APPROVED Chair Trevino opened the public hearing and called on Managing Director of Development Services Clayton Comstock to introduce the item. Mr. Comstock informed the Board the applicant is requesting a variance to Chapter 106 (signs) of the North Richland Hills Code of Ordinances. Specifically wall signs permitted on two building elevations. Located at 5131 Rufe Snow Drive being 11.59 acres. This is the previous Chick-fil-A location. Mr. Comstock provided site photos of the property. Applicant representative Tavis Browne, 5050 Quorum Drive, Dallas, Texas presented request and was available to answer questions. Mr. Browne informed the Board the applicant is requesting wall signs on all four sides for the new Jason's Deli. Mr. Browne provided renderings/elevations and sign photos. Mr. Browne also stated there will be landscape improvements. Mr. Browne was available to answer questions from the Board. Mr. Comstock presented staff's report stating Section 106-13(b)(1) of the sign regulations permits a structure to have wall signage on a maximum of two building sides, and those building sides must have a street frontage or public entrance. The applicant proposes to construct wall signs on all four sides of the building. Mr. Comstock stated the sizes of the wall signs are compliant with the sign regulations and the existing pole sign cannot be used. Mr. Comstock reviewed options for Board consideration. The Board may approve the request as presented, approve the variance with conditions, or deny the variance. Mr. Comstock was available to answer questions. D.2 SRB24-0010 PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM SIGN REMEDY INC FOR A VARIANCE TO CHAPTER 106 (SIGNS) OF THE NORTH RICHLAND HILLS CODE OF ORDINANCES AT 8225 NORTHEAST PARKWAY, BEING 1.69 ACRES DESCRIBED AS LOT 3R1, BLOCK 2, CULP ADDITION. APPROVED Chair Trevino opened the public hearing and called on Senior Planner Clayton Husband to introduce the item. Mr. Husband informed the Board the applicant is requesting a variance to Chapter 106 (Signs) of the North Richland Hills Code of Ordinances. Specifically to allow a wall sign to exceed fifty (50) square feet. Located at 8225 Northeast Parkway being 1.69 acres located in the Transit Oriented Development District. Mr. Husband provided site photos of the property. Applicant representative Leia Young, 21281 Blair Road, Conroe, Texas, presented the item. Ms. Young informed the Board this site was formerly Service King and is now Crash Champions. The sign being proposed is smaller than the previous Service King Repair sign but larger than the current code allows. Ms. Young provided photos of previous, and proposed signage. Ms. Young was available to answer questions. Mr. Husband presented staffs report stating the request is to construct a 103.17-square-foot wall sign above the building entrance facing the street. The proposed sign is approximately 17.5 feet wide by 5.75 feet tall. Mr. Husband reviewed options for Board consideration. The Board may approve the request as presented, approve the variance with conditions, or deny the variance. Mr. Husband stated an affirmative vote of four (4) Board members is required to approve the variance, and was available to answer questions. Joining Mr. Aguillen was Jonathon Houdin, Senior Manager of the Product Delivery Team. Mr. Aguillen informed the Board on the progress of the project and provided photos of the proposed signage and location and stated they plan to open mid to late summer 2024. Mr. Aguillen was available to answer questions. Mr. Comstock presented staffs report. Mr. Comstock stated the sign regulations permits a property to have one monument sign per street frontage. The applicant proposes to construct a pole sign adjacent to Boulevard 26. The proposed sign structure is 13 feet in height, with a sign message area of 82.5 square feet. The design of the sign includes a 4.5-foot tall masonry base with 50 square feet of landscaping around the base. The sign would be located at south corner of the property off Boulevard 26. Mr. Comstock reviewed options for Board consideration. Staff recommends cast stone topper on masonry base; address is required; sign to be illuminated; single row of 5-gallon shrubs 36" on center at the sign base and must be outside the sight visibility triangle. The board may approve the request as presented, approve the variance with conditions, or deny the variance. PRESENTER: Clayton Comstock, Managing Director of Development Services SUMMARY: On behalf of DCTN3 589 N Richland Hills TX LLC (owner) and Strickland Brothers Oil Change (tenant), Signs Manufacturing and Maintenance Corp is requesting a variance to Chapter 106 (Signs) of the North Richland Hills Code of Ordinances. The site is located at 6450 Rufe Snow Drive. The applicant is requesting a variance to allow wall signs on three elevations of the building. GENERAL DESCRIPTION: The site is located on the east side of Rufe Snow Drive,just north of Mid-Cities Boulevard. The subject property is the location of a Strickland Brothers oil change business. The 1,725-square-foot building is a new store that opened in March 2024. The site is adjacent to a shopping center on the south and single-family residences to the east. The building is constructed at an angle on the property, facing southwest and aligning with the adjacent shopping center. The building has wall signs on the north and south sides of the building. ' " In April 2024, the sign contractor for Strickland Brothers applied for a sign permit to add a wall sign to the side of the building facing Rufe Snow Drive. As part of the plan review, it was noted that wall signs were already constructed on two sides , of the building. The sign regulations limit wall signs to two elevations of a building. The owner 10 considered modifications to the existing signs to f ' comply with the standards. However, they "'T ultimately decided to seek a variance to allow the third