CALL TO ORDER The meeting was called to order by Dr. Tom Duer at 7:10 p.m. 2. CONSIDERATION OF MINUTES OF MARCH 16, 2000 TABLED Ms. Jauregui, seconded by Mr. Schopper, moved to table approval of the March 16,2000 minutes until the next regularly scheduled meeting. The motion carried unanimously. Chairman Duer explained that this Board consists of five voting members and it Requires four affirmative votes in order for a variance to pass. ZBA Minutes March 30, 2000 4. BA 2000-04 PUBLIC HEARING TO CONSIDER THE REQUEST OF D.M. SHELTON BUILDERS TO VARY FROM THE NRH ZONING ORDINANCE, NO. 1874; SECTION 150 - SIDE YARD REQUIREMENTS AND SECTION 410.C - ;LOT AND AREA REQUIREMENTS TO ALLOW A RESIDENTIAL STRUCTURE TO ENCROACH THE SIDE BUILDING LINE. THE PROPERTY IS KNOWN AS LOT 18, BLOCK 10, OAK HILLS ADDITION AND IS LOCATED AT 7224 SPRING OAK DRIVE. APPROVED D. M. Shelton Builders is requesting a variance to allow the newly constructed residential structure at 7224 Spring Oak Drive to encroach the side building line. The encroachment is approximately four feet, creating a side yard setback of approximately two feet. A six-foot setback is required. The encroachment is the result of an erroneous survey that was performed on the neighboring parcel at 7220 Spring Oak Drive. Because of the mistaken survey, the structures at 7220 and 7224 Spring Oak Drive were built too close to the respective real southern property line. The residence at 7220 did not seek a variance because they amended the plat to move the property line. Amending the plat to move property lines is not an option in this case because the adjacent parcel is under different ownership. Mr. Johnson explained that staff has found a special condition in that the contractor and City staff had no reason to believe the side building line was different than what was shown on the survey. The house was constructed with good faith of all parties that it complied with the required setback. Because the property to the south was also constructed in the side setback, adequate separation exists between the two structures. Staff recommends approval of the requested variances to Sections 150 - Side Yard Regulations & 41 O.C - Lot & Area Requirements, allowing the newly constructed residence to encroach the side building line by approximately 4 feet. Chairman Duer opened the public hearing and asked the applicant forward. Mr. DeWayne Shelton presented this request. Seeing no proponents and no opponents, the hearing was closed. Mr. Bacon, seconded by Ms. Jauregui, moved to approve BA 2000-04 as requested since the contractor and City staff had no reason to believe the side building line was different than what was shown on the survey.
