SECTION 630, ACCESSORY STRUCTURES AND BUILDINGS
TO ALLOW CONSTRUCTION OF A CARPORT. THE PROPERTY IS KNOW
AS LOT R16B, BLOCK 34, HOLIDAY WEST ADDITION AND IS LOCATED AT
5725 WESTCHASE DRIVE.
PARTIAL APPROVAL, PARTIAL DENIAL
Mr. Ziegler submitted a building permit application for a carport and was denied
for various inconsistencies with the Zoning Regulations. The current request is
to allow the carport to encroach the side building line and to allow metal posts
where masonry is required. The building permit denial letter (dated Febuary 21,
2000) indicates several other problems, which the applicant has stated he will
comply with.
Under Section 630(D)(4), carports located on residentially zoned lots require a
six-foot side building line. The variance would allow the carport to encroach
5-1/2 feet into the setback, six inches from the side property line. Section 630
(D)(13) requires that support columns comply with the masonry requirements of
the district, which is 75%. The applicant is requesting that no masonry be
required.
Staff recommends the Zoning Board of Adjustment Denv BA 2000-02 as
submitted by Mr. Ziegler to vary from Section 630.D (4), Ordinance 1874, Zoning
Regulations.
1. Section 630.DA - Side Buildinq Line Setback for Carport Communication-
In residential districts, a carport shall not extend into a side yard setback of
six-feet on interior lots.
The requested variance is to allow the carport to encroach 5'6" into the six-foot
setback. If approved it would allow the carport to be six inches from the side
property line.
2. Section 630.D.13b. Carport Requlations - Desiqn Criteria
13.b. Support Columns - The columns or post supporting the roof
structure shall conform to the masonry requirements of the district.
Staff found a special condition does exist in that the neighborhood
environment that has many carports that were constructed prior to the adoption
of the new carport regulations. The property is narrow in a way that would not
accommodate a carport without encroaching the side building line. The narrow
area where the proposed carport is to be located would be further impacted by

the width of brick columns. There is room to accommodate a carport meeting the
zoning regulations, just not at the location the applicant has proposed.
Dr. Duer opened the public hearing.
James Ziegler, representing Jack and Elaine Ziegler, 7025 Lincoln Drive, North
Richland Hills, Texas, stated that the property was narrow and would be hard for
his father to maneuver his vehicle safely. Mr. Ziegler showed several pictures of
other homes in the area with carports encroaching side building line. He also
stated that the duplexes when built did not require covered parking, leaving
residence without protection from the weather. He stated that if the Zoning
Board granted his request to encroach building line, he would comply with
bricking of the post.
Seeing no additional proponents, Chairman Duer called for any opponents.
Seeing no opponents, Chairman Duer closed Public Hearing.
Dr. Tom Duer, seconded by Jim McCain, moved to approve part of BA
2000-02. Dr. Duer, made the motion to approve the encroachment of a
carport on side building line, due to the narrow property, and that the
developers did not provide any covered parking, and that several non-
conforming carports already exist in the neighborhood. However, Dr. Duer
made a motion to deny the request of no masonry columns. The motion
carries unanimously.
5.
PUBLIC HEARING TO CONSIDER THE REQUEST OF DUANE RENFRO FOR
VARIANCES TO NORTH RICHLAND HILLS ZONING ORDINANCE NO. 1874:
ARTICLE 6, SECTION 655, SWIMMING POOLS TO ALL CONSTRUCTION OF
A DIVING POOL TO ENCROACH A SIDE BUILDING LINE. THE PROPERTY
IS KNOWS AS LOT 10, BLOCK A, MARTIN OAKS ADDITION AND IS
LOCATED AT 7701 RIDGEWAY COURT
WITHDRAWN
Leslie Jauregui, seconded by Jim McCain, to accept the withdrawal of
BA 2000-3. The motion carries unanimously.
