PUBLIC COMMENTS There were no requests to speak from the public. B. ACTION ITEMS B.1 APPROVE MINUTES OF THE JANUARY 23, 2023 LANDSCAPE REVIEW BOARD MEETING. APPROVED July 10, 2023 Landscape Review Board Meeting Minutes Page 1 of 3 A MOTION WAS MADE BY BOARD MEMBER TURNAGE, SECONDED BY BOARD MEMBER RODRIGUEZ TO APPROVE MINUTES OF THE JANUARY 23, 2023 LANDSCAPE REVIEW BOARD MEETING. MOTION TO APPROVE CARRIED 7-0. B.2 LRB23-0006 CONSIDERATION OF A REQUEST FROM AXIOM RK CONSTRUCTION LLC FOR A PERMIT FOR NONCONFORMITY TO CHAPTER 114(VEGETATION) OF THE NORTH RICHLAND HILLS CODE OF ORDINANCES AT 7120 RUFE SNOW DRIVE, BEING 8.20 ACRES DESCRIBED AS LOT 1, BLOCK A, RUFE SNOW VILLAGE ADDITION. APPROVED Acting Chair Deupree called on Principal Planner Clayton Husband to introduce the item. Mr. Husband informed City Council the applicant is requesting a permit for nonconformity to Chapter 114(Vegetation) of the North Richland Hills Code of Ordinances at 7120 Rufe Snow Drive. Mr. Husband provided site photos of the property. Richard Atwell with Axiom RK Construction, 20516 Elder Road, Conroe, Texas 77385 and Steve Miner with SMA Architects, 115 West Main Street, Allen, Texas 75013 presented the request. Mr. Atwell provided an overview of the existing property being a retail building constructed in 1996 on 8.2 acres with 373 parking spaces. The existing building value is $2.5 million and a construction value of $4.5 million. Mr. Atwell reviewed the proposed request for permit for nonconformity, stating the permit requested is to consider an alternative landscape plan that makes incremental landscaping improvements with the property still being non-conforming. Mr. Husband presented a summary of the non-conformity request. The proposed landscape area required is 15% of total lot area, the applicant proposes 15.9%. The landscape setback requires a 15-foot setback adjacent to all public streets, one large tree per 50 feet of frontage and ten shrubs per 50 feet of frontage. Rufe Snow Drive requires six (6) large trees and 60 shrubs. Hightower Drive requires 13 large trees and 130 shrubs. The applicant proposes on Rufe Snow Drive a 10-foot setback on entire frontage, five (5) existing trees and one (1) new tree to be planted in setback. The applicant proposes on Hightower Drive a 10-foot setback for 34% of frontage and a 15-foot setback for the remaining frontage, twelve (12) existing trees and one (1) new tree and 151 shrubs to be planted in the setback. The parking lot landscaping requires a minimum area of 5% of the parking lot in landscaped area, one (1) tree in island per 20 parking spaces, each parking space July 10, 2023 Landscape Review Board Meeting Minutes Page 2 of 3 within 100 feet of a parking lot island tree. The applicant proposes 4.4% of parking lot in landscaped area, seven (7) existing trees provided in parking area, seven (7) trees to be planted in the parking area adjacent to the building, and all parking spaces would be within 100 feet of a parking lot island tree. Lastly, buffer requirements related to the adjacent residential property on the north and east property lines require masonry screening walls; six (6) to eight (8) feet in height, 15-foot landscape buffer yard, one (1) large tree per 30 linear feet, and at least 40% of trees must be evergreen. On the North property line the applicant is proposing the existing six (6) foot tall masonry screening wall, five (5) foot wide landscape buffer yard, 43 ornamental trees to be planted in lieu of large trees. On the East property line the applicant is proposing the existing six (6) foot tall masonry screening wall, 48-foot wide landscape buffer yard and 16 large trees to be planted with 50% being evergreen. Mr. Husband was available to answer questions from the Board. The Board, applicant, and staff discussed tree and fence line irrigation, fence panel and fence cap replacement, condition of utility pole, condition and improvement to the base of lighting poles, condition and replacement of damaged fence areas, code enforcement purview, and the length of time the property has been vacant. A MOTION WAS MADE BY BOARD MEMBER WRIGHT OUJESKY, SECONDED BY BOARD MEMBER TURNAGE TO APPROVE LRB23-0006, WITH THE STIPULATIONS THAT ALL REQUIRED AREAS HAVE IRRIGATION, CONCRETE AT BOTTOM OF UTILITY POLES ARE SANDBLASTED, PRUNE TREES,AND CAPS ON FENCE TO BE REPAIRED. MOTION TO APPROVE CARRIED 7-0. C.
