The Commission, after a few brief questions on each item, closed the Pre-Session Meeting and retired to the City Council Chambers to begin the regular meeting. CONSIDER THE MINUTES OF THE APRIL 13, 2000 MEETING APPROVED Mr. Davis moved, seconded by Mr. Nehring, to approve the minutes of April 13, 2000. The motion carried unanimously. The Chair announced that the Commission was moving PZ 2000-22, Agenda Item No. 9, to this point in the Agenda. P & Z Minutes April 27, 2000 2 9. PZ 2000-22 PUBLIC HEARING TO CONSIDER THE REQUEST OF MCDONALD ASSOCIATES FOR A SPECIAL USE PERMIT TO ALLOW A 120 FOOT MONOPOLE COMMUNICATIONS TOWER WITH AN EQUIPMENT SHELTER BUILDING ON PROPERTY ZONED 1-2 MEDIUM INDUSTRIAL DISTRICT. THE PROPERTY IS LOCATED ON LOT 3R, BLOCK 7, INDUSTRIAL PARK ADDITION AND ADDRESSED AS 5649 RUFE SNOW DRIVE TABLED Chairman Bowen opened the public hearing and announced that the applicant was requesting that this item be postponed until May 11, 2000. Chairman Bowen asked if there was anyone who would like to speak to this item. There being no one wishing to speak, the Chair asked for a motion. Mr. Blue, seconded by Mr. Welch, moved to table PZ 2000-22 to the May 11 Planning & Zoning Meeting. The motion carried unanimously. P & Z Minutes April 27, 2000 3 4. PS 99-39 REQUEST OF ARCADIA REALTY CORPORATION FOR A FINAL PLAT OF TOWN CENTER ADDITION PHASE I. THE PROPERTY IS LOCATED EAST OF DAVIS BOULEVARD, SOUTH OF MID-CITIES BOULEVARD TO THE WEST SIDE OF THE PROPOSED LAKES AT TOWN CENTER ADDITION APPROVED Arcadia Realty Corporation is proposing a final plat of Town Center Addition Phase I containing 59.647 acres, 236 single family lots, 9 common areas and one drainage right-of-way area. The proposed plat meets the City's Subdivision Ordinances and is in compliance with the adopted Town Center Regulating Plan and Urban Standards. The applicant has made a couple of changes from the preliminary plat. One change is two one-way streets along Common Area LL. The applicant is proposing that Frost Street be northbound only and Winter Park Drive beginning at Common Area LL be southbound traffic only. The Traffic Impact Analysis has been submitted for review to an outside traffic consultant. At a later date, consideration may be needed for the warranting of additional traffic control devices when the streets connect to Davis Boulevard. Necessary revisions were made to the plat as requested by Public Works. Staff recommends approval of the Final Plat of Town Center Addition Phase I with the following conditions: 1. The Traffic Impact Analysis be approved prior to start of construction of civil improvements of Phase I. 2. Only the portion of Lake Way running east/west be renamed as another street. 3. Re-Iabel Common Area CA-11 as either Lot 14, Block I or as Lots 11-14, Block I. Mr. Davis requested that Public Works give consideration to signage and/or other traffic control devices on the one-way streets.- Mr. Davis, seconded by Mr. Laubacher, moved to approve PS 99-39 final plat of Town Center Addition Phase I subject to the engineer's comments and recommendations of Staff: the Traffic Impact Analysis be approved prior to start of construction of civil improvements of Phase I; only the portion of Lake Way running east/west be renamed as another street; re-Iabel Common Area CA-11 as either Lot 14, Block lor as Lots 11-14, Block I. The motion carried unanimously. P & Z Minutes April 27, 2000 4 5. PZ 2000-19 PUBLIC HEARING TO CONSIDER THE REQUEST OF DENNIS PAUL FOR A ZONING CHANGE ON LOT 5, COLLEGE ACRES ADDITION FROM R-3-SINGLE FAMILY RESIDENTIAL TO R-1-S SPECIAL SINGLE FAMILY RESIDENTIAL. LOCA TED AT 8044 GREEN VALLEY DRIVE APPROVED Mr. Paul has submitted a request to rezone approximately 2.10 acres from R-3 Single Family Residential to R-1-S Special Single Family Residential. The property is currently developed with one single-family residence. The applicant noted on his request his reason for rezoning is to build a garage larger than what is allowed in the current zoning of R-3, which is 500 square feet. The R-1-S District allows larger garages or accessory buildings, requires a minimum lot size of one acre and allows the keeping of livestock in a single-family residential district. The request meets the future land use plan, and adjacent land uses are low density residential. Staff recommends the Planning & Zoning Commission approve PZ 2000-19, to rezone Lot 5, College Acres, addressed as 8044 Green Valley Drive, from R3 Single Family Residential to R-1-S Special Single Family Residential. Chairman Bowen opened the Public Hearing and asked for proponents. Mr. Dennis Paul, owner of property, appeared in favor of this request. Chairman Bowen called for opponents. Mr. John Duxbury, 7805 Ember Oaks, questioned the type, size and location of structure proposed to be built, whether the structure must meet the low density residential requirements for aesthetics, roof pitch, exterior finish and whether landscaping for the new structure would be required. The Planning and Zoning Commission and the applicant responded to Mr. Duxbuîy's questions. Seeing no more proponents or opponents, the public hearing was