wall sign as proposed. The materials include a copy of the application explaining the reasoning for the variance request and other relevant documents. An analysis of the request and relevant codes is below. ANALYSIS The variance request is related to standards for wall signs, which are contained in .Scaiipir „-„11 („N „)(„11) of the sign regulations. Section 106-13(b)(1) of the sign regulations permits a structure to have wall signage on a maximum of two building faces, and those building faces must have a street frontage or public entrance. There are existing wall signs on the north and south sides of the building, which face internal driving and maneuvering areas on the property. The applicant proposes to add a third wall sign on the side of the building facing Rufe Snow Drive, which would require approval of a variance from the wall sign standards. A summary of the location and design of the wall sign is shown in the exhibits below. Detailed sign drawings of proposed and existing signs are attached. APPLICATION INFORMATION Sign Review Board Case SRB24-0012 6450 Rufe Snow Drive, North Richland Hills,Texas The following information was submitted with the application on the NRH E-SERVICES PORTAL on May 13,2024. SIGN REVIEW BOARD APPLICATION 1. List the pertinent section(s) of the Sign Regulations and indicate the specific interpretation(s), variance(s), or nonconforming use exception(s) being requested. Sec. 118-464. -General conditions. 2. State the grounds for the request and detail any special conditions that cause hardships that in your opinion justify the variances or exceptions being requested. Explain any unique circumstances, if applicable, not considered by the Sign Regulations. The Ground sign is basically ineffective as most all the ground signs are with this type of application. Four lanes of traffic PLUS a middle median with only a TOTAL HEIGHT of 64"and the average height of a midsize passenger vehicle being 52", any car that crosses in front of the sign creates an issue of not being able to see the sign. This is why the Sign Industry shy's away from ground signs as they actually cause a traffic hazard issue in trying to see past the moving traffic to read the ground sign.Add to the fact that the copy is only approx. 8"tall and has a maximum readership distance of only 240, passengers in vehicles strain to see and identify copy on a sign. The tower sign alleviates that issue completely. Size and location on the tower are the highest degree of Identification and Advertising for this location. Readability is excellent and adequate for decision making when this location is a destination. The ground sign is less than 50%effective compared to the tower signage. The ground sign copy is small, the height of the ground sign presents an inability to read the text because of the copy size and obstructed view of the sign at 64"to the TOP OF THE SIGN and the copy itself is even lower. PRESENTER: Clayton Comstock, Managing Director of Development Services SUMMARY: On behalf of Merlin Entertainments, Hoar Construction is requesting a variance to Chapter 106 (Signs) of the North Richland Hills Code of Ordinances. The site is located at 8851 Boulevard 26. The applicant is requesting a variance to allow thematic signage on the fence adjacent to Boulevard 26. GENERAL DESCRIPTION: The site is located on the northwest side of Boulevard 26 adjacent to the NRH2O Family Water Park. The subject property is the former location of the Mountasia entertainment facility and is currently being redeveloped into a Peppa Pig theme park. The park will include a fence around the perimeter of the site. Most of the fence adjacent to Boulevard 26 and the southeast tip of the property would be a precast concrete wall, with other portions of the fence being vinyl-coated chain link similar to the NRH2O Family Water Park. During the building permit review for the fence, it was noted that the plans indicated a portion of the wall adjacent to Boulevard 26 would include thematic graphics associated with the park. For commercial properties, the sign regulations allow permanent signs including ground signs, such as monument signs, and wall signs attached to buildings. The regulations do not include any allowances or standards for signage on fences. Due to the unusual nature of the proposed signage, the owner is seeking a variance to allow thematic graphics to be installed on the fence adjacent to Boulevard 26. far:, "K NOKTH KICHLAND HILLS The supporting materials for the variance application are attached. The materials include a copy of the application explaining the reasoning for the variance request; an exhibit showing the location and construction details of the concrete wall; and exhibits showing the type, size, and location of the thematic graphics to be placed on the wall. The request is being processed as a variance application, which would waive certain sign standards for the property. The Board may include appropriate conditions as part of the approval of a variance request. The affirmative vote of four Board members is required to approve a variance. On April 22, 2024, the Board approved a separate variance application to allow a pole sign to be constructed on the property. A public hearing is required for consideration of a request for variance. Notice of the public hearing was published in the newspaper and mailed to all owners of real property within 200 feet of the site. OPTIONS FOR BOARD CONSIDERATION The Sign Review Board has the following options on this application. 1. Approve the variance as presented. This action would approve variances to the sign standards and allow thematic graphics on the perimeter wall to be constructed as presented. 2. Approve the variance with conditions. This action would approve variances to the sign standards for ground signs, subject to the owner making modifications to its size, location, or design as directed by the Board. 3. Deny the variance.
