CALL TO ORDER The meeting was called to order by Dr. Tom Duer at 7:04 p.m. ROLL CALL Present Chairman Dr. Tom Duer Dr. Rick Enlow Jim Kemp Bill Schopper Absent Jim Allen Leslie Jauregui City Staff Zoning Administrator Recording Secretary Cathy Horton Lisa Juren 2. CONSIDERATION OF MINUTES Chairman Tom Duer asked for approval on the October 18, 2001 minutes. Jim Kemp, seconded by Bill Schopper motioned to approve the minutes of October 18, 2001. The vote carried unanimously (4-0). Chairman Tom Duer explained the voting requirements of the Zoning Board of Adjustment. The Board requires a super majority vote of 4-0 to pass a case when only four voting members are present. Since there are four members present this evening, a super majority of four affirmative votes will result in approval of the applicant's request. 3. BA-2001-12 PUBLIC HEARING TO CONSIDER THE REQUEST BY RIC VINSON FOR VARIANCES TO NORTH RICHLAND HILLS ZONING ORDINANCE NO. 1874: ARTICLE 6, SECTIONS 630 E 7 AND E 13. THE APPLICANT IS ZBA Minutes November 15, 2001 1 REQUESTING PERMISSION TO CONSTRUCT A GARAGE THAT WILL EXCEED THE MAXIMUM SIZE PERMITTED. ADDITIONALLY THE APPLICANT PROPOSES TO USE MATERIALS THAT DO NOT COMPLY WITH THE DESIGN CRITERIA OF THE ORDINANCE. THE PROPERTY IS KNOWN AS LOT 17, BLOCK 16 OF THE NORTH RICHLAND HILLS ADDITION AND IS LOCATED AT 4709 DEVILLE DRIVE. APPROVED Cathy Horton, Zoning Administrator, presented the case to the board. The applicant is proposing to construct a detached garage at the above address, which is located in an R-2 Residential District. The three car garage will be approximately 986 square feet in size. Section 630 E 7 of the Zoning Ordinance limits detached garages in the R 1, R2 and R3 Districts to a maximum of 500 square feet. The R1(S) and AG Agricultural were established to permit large accessory buildings. These districts allow up to 5% of the lot area to be used for accessory building such as a garage. The applicant is requesting a variance of 486 square feet or almost double the maximum allowed by ordinance. The applicant states that this variance is necessary to allow the parking of his vehicles on his property rather than in the street. In addition, the applicant is requesting to construct the garage using masonite or hardy plank material. The Ordinance requires accessory buildings to be constructed of a minimum 75% masonry material. The applicant states that matching the brick to his existing residence is impossible. In 1999 the applicant received a variance to use masonite material to construct an addition to his residence. The applicant would like to use the same material on the garage so that the existing character of his property and the area would be maintained. Several letters of support have been received for this case. Chairman Tom Duer opens the public hearing. Applicant Ric Vinson, 4709 Deville Drive, explained the reasons for the application for the variances and showed pictures of the home and samples of the materials he proposes to use. He stated he spoke to every surrounding neighbor and found all in support of his case. John Holt of 4712 Deville Drive, Bobby Kennedy of 4609 Deville Drive and Kim Mason of 4704 Deville Drive all spoke in favor of Mr. Vinson's case. Chairman Tom Duer closes the public hearing. Jim Kemp asked the applicant about the size of the lot. Mr. Vinson states it is .484 in size. ZBA Minutes November 15, 2001 2 Chairman Tom Duer asked for a motion by the board. Rick Enlow, seconded by Jim Kemp, motioned to approve BA 2001-12. The motion carried unanimously (4-0). 4. CITIZEN COMMENTS There were none. 5. MISCELLANEOUS REPORTS & DISCUSSIONS There were none. 6.
