MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF
ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS

The meeting was called to order by Dr. Tom Duer at 7:00 p.m.

CONSIDERATION OF MINUTES
Chairman Tom Duer asked for a change on the minutes of August 16, 2001.
The changes will be reconsidered in the next meeting.
Chairman Tom Duer explained the voting requirements of the Zoning Board
of Adjustment. The Board requires a super majority vote of 4-0 to pass a
case when only four voting members are present. Since there are five
members present, a super majority of four affirmative votes will result in
approval of the applicant's request.

ZBA 2001-10
PUBLIC HEARING TO CONSIDER A REQUEST BY DAVID AND VELMA
LAND FOR A VARIANCE TO THE NORTH RICHLAND HILLS ZONING
ORDINANCE NO. 1874, ARTICLE 6, SECTION 630D ACCESSORY
STRUCTURES AND BUILDINGS. THE PROPERTY KNOWN AS LOT 8,
BLOCK 7, SNOW HEIGHTS ADDITION AND IS LOCATED AT 7017 MARILYN
LANE.
APPROVED
Cathy Horton, Zoning Administrator, presented the case to the board. Mrs. Land
is requesting a variance to build a 17'6" (wide) by 20' (long) pitched-roofed
carport with ornamental iron columns over the existing driveway. The carport
would extend from the front of the garage into the required 25' setback by
approximately 7'. The applicant is requesting variances from the required 25'
front yard setback and the requirement for masonry support columns.
The applicant has cited accessibility and health concerns as reasons for this
request. Staff has received one letter in opposition to the request.
The Chairman opened the public hearing.
Velma Land, of 7017 Marilyn Lane, stated they purchased the home in 1997 and
the garage had already been converted. She recently suffered from a stroke,
and her husband suffers from asthma, prostate cancer and walks with
assistance. Due to these health reasons, a carport is being requested so that
movement to and from vehicles would be shielded from the weather. Mrs. Land
feels that ornamental iron would visually be more pleasing, and that the wooded
post on the house would be replaced with ornamental iron for consistency sake.
Pictures were provided to the Board of the home in question and homes in the
area with carports.
The Chairman closed the public hearing and asked for discussion or a motion by
the Board.
Bill Schopper, seconded by Jim Allen, motioned to approve. The motion carried
4-1 with Leslie Jauregui voting against. Finding of Fact being health reasons
and hardship to the applicant, and hardship is neither self-imposed nor generally
affecting all or most properties in the same zoning district.
