MOTION TO APPROVE CARRIED 7-0. B.2 LRB23-0006 CONSIDERATION OF A REQUEST FROM AXIOM RK CONSTRUCTION LLC FOR A PERMIT FOR NONCONFORMITY TO CHAPTER 114 (VEGETATION) OF THE NORTH RICHLAND HILLS CODE OF ORDINANCES AT 7120 RUFE SNOW DRIVE, BEING 8.20 ACRES DESCRIBED AS LOT 1, BLOCK A, RUFE SNOW VILLAGE ADDITION. APPROVED Acting Chair Deupree called on Principal Planner Clayton Husband to introduce the item. Mr. Husband informed City Council the applicant is requesting a permit for nonconformity to Chapter 114 (Vegetation) of the North Richland Hills Code of Ordinances at 7120 Rufe Snow Drive. Mr. Husband provided site photos of the property. Richard Atwell with Axiom RK Construction, 20516 Elder Road, Conroe, Texas 77385 and Steve Miner with SMA Architects, 115 West Main Street, Allen, Texas 75013 presented the request. Mr. Atwell provided an overview of the existing property being a retail building constructed in 1996 on 8.2 acres with 373 parking spaces. The existing building value is $2.5 million and a construction value of $4.5 million. Mr. Atwell reviewed the proposed request for permit for nonconformity, stating the permit requested is to consider an alternative landscape plan that makes incremental landscaping improvements with the property still being non-conforming. Mr. Husband presented a summary of the non-conformity request. The proposed landscape area required is 15% of total lot area, the applicant proposes 15.9%. The landscape setback requires a 15-foot setback adjacent to all public streets, one large tree per 50 feet of frontage and ten shrubs per 50 feet of frontage. Rufe Snow Drive requires six (6) large trees and 60 shrubs. Hightower Drive requires 13 large trees and 130 shrubs. The applicant proposes on Rufe Snow Drive a 10-foot setback on entire frontage, five (5) existing trees and one (1) new tree to be planted in setback. The applicant proposes on Hightower Drive a 10-foot setback for 34% of frontage and a 15-foot setback for the remaining frontage, twelve (12) existing trees and one (1) new tree and 151 shrubs to be planted in the setback. The parking lot landscaping requires a minimum area of 5% of the parking lot in landscaped area, one (1) tree in island per 20 parking spaces, each parking space July 10, 2023 Landscape Review Board Meeting Minutes Page 2 of 3 within 100 feet of a parking lot island tree. The applicant proposes 4.4% of parking lot in landscaped area, seven (7) existing trees provided in parking area, seven (7) trees to be planted in the parking area adjacent to the building, and all parking spaces would be within 100 feet of a parking lot island tree. Lastly, buffer requirements related to the adjacent residential property on the north and east property lines require masonry screening walls; six (6) to eight (8) feet in height, 15-foot landscape buffer yard, one (1) large tree per 30 linear feet, and at least 40% of trees must be evergreen. On the North property line the applicant is proposing the existing six (6) foot tall masonry screening wall, five (5) foot wide landscape buffer yard, 43 ornamental trees to be planted in lieu of large trees. On the East property line the applicant is proposing the existing six (6) foot tall masonry screening wall, 48-foot wide landscape buffer yard and 16large trees to be planted with 50% being evergreen. Mr. Husband was available to answer questions from the Board. The Board, applicant, and staff discussed tree and fence line irrigation, fence panel and fence cap replacement, condition of utility pole, condition and improvement to the base of lighting poles, condition and replacement of damaged fence areas, code enforcement purview, and the length of time the property has been vacant. A MOTION WAS MADE BY BOARD MEMBER WRIGHT OUIESKY, SECONDED BY BOARD MEMBER TURNAGE TO APPROVE LRB23-0006, WITH THE STIPULATIONS THAT ALL REQUIRED AREAS HAVE IRRIGATION, CONCRETE AT BOTTOM OF UTILITY POLES ARE SANDBLASTED, PRUNE TREES, AND CAPS ON FENCE TO BE REPAIRED. MOTION TO APPROVE CARRIED 7-0. C. ADJOURNMENT Acting Chair Deupree adjourned the Landscape Review Board meeting at 8.15 p.m. Kelvin Deupree, Acting Chair Traci Henderson Assistant City Secretary July 10, 2023 Landscape Review Board Meeting Minutes Page 3 of 3 "K NOKTH KICHLAND HILLS LANDSCAPE REVIEW BOARD MEMORANDUM FROM: The Office of the City Manager DATE: January 22, 2024 SUBJECT: LRB23-0007 Public hearing and consideration of a request from Trinity Partners Commercial Real Estate