closed. Mr. Nehring, seconded by Mr. Welch, moved to approve PZ 2000-19 changing the zoning on Lot 5 College Acres and addressed as 8044 Green Valley Drive from R3-Single Family Residential to R-1-S Special Single Family Residential. The motion carried unanimously. P & Z Minutes April 27,2000 5 / 6. PZ 2000-21 PUBLIC HEARING TO CONSIDER THE REQUEST OF WINKELMANN & ASSOCIATES TO AMEND THE COMPREHENSIVE LAND USE PLAN FROM LOW DENSITY RESIDENTIAL TO COMMERCIAL AT THE NORTHWEST CORNER OF PRECINCT LINE ROAD AND MID-CITIES BOULEVARD IN THE 6400 BLOCK OF PRECINCT LINE ROAD TABLED Winkelmann & Associates has submitted a request to amend the Comprehensive Land Use Plan from low density residential to commercial at the northwest corner of Precinct Line Road and Mid-Cities Boulevard. When the existing land use plan was developed, Mid-Cities Boulevard was not in place and Precinct Line Road was not a seven-lane thoroughfare at this location. Surrounding future land uses are commercial to the north and south and low-density residential to the west. Staff recommends approval of PZ 2000-21 . Chairman Bowen opened the Public Hearing and called for proponents. Mr. Michael Clark, Winkelmann & Associates, spoke in favor of the amendment to the land use plan. Mr. Davis explained to the audience that two separate items were being considered. The first item is a request to amend the Comprehensive Land Use Plan and the next agenda item is consideration of the site plan. Mr. Davis advised that it would be his recommendation that the Commission table this item and consider this area along with the review and update of the entire Land Use Plan. Several citizens supported a park being located on the property. Chairman Bowen closed the public hearing. Mr. Davis, seconded by Mr. Nehring, moved to table PZ 2000-21 and the Commission will address the land use for this area at the time the Commission considers the update of the entire Comprehensive Land Use Plan. PZ 2000-20 PUBLIC HEARING TO CONSIDER THE REQUEST OF WINKELMANN & ASSOCIATES FOR A ZONING CHANGE ON 17.681 ACRES FROM R-1 SINGLE FAMILY RESIDENTIAL AND C-1 COMMERCIAL TO PD-PLANNED DEVELOPMENT FOR HOME DEPOT, A HOME IMPROVEMENT CENTER WITH OUTDOOR SALES, RENTAL AND DISPLAY. THE PROPERTY IS LOCATED AT THE NORTHWEST CORNER OF PRECINCT LINE ROAD AND MID-CITIES BOULEVARD IN THE 6400 BLOCK OF PRECINCT LINE ROAD DENIED Winkelmann & Associates is requesting a change in zoning at the northwest corner of Precinct Line and Mid-Cities Boulevard. The applicant is requesting a change in zoning of 17.681 acres from C-1 Commercial and R-1 Single Family Residential to Planned Development for a home improvement center (Home Depot). Home Depot is proposing to construct a building containing 110,000 square feet and a garden center containing 28,917 square feet. Shaded areas containing 28,447 square feet are shown on the site plan along the front and sides for outdoor sales and display. Other items to be included with the Planned Development are: 1) area in far north will remain residential zoning; 2) construction of an 8 foot masonry screening wall to the north; 3) no access from Martin Drive to this site; 4) one entrance on Precinct Line and three entrances along Mid-Cities with one designated as truck traffic (truck traffic entrance to be right-in only); 5) main entrance will have left-hand turning capability and access to a median; 6) preservation of as many trees as possible along the fence line and adjusting the masonry screening wall to save as many trees as possible; 7) planting significant number of additional trees - two trees along the front area to help shade the loading dock and provide additional buffering; 8) setback from the western property line to the actual building is 136 feet; and 9) will not be a 24-hour operation but will have limited hours. The applicant is meeting all of the landscape requirements. Home Depot is proposing to provide 30% of the total lot as landscaped area. Home Depot has also requested the following items to be part of the Planned Development - 1) a masonry screening -wall not be required around the front corner lot; 2) deletion of the screening wall at the trash compactor; 3) delete the cul-de-sac requirements at the west termination of Wayne Lane; 4) allow open channel to be unlined to satisfy the Corps of Engineers mitigation requirements; 5) allow exterior building elevation articulation variations from the ordinance on the front and side elevations facing Precinct Line Road and Mid-Cities Boulevard; 6) delete screening requirements for transformer and generator because of the location on the site; 7) permit Garden Use; and 8) permit Garden Center fence increase to 12 feet. Staff recommends approval of PZ 2000-20 rezoning proposed Lot 1, Block 1, Home Depot Addition to Planned Development from R-1 Single Family and C-1 Commercial with the stipulations included in the agenda packet and the above outlined stipulations. Chairman Bowen opened the public hearing and called for any proponents. Mr. Michael Clark, Winkelmann & Associates, representing Home Depot presented the request. Mr. Clark clarified that the two lots adjacent to Martin Drive were not a