A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, CALLING THE CITY RUNOFF
ELECTION TO BE HELD ON JUNE 15, 2024 TO ELECT A
PERSON TO THE OFFICE OF COUNCIL PLACE 4 FOR A TERM
OF TWO YEARS; ESTABLISHING ELECTION DAY VOTING
LOCATIONS; EARLY VOTING; METHOD OF VOTING; AND
PUBLICATION AND POSTING REQUIREMENTS.
WHEREAS, the City of North Richland Hills, Texas ("City") is a home rule city acting
under its charter adopted by the electorate pursuant to Article XI, Section 5
of the Texas Constitution and Chapter 9 of the Local Government code; and
WHEREAS, the City of North Richland Hills Charter provides that city elections shall be
held in accordance with laws of the State of Texas; and
WHEREAS, the City of North Richland Hills held a general election on May 4, 2024 to
elect persons to the office for Mayor and Council Places 2, 4, and 6 to serve
from May 2024 until May of 2026, or until their successors are duly elected
and qualified; and
WHEREAS, the City Council approved Resolution No. 2024-022, canvassing the
election results of the May 4, 2024 general election; and
WHEREAS, no candidate in Place 4 received more than 50% of the vote; and
WHEREAS, Section 2.021 of the Texas Election Code ("Code") requires a runoff election
for an office if no candidate receives the vote necessary to be elected in an
election requiring a majority vote; and
WHEREAS, Section 2.023(a) of the Code provides that candidates in a runoff election
are the candidates who receive the highest and second-highest number of
votes in the main election or who tie for the highest number of votes; and
WHEREAS, Section 2.024 of the Code provides that the runoff election be ordered not
later than the fifth day after the date of the final canvass of the general
election; and
WHEREAS, Section 2.025 of the Code provides that such runoff election shall be held
on a Saturday designated by the Texas Secretary of State; and
WHEREAS, the Texas Secretary of State has designated the date of June 15, 2024 for
said runoff election; and

WHEREAS, the city exercises its option to extend the terms of the joint election
agreement and contract for election services approved by City Council at
its January 22, 2024 meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS:
Section 1. That the recitals set forth above are true and correct and are hereby
incorporated into and made a part of this Resolution.
Section 2. Runoff Election Called. A runoff election is hereby called to elect a person
to Council Place 4 to serve from June 2024 until May of 2026, or until their
successors are duly elected and qualified. The election shall be held on
June 15, 2024 between the hours of 7:00 a.m. until 7:00 p.m.

Qualified North Richland Hills voters will also be able to cast their ballots at
any countywide polling location on Election Day.

Section 3. Joint Election Agreements Extended. The City exercises its option to
extend the terms of the joint election agreement and contract for election
services approved by the City Council at its January 22, 2024 meeting to
the June 15, 2024 runoff election. The election shall be conducted pursuant
to the election laws of the State of Texas.
Section 4. Early Voting.
a. Early voting by personal appearance. Early voting by personal
appearance will be held jointly with other political subdivisions in Tarrant
County beginning on June 3, 2024 and will continue through June 11,
2024 at the locations established by Tarrant County for the runoff

election, on the dates and times as follows or as may be amended by
Tarrant County:
June 3 - 7 8:00 a.m. to 5:00 p.m.
June 8 7:00 a.m. to 7:00 p.m.
June 9 10:00 a.m. to 4:00 p.m.
June 10 - 11 7:00 a.m. to 7:00 p.m.

b. Early voting by mail. Tarrant County Chief Elections Administrator, or
his designee, is hereby designated as Early Voting Clerk for the city's
runoff election. The Tarrant County Chief Elections Administrator may
appoint other deputy early voting clerks as necessary. Applications for
early voting by mail may be delivered to the Chief Elections
Administrator not later than June 4, 2024 if delivered by mail to:

c. Early voting by Ballot Board. Early voting, both by personal
appearance and by mail, shall be canvassed by the Early Voting Ballot
Board, which is hereby created. The Presiding Election Judge and
Alternate Presiding Election Judge, as set forth in the Agreements, shall
serve as the presiding officer and alternate presiding officers,
respectively, of the Early Voting Ballot Board. The other election officers
serving at the election shall serve as the other members of the Early
Voting Ballot Board.
Section 5. Method of Voting. Early voting by personal appearance and voting on
Election Day shall be conducted exclusively on Tarrant County's Hart
InterCivic Verity Voting System. All expenditures necessary for the conduct
of the election, the purchase of materials therefore, and the employment of
all election officials are hereby authorized, and shall be conducted in
accordance with the Agreements and the Code.
Section 6. Governing Law and Qualified Voters. The election shall be held in
accordance with the Constitution of the State of Texas and the Code, and
all resident qualified voters of the City shall be eligible to vote at the election.
Section 7. Publication and Posting of Notice of Election. Notice of the election
shall be given as required by Chapter 4 of the Code.
Section 8. Necessary Actions. Tarrant County will provide all material, supplies and
personnel to hold the runoff election, and will be responsible for
coordinating, supervising and administering the joint election. This
resolution shall be construed with any action of the governing bodies of
other Tarrant County political subdivisions providing for the conduct of a
joint election as herein contemplated. The Mayor and the City Secretary of
the City, in consultation with the City Attorney, are hereby authorized and
directed to take any and all actions necessary to comply with the provisions
of the Code in carrying out and conducting the election, whether or not
expressly authorized herein.