LLC for a variance to Chapter 114 (Vegetation) of the North Richland Hills Code of Ordinances at 8633 Davis Boulevard, being 0.9791 acres described as Lot 2R2R, Block 1, Watermere on the Preserve. PRESENTER: Clayton Comstock, Planning Director SUMMARY: Trinity Partners Commercial Real Estate LLC is requesting a variance to Chapter 114 (Vegetation) of the North Richland Hills Code of Ordinances. The site is located at 8633 Davis Boulevard. The applicant is requesting a variance from the masonry screening wall and landscape buffer requirement adjacent to residential property. GENERAL DESCRIPTION: The site is located on the west side of Davis Boulevard south of the intersection of Precinct Line Road, and in front of the Watermere on the Preserve independent senior- living apartment development. The 42,651-square-foot lot is the site for the construction of an 8,377-square-foot multitenant retail building. The property is zoned PD (Planned Development) with a C-1 (Commercial) base district. A replat of the property was approved by City Council on May 9, 2022. The landscaping and buffering standards that apply to this property are found in Article III, Landscaping and Buffering Regulations of Chapter 114 (Vegetation) of the Code of Ordinances. The Development Review Committee reviewed the landscape plan for the property as part of the site plan application for the project. The plan meets the requirements of the landscaping and buffering regulations with the exception of the standards described below. Sections 114-72(b) and 114-72(c)(2) of the landscaping regulations establish standards for buffer yards between commercial and residential land uses. These standards require a 15-foot wide landscape buffer yard and the construction of a six- to eight-foot tall masonry screening wall. Since the adjacent Watermere project is considered a residential property, the retail building site requires a buffer yard and masonry screening wall to be constructed on the common property line. The applicant is requesting a reduction in the width of the landscape buffer yard and a waiver of the screening wall requirement. The applicant is requesting that the landscape plan be approved with a modified buffer yard adjacent to the residential property. The buffer yard is required to be 15 feet deep, "K NOKTH KICHLAND HILLS and the applicant is requesting that a 13.5-foot buffer yard be permitted. The reduced depth buffer yard allows for full-size parking spaces to be constructed on the site. The landscape area on the site is 7,153 square feet (17%), which exceeds the 15% landscape area requirement. The retail building site is at a higher elevation than the Watermere site, with a difference ranging from 13 to 15 feet. In lieu of the screening wall, the developer proposes to install a solid landscape screen adjacent to the ornamental metal fence. The screen would include a hedge row of thirty-three (33) Dwarf Abelia shrubs and three (3) Live Oak trees, both of which are evergreen species. A similar screening arrangement was approved on the Dutch Bros coffee and Wild Fork Foods lots adjacent to the subject site. The applicant's proposed landscape plan is attached. The table below summarizes the applicable standards and describes the applicant's proposal to mitigate the deficiency. STANDARD REQUIRED PROPOSED Buffer yard between zoning districts Sec. 114-72(b) • 15-foot wide buffer yard between • 13.5-foot wide buffer yard Buffer requirements commercial and residential districts Nonresidential adjacent to residential: • Screening wall not provided. Living screen Sec. 114-72(c)(2) • Masonry screening wall(6-8 feet height) proposed in lieu of wall. Buffer requirements • One large tree per 30 linear feet • 3 Live Oak provided (6 required) • 40%of trees must be evergreen • 33 Dwarf Abelia provided(none required) iY Live Oak Dwarf Abelia Quercus virginiana Abelia x "Edward Goucher' The request is being processed as a variance application, which would waive certain landscaping standards for the office development. The Board may include appropriate conditions as part of the approval of a variance request. The affirmative vote of four Board members is required to approve a variance. A public hearing is required for consideration of a request for variance. Notice of the public hearing was published in the newspaper and mailed to all owners of real property within 200 feet of the site. "K NOKTH KICHLAND HILLS RECOMMENDATION: Approve LRB23-0007.
