SUMMARY:
The minutes are approved by majority vote of the Landscape Review Board.
GENERAL DESCRIPTION:
The City Secretary's Office prepares action minutes for each Landscape Review Board
meeting. The minutes for the previous meetings are prepared and provided for review of
the Board. Upon approval of the minutes, an electronic copy will be uploaded to the City's
website.
RECOMMENDATION:
Approve minutes of the January 22, 2024 Landscape Review Board meeting.

HILLS CODE OF ORDINANCES AT 8633 DAVIS BOULEVARD, BEING 0.9791
ACRES DESCRIBED AS LOT 2R2R, BLOCK 1, WATERMERE ON THE
PRESERVE.

Chair Trevino opened the public hearing and called on Director of Planning Clayton
Comstock to introduce the item.
Mr. Comstock informed City Council the applicant is requesting a variance to Chapter
114 (Vegetation) of the North Richland Hills Code of Ordinances for 0.979 acres located
at 8633 Davis Boulevard. Mr. Comstock provided site photos of the property.
Kevin McIntosh with Trinity Partners Commercial Real Estate, LLC, 704 Lindsey Way,
Colleyville, Texas, presented the request. Mr. McIntosh stated they were close to getting
their permit on the 8500 square foot building and seeking a variance on the landscape
buffer by removing 2.5' from landscape buffer and replacing required trees with shrubs.
Mr. McIntosh shared the building lease plan and informed the Board there are currently
three leases on the four available spaces. Leases have been signed for Five Guys,
Einstein Bagels, and Pet Evolution. Mr. McIntosh was available to answer questions from
the Board.
Mr. Comstock presented staff's report and brief summary of the surrounding properties.
Mr. Comstock stated the standard buffer requires a landscape buffer width adjacent to
the residential property, fifteen (15) feet is required, and one (1) tree per thirty (30) feet
with six (6) trees being required. In addition, a masonry screening wall adjacent to the
residential property and a minimum six (6) foot in height is required. Mr. Comstock
reviewed the proposed landscape plan and provided a copy to the Board at the meeting.
The applicant is proposing a thirteen and one half (13.5) foot wide landscape buffer,
living screen in lieu of masonry screening wall and one (1) tree per fifty-five (55) feet

which is three (3) trees. Three (3) live oak trees and forty-one (41) dwarf wax myrtles.
Mr. McIntosh and Mr. Comstock were available to answer questions from the Board.
The Board and staff discussed flexibility of tree type related to root intrusion in the
masonry wall, distance of trees being planted behind masonry wall, and irrigation.
Chair Trevino asked the City Secretary to call on those who completed a public meeting
appearance form to speak during the public hearing. There being no forms submitted,
Chair Trevino asked if there was anyone in the audience wishing to speak for or against
the item to come forward. There being no one wishing to speak, Chair Trevino closed
the public hearing.

SUBJECT: LRB24-0008 Consideration of a request from ARCO Murray for a
permit for nonconformity to Chapter 114 (Vegetation) of the North
Richland Hills Code of Ordinances at 8651 Airport Freeway, being
11.515 acres described as Lot 2R1, Block A, Richland Oaks
Addition.
PRESENTER: Clayton Comstock, Managing Director of Development Services
SUMMARY:
On behalf of 8651 Airport Freeway LLC, ARCO Murray is requesting a permit for
nonconformity in conjunction with a large-scale remodel of an existing building. The
permit for nonconformity would allow improvements to the building to continue without
conforming to the current landscaping and buffering standards. The site is located at 8651
Airport Freeway and was most recently an At Home retail business. Since the permit
value of the building remodel is expected to exceed 75 percent of the 2024 appraised
value of the existing improvements, full compliance with the landscaping standards is
required.
GENERAL DESCRIPTION:
The property under consideration is generally located on the north side of Airport Freeway
near the Bedford Euless Road intersection. The subject building is 137,810 square feet
in size and was originally developed as a Pace Membership Warehouse in 1992. The
building was converted to a Garden Ridge store in 1994 and was rebranded to At Home
in 2014. The building is currently vacant and under contract to be sold to a company that
would renovate the building and site for an indoor commercial amusement business.
The site was developed in 1992 prior to the adoption of the current landscaping and
buffering standards, and the property is considered legal non -conforming to those
standards. The landscaping standards in effect at the time the property was developed
required that ten (10) percent of the site be maintained in a landscaped area. Additionally,
when abutting residential property, a 10-foot landscape setback greenbelt was required
on a rear property line and a five-foot greenbelt on a side property line.
Building and site improvements on the property hold a 2024 appraised value of $3.49
million, according to the Tarrant Appraisal District (TAD). According to the applicant, the
anticipated initial investment in the site and building is $22 to $25 million. Since the value
of the remodel of the building is more than 75% of the existing improvements value, the
general standards of the Vegetation Chapter 114, Article III, Section 114-71 (Landscaping
Regulations) apply to this property. The improvements required by the code include a

minimum landscaped area on the site, landscape setback on Airport Freeway, parking lot
landscaping, buffer yard adjacent to existing multifamily development on the north side of
the property, and landscape setback design for Freeway Corridor overlay district.
The table below details the applicable standards. The applicant is requesting that
landscaping improvements be deferred and proposes to make parking lot upgrades and
repairs to support the proposed business. For reference, a site plan indicating existing
landscaping features is attached.

The request is being processed as a permit for nonconformity. Approval would be
associated with the building permit for the renovation of the building, and approval does
not run with the property in the same manner as a variance. If future improvements were
proposed on the site, compliance with the standards would be evaluated again at that
time. A public hearing is not required for consideration of a permit for nonconformity.

OPTIONS FOR BOARD CONSIDERATION
The Landscape Review Board has the following options on this application.
1. Approve the request as presented. This action would defer landscaping
improvements on the site until future building improvements are proposed, at
which time compliance with the standards would be reevaluated.
2. Approve the request with conditions. This action would require some landscaping
improvements to be made on the site without requiring full compliance with the
standards. These improvements could include planting of additional trees in the
buffer area on the west side of the parking lot and/or replacement of the existing
wood fence on the north property line with a new wood fence.
3. Deny the request. This action would require the site to be built in compliance with
the landscaping and buffering standards.
RECOMMENDATION:

DESCRIPTION
We wish to submit for permit nonconformity for landscaping, given the value and revenue we will be adding to
the city
1. List the pertinent section(s) of the landscaping and buffering regulations and indicate the specific
interpretations, variances, or nonconforming use exceptions being requested.
We wish to make parking lot upgrades (new striping, fixes to curbs, parking lot, etc.) to increase the
aesthetics of the property, but wish to be exempt from further landscaping upgrades. We are attempting to
bring value to the city through increased revenue, increased jobs, etc. and want to make sure our funding
can be put into the park itself.
2. State the grounds for the request and describe any special conditions that cause hardships that, in your
opinion, justify the variances or exceptions being requested. Explain any usual circumstances, if
applicable, that are not considered by the landscaping and buffering regulations.
We are already going to be spending quite a bit of funding on improving the interior of the space, bringing
attractions in, etc. and want to make sure that the deal can work financially. As previously stated, we do
plan to have some site upgrades, but want the rest of the funding to go into the project itself.
