MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF
ADJUSTMENT OF THE CITY OF NORTH RICH LAND HILLS, TEXAS
October 18, 2001

CALL TO ORDER
The meeting was called to order by Dr. Tom Duer at 7:00 p.m.

CONSIDERATION OF MINUTES
Chairman Tom Duer asked for approval on the September 20, 2001 minutes.
Jim Allen, seconded by Leslie Jauregui motioned to approve the minutes of
September 20,2001. The vote carried unanimously (5-0).
Chairman Tom Duer explained the voting requirements of the Zoning Board
of Adjustment. The Board requires a super majority vote of 4-0 to pass a
case when only four voting members are present. Since there are five
members present this evening, a super majority of four affirmative votes
will result in approval of the applicant's request.

BA-2001-11
PUBLIC HEARING TO CONSIDER THE REQUEST BY DAVID POKLUDA
REPRESENTING ALAMO CUSTOM HOME BUILDERS INC. FOR A
VARIANCE TO NORTH RICHLAND HILLS ZONING ORDINANCE NO 1874:
ARTICLE 4, SECTION 410. THE APPLICANT IS REQUESTING PERMISSION

TO CONSTRUCT A NEW HOUSE THAT WILL ENCROACH APPROXIMATELY
2' 4" INTO THE REQUIRED 20' FRONT BUILDING SETBACK. THE
PROPERTY IS KNOWN AS LOT 13, BLOCK 1 RICHFIELD AT THE PARKS
ADDITION AND IS LOCATED AT 6728 LUCAS LANE
APPROVED
Cathy Horton, Zoning Administrator, presented the case to the board. The
applicant is planning to build a new home on this vacant lot. It has 3 street
frontages. The property has a 20' required setback on Lucas Lane, and 20'
setbacks on both Lucas and Blythe Courts. The property is zoned R-3 1800.
Mr. Pokluda requested an encroachment of 2'4" on only one setback. Due to the
uniqueness of this lot configuration staff supports this request.
Dr. Tom Duer opens the public hearing.
Mr. David Pokluda, 6341 Skylark Cr., North Richland Hills, TX 76180 explained
the difficulty of the configuration of this lot and requested approval from the
Zoning Board of Adjustment members.
Bill Schopper, seconded by Leslie Jauregui motioned to approve BA 2001-11.
The motion carried unanimously (5-0).