part of the rezoning request. Home Depot is proposing to construct an 8-foot masonry wall cutting these two lots off from the continuity of the Home Depot development. Additionally, they are proposing a large buffer on the west end and the north end between the homeowners and the proposed store. Mr. Clark reviewed the proposed landscaping, setbacks, access to the property, the request for outside storage, the outside lighting and the requests for variances. Mr. Clark advised that the Traffic Impact Analysis study indicates that with Home Depot at this location the level of service on the roadways is well within serviceable levels and will remain well within serviceable levels. Home Depot is proposing a deceleration lane on Mid-Cities Boulevard, which the Traffic Impact Analysis did not represent as being warranted. Home Depot will also propose to TxDOT that they will restripe the shoulder on Precinct Line to be a deceleration lane until such time as it is opened in its entirety. Mr. Clark advised the Commission that Home Depot's reason for not wanting to place normal screening around the emergency generator is that when masonry is placed close to a travel way it tends to be hit and becomes a maintenance issue. Mr. Davis felt the entrance at the southeast corner of the property was too close to Precinct Line and the only access easement should be the easement for access to the loading/unloading area. Mr. Clark advised that the hours of operation for Home Depot would be 6:00 a.m. to 10:00 p.m. Monday through Saturday and 7:00 a.m. to 7:00 p.m. Sunday. Mr. Clark agreed to include as part of the planned development application a statement that no access would be allowed to Martin Drive and to place verbiage on the site plan as well. Mr. John McCutchen, Casco, 10877 Watson Road, St. Louis Missouri, Architectural Engineering Consultants for Home Depot, addressed the proposed elevations. The canopies will be more detailed than the typical Home Depot with a concrete panelized finish as opposed to the steel tubed columns. The walls will be a textured concrete finish. Hill, 6324 Rogers Road Christopher Agar, 6501 Parkway Avenue Robin Eddins, 8628 Crestview Roxie Powell, 6544 Riddle Marti Agar, 6501 Parkway Avenue Nicole Buckingham, 9100 Martin Concerns expressed by the opponents included: whether there would be access to Martin Drive, drainage concerns on Rogers Drive, increase in traffic and traffic safety issues, devaluation in property values and quality of life, parking lot lights shining into people's homes, hours of operation, traffic safety concerns for students at Birdville High School, and noise and trash issues. There was general opposition against commercial zoning in that area and it was felt that it should remain residential and be developed as residential. Several also expressed a desire for the area to be developed as a park. Ms. Robin Eddins presented a petition to the Commission containing approximately 120 signatures opposing the change in zoning to allow the construction of Home Depot Concerns listed on the petition were 1) dramatic increase in traffic in the immediate vicinity of two school zones not in the best interest of the students; and 2) increase in noise pollution, light pollution, and traffic bringing about a decline in property values. Chairman Bowen closed the public hearing. After comments by the Commissioners, Mr. Nehring, seconded by Mr. Blue, moved to deny PZ 2000-20. Motion carried unanimously. P & Z Minutes April 27, 2000 10 Mr. Davis stated that if the applicant chose to appeal to the City Council, for the record the Commission felt the following should be taken into consideration 1) east entrance on Mid-Cities be deleted and that the site plan be amended to show an access easement change for the out parcels fronting on Precinct Line Road; 2) building should be split face masonry instead of just a concrete wall; 3) should have permanent irrigation on the entire property (trickle systems for the trees and irrigation where there will be mowing); 4) that the hours of operation be 6:00 a.m. to 10:00 p.m. Monday through Saturday and 7:00 a.m. to 7:00 p.m. Sunday; and 5) site plan should state that there will be no access to Martin Drive. P & Z Minutes April 27, 2000 11 8. PS 2000-16 REQUEST OF WINKELMANN & ASSOCIATES FOR A PRELIMINARY PLAT OF LOTS 1 & 2, BLOCK 1, HOME DEPOT ADDITION. LOCATED AT THE NORTHWEST CORNER OF PRECINCT LINE ROAD AND MID-CITIES BOULEVARD IN THE 6400 BLOCK OF PRECINCT LINE ROAD APPROVED Mike Clark of Winkelmann & Associates is proposing a preliminary plat of Lots 1 and 2, Block 1 Home Depot Addition containing 17.31 acres. The Traffic Impact Analysis has been submitted and is being reviewed. The applicant is addressing the engineering comments. Staff recommends approval of the preliminary plat with the condition that zoning will have to be approved and the Traffic Impact Analysis approved by staff prior to submittal of final plat. Mr. Davis, seconded by Mr. Laubacher, moved to approve PS 2000-16 subject to engineer's comments with the additional comment that the final plat show any pertinent access easement changes as shown on an approved site plan.
