MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF
ADJUSTMENT OF THE CITY OF NORTH RICH LAND HILLS, TEXAS
August 16, 2001

CALL TO ORDER
The meeting was called to order by Dr. Tom Duer at 7:08 p.m.

Recording Secretary Kellie Smith administered the Oath of Office to
Chairman Tom Duer, reappointed to Place 5, and Leslie Jauregui,
reappointed to Place 1. Kellie Smith also administered the Oath of Office to
newly appointed Jim Kemp, Place 3, Alternate, and Jim Allen, Place 7.

CONSIDERATION OF MINUTES
Chairman Tom Duer asked for approval on the March 15, 2001 minutes. The
vote carried unanimously (5-0).
Chairman Tom Duer explained the voting requirements of the Zoning Board
of Adjustment. The Board requires a super majority vote of 4-0 to pass a
case when only four voting members are present. Since there are five
members present this evening, a super majority of four affirmative votes
will result in approval of the applicant's request.

BA-2001-09
PUBLIC HEARING TO CONSIDER THE REQUEST BY MICHAEL AND
YOLANDA SANDERS FOR A VARIANCE TO NORTH RICH LAND HILLS
ZONING ORDINANCE NO. 1874: ARTICLE 6, SECTION 630D ACCESSORY
STRUCTURES AND BUILDINGS TO ALLOW CONSTRUCTION OF A
CARPORT. THE PROPERTY IS KNOWN AS LOT 10, BLOCK 7, HOLIDAY
NORTH ADDITION AND IS LOCATED AT 5817 CRESTWOOD CIRCLE WEST.

Cathy Horton, Zoning Administrator, presented the case to the board. Mr.
Sanders is requesting a variance to build a 16' (wide) by 14' (long) flat-roofed,
wooden carport with brick columns over the existing driveway. The carport would
extend from the front of the garage into the required 25' setback. The applicant
is also requesting a variance from the required 4:12 roof pitch.
The applicant is requesting the carport so that his welding equipment will be
protected from the weather. The applicant submitted signatures of support from
nearby neighbors. Staff has received one letter in opposition to the request.
The applicant's situation is self-imposed. No other front yard carports exist in the
neighborhood.
Dr. Rick Enlow asked whether the applicant's roof is pitched or gabled? The
applicant replied that it is gabled. Dr. Enlow commented that if the applicant
meets the 25' setback, provides a pitched roof, and then follows the building
codes, he would not need a variance. However, after further discussion between
the Zoning Board and the applicant, it was determined that the applicant's
garage pitch sits on the property line and therefore the entire carport will
encroach into the 25' front yard setback line.
Dr. Rick Enlow also commented that the City Council has asked the Board to not
allow carports to be built to the street unless a significant hardship exists.
Should the variance not be approved, he suggested the alternative of a side
carport or the use of a tarp to protect the applicant's welding equipment. The
applicant replied that the covers he has had made melted the compressors and
welders. Dr. Enlow suggested a thick cotton duck material which would not
leave a residue or melt.
The Chairman closed the public hearing and asked for discussion or a motion by
the Board.
Jim Allen motioned to approve BA-2001-09. The motion failed due to lack of a
second.

Chairman Tom Duer then motioned, seconded by Jim Kemp, to approve BA-
2001-09 with the stipulation that the pitched roof match the home, and the brick
columns match the brick of the home. The motion was approved 4-1 with Board
member Leslie Jauregui voting against.
