MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF
ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS
DECEMBER 20, 2001

The meeting was called to order by Dr. Tom Duer at 7:03 p.m.

CONSIDERATION OF MINUTES
Chairman Tom Duer asked for approval on the November 14, 2001 minutes. Jim
Kemp, seconded by Bill Schopper motioned to approve the minutes of November
14,2001. The vote carried unanimously (5-0).
Chairman Tom Duer explained the voting requirements of the Zoning Board
of Adjustment. Since there are five members present this evening, a super
majority of four affirmative votes will result in approval of the applicant's
request.

PUBLIC HEARING TO CONSIDER A REQUEST BY ALBERT ALEXANDER
FOR VARIANCES TO NORTH RICHLAND HILLS ZONING ORDINANCE NO.
1874: ARTICLE 6, SECTIONS 630 E 3, E 7, E 11, AND E 13. THE
APPLICANT IS REQUESTING A VARIANCE TO THE REQUIRED 25' FRONT
SETBACK FOR A CARPORT IN AN R-2 ZONING DISTRICK, VARIANCES TO

THE REQUIRED BUILDING MATERIALS, THE MAXIMUM SQUARE

AND IS LOCATED AT 5116 BOB DRIVE.

Cathy Horton, Zoning Administrator, presented the case to the board. The
applicant of the request indicated that a carport was built without his knowledge
as a gift. Approximately two weeks after the construction took place, a code
enforcement officer noticed that the structure was built in a required building
setback area. After researching the situation she discovered that no building
permit was issued for the structure. The purpose of the request is to seek ZBA
approval for several variances to allow the structure to remain. If this case is not
approved in its entirety the structure will have to be removed by the property
owner.
Necessary variances include a variance to the required 25' front yard setback;
the structure encroaches by approximately 25'. A variance to the maximum size
for a carport. The ordinance limits the size to 360 square feet. This structure is
528 square feet in size. Variance to the use of the structure. The ordinance
does not allow carports to be used for business purposes. The applicant, in his
letter, indicated that he works on vehicles as a non-profit entity. This is not
permitted to occur in a residential zoning district. Variances to the required
building materials. The ordinance requires carports to be constructed with a
minimum 4/12 roof pitch, that the roof materials be similar to those used on the
primary structure, and that all of the supporting poles be enclosed with brick.
This carport is entirely metal with no enclosures around the poles.
Several letters of opposition were received for this case. Staff recommends
denial of this request and that the structure be removed.

Applicant Albert Alexander, 5116 Bob Drive, explained the reasons for the
application for the variances and presented pictures to the commission prior to
the meeting. He stated he spoke with surrounding neighbors and found there
was opposition of his case. He went on to say that he appreciated all the help
from the staff and consideration of the Board, but in fairness to his long time
neighbors and respect to ordinances, he would withdraw the case and have the
structure removed by January 15, 2002.
