CALL TO ORDER The meeting was called to order by Dr. Tom Duer at 7:00 p.m. 2. CONSIDERATION OF MINUTES APPROVED Mr. David Whitson moved to approve February 15, 2001 minutes. Seconded by Leslie Jauregui, the motion carried unanimously (5-0). 4. BA-2001-06 PUBLIC HEARING TO CONSIDER THE REQUEST BY MARVIN SMITH FOR A APPEAL OF DETERMINATION OF NON-COMPLIANCE TO NORTH RICHLAND HILLS ZONING ORDINANCE NO. 1874: ARTICLE 10, SECTION 1025C SCREENING AND FENCING REGULATIONS. APPROVED 1 Mr. John Pitstick, Director of Economic Development summarized the appeal for the board saying that Mr. Marvin Smith received a permit to build fences along the front property line adjacent to two homes under construction on Bursey Road. Upon completion of the fences, it was discovered that he did not have the recommended masonry columns that were required by the city ordinance. Although the ordinance is not completely clear in terms of requiring columns on 4' tall fences, it is absolutely clear on requiring columns on 6' fences. In 2000, the board denied a similar request to vary the ordinance for a 5' ornamental fence. At this time staff wrote a policy statement identifying that the columns requirement would apply to all fences 4 feet and above. The board discussed that a four-foot masonry and ornamental fence could look too busy with the inclusion of columns every 20 feet. They were unclear as to the intent of the ordinance as originally approved by the council. Chairman Tom Duer entertained a motion. Mr. Bill Shopper motioned, seconded by Mr. Kyle Bacon, to grant the appeal. The motion carried (4-1). 5. BA 2001-07 PUBLIC HEARING TO CONSIDER THE REQUEST BY MARVIN SMITH FOR VARIANCES TO NORTH RICH LAND HILLS ZONING ORDINANCE NO. 1874: ARTICLE 10, SECTION 1025C, SCREENING WALL AND FENCE CRITERIA REQULA TIONS TO ALLOW CONSTRUCTION OF A WROUGHT IRON FENCE IN THE FRONT YARD WITHOUT MASONRY COLUMNS. THE PROPERTY IS KNOWN AS LOTS 1-4, BLOCK 1, PENNINGTON ESTATES AND IS LOCATED AT 7200, 7206, 7212 AND 7218 BURSEY ROAD. WITHDRAWN The variance case was withdrawn after the Board granted the appeal. 6. ADJOURNMENT Having no additional business to conduct, the meeting adjourned at 7:20 p.m. 7~Þ~ Chairman Tom Duer 2
