PRESENTER: Clayton Comstock, Managing Director of Development Services SUMMARY: Zoning is generally the division of a city into districts (zoning map) with prescribed regulations for each district (zoning ordinance text). Texas Local Government Code Chapter 211 authorizes cities to adopt zoning regulations. Section 211.005 specifically allows for the governing body to divide the city into zoning districts that may regulate the erection, construction, reconstruction, alteration, repair, or use of buildings, other structures, or land. The regulations may vary from district to district but must be uniformly applied throughout the district. Commissioner Narayana commented that the standards for floor area and wall heights for accessory buildings may be worth reviewing in the future. C.2 ZC24-0102 PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM ATITHI SB LLC FOR A SPECIAL USE PERMIT FOR AN EVENT CENTER AT 5346 RUFE SNOW DRIVE, BEING 2.58 ACRES DESCRIBED AS LOT 4R2, BLOCK 10, SNOW HEIGHTS NORTH ADDITION. APPROVED Chair Welborn introduced the item, opened the public hearing, and called for Principal Planner Clayton Husband to introduce the request. Mr. Husband introduced the request. Chair Welborn called the applicant to present the request. Dikchhya Bhatta, 716 E Timberview Lane, Arlington, Texas, presented the request and discussed the proposed event center. Heather Phillips, HP Commercial 500 Throckmorton Street, Fort Worth, Texas, presented information related to questions about the business from the Development Review Committee comments. Commissioner Ross and the applicant discussed the parking requirements for the proposed business, availability of parking on the site, and security measures used for events at the business. Chair Welborn called for Mr. Husband to present the staff report. Mr. Husband presented the staff report. Chair Welborn and Mr. Husband discussed the adjacent land uses and location of residential properties. Commissioner Narayana and Mr. Husband discussed the expiration period for special use permit approvals. Commissioner Goetz and Mr. Husband discussed the types of permits that may be required for alcoholic beverages to be served at the business. Commissioner Ross and Mr. Husband discussed the number of parking spaces available at the site. Commissioner Narayana and Mr. Husband discussed the parking details of the shopping center, the proposed leased space, and other tenants of the center. Chair Welborn called for anyone wishing to speak for or against the request to come forward. There being no one else wishing to speak, Chair Welborn closed the public hearing. A motion was made by Commissioner Ross, seconded by Commissioner Goetz to approve ZC24-0102 subject to site improvements being made related to lighting, refuse container enclosures, and parking lot landscaping. Commissioner Ross discussed the recommended parking lot landscaping that could be improved with replacement of trees in islands. Commissioner Goetz and Mr. Husband discussed the size of parking lot islands and minimum standards for parking lot trees. Commissioner Narayana stated the addition of landscaping to the parking lot may be too onerous to require for this tenant and application given similar recent approvals. Commissioner Ross stated it was not the intent for parking spaces to be removed, and keeping as many spaces available is important with the addition of the new tenant. An amended motion was made by Commissioner Ross, seconded by Commissioner Goetz to approve ZC24-0102 subject to site improvements being made related to lighting and refuse container enclosures. Commissioner Goetz and Mr. Husband discussed the landscaping standards in place at the time the shopping center was constructed in 1983. Commissioner Narayana and Mr. Husband discussed the number and location of refuse containers relative to the proposed tenant space. Commissioner Narayana stated improving one enclosure may be appropriate rather than improving both enclosures. Chair Welborn discussed refuse container enclosures and residential adjacency. Commissioner Goetz asked Mr. Husband discussed the if there is one owner for the entire shopping center. Mr. Husband stated yes. Chair Welborn stated that replacement of building lighting would be important if the site were adjacent to residential property, but the adjacent sites are all commercial uses. Chair Welborn and Mr. Husband discussed the zoning and planned redevelopment of the adjacent pad site for Popeye's restaurant. Chair Welborn and Commissioner Narayana discussed the materials of the existing refuse container enclosures. PRESENTER: Clayton Comstock, Managing Director of Development Services SUMMARY: C2C Smithfield LP is requesting approval of a preliminary plat of Smithfield Station Addition. The property is located at the northwest corner of Smithfield Road and Arthur Drive. GENERAL DESCRIPTION: The 5.998-acre property under consideration is a triangular site with frontage on Smithfield Road and Arthur Drive, and it is bound by the railroad right-of-way to the northwest. This property is directly across Smithfield Road from the TEXRail Smithfield Station. The property is zoned TOD (Transit Oriented Development). A special development plan for the property was approved by City Council on August 28, 2023 (Ordinance 3808). The special development plan for the site includes one building with three- and four-story sections and an attached structured parking garage. The building includes 277 multi- family units, 15 townhouses, and 10,231 square feet of dedicated commercial space. The preliminary plat includes 16 lots. The largest lot, which fronts Smithfield Road, is 5.19 acres in size and is intended for the construction of the main building and parking garage. The remaining lots front Arthur Drive and are intended for construction of individual townhouses. Streetscape improvements to Smithfield Road and Arthur Drive frontages will be constructed as part of this project, as required by the TOD code. Street trees spaced 30- feet on center, decorative street light fixtures, wide sidewalks, street furniture (bike racks, benches, and trash receptacles), and on-street parking are all required streetscape elements. All improvements within the public right-of-way are reviewed thoroughly for sight visibility, pedestrian safety, motorist safety, and overall traffic flow. The plat includes a right-of-way dedication for Arthur Drive at the west end of the street. The existing street is a dead-end street that terminates at the railroad right-of-way. The "K NOKTH KICHLAND HILLS dedication will provide for the construction of a cul de sac turnaround at the end of Arthur Drive. The plat also includes a right-of-way abandonment for Guy Street. The right-of-way was originally dedicated in 1946 as part of the original plat in the Town of Smithfield. The street was never constructed. It is currently a cross-fenced unimproved right-of-way that provides driveway access to a property adjacent to the railroad. LAND USE PLAN: This area is designated on the Vision2030 Land Use Plan as Urban Village. This designation promotes sustainable, pedestrian-oriented, mixed-use development that provides the opportunity for many uses to coexist within a compact area. Urban villages encourage an efficient compact land use pattern; support vibrant public spaces; reduce the reliance on private automobiles; promote a functional and attractive community using urban design principles; allow flexibility in land use; and prescribe a high level of detail in building design and form. Urban villages can come in the form of vertical mixed use, where multiple uses share a single multistory building, or horizontal mixed use, where a diverse set of uses are placed within close walkable proximity. CURRENT ZONING: The property is currently zoned TOD (Transit Oriented Development). The TOD district is intended to support the development of the community's station areas into pedestrian-oriented, mixed-use urban neighborhoods, with convenient access to rail transit, shopping, employment, housing, and neighborhood retail services. The goal of each station area is to encourage an efficient, compact land use pattern; encourage pedestrian activity; reduce the reliance on private automobiles; promote a more functional and attractive community using recognized principles of urban design; and allow property owners flexibility in land use, while prescribing a high level of detail in building design and form. The TOD district is divided further into Character Zones, or subzones. This property is in both the TOD Core Character Zone and the TOD Residential Character Zone of the Smithfield TOD. o The TOD Core provides the most opportunities for redevelopment and new development in both the Station Areas. It is the area that has the most development impact due to the location of the transit station. o The TOD Residential zone provides the transitions from the higher intensity development of the TOD Core and existing residential neighborhoods. A special development plan for the property was approved by City Council on August 28, 2023 (Ordinance 3808). TRANSPORTATION PLAN: The development has frontage on the following streets. A right-of-way dedication of 5,073 square feet is provided on the plat for the construction of a cul de sac turn-around on Arthur Drive. The plat also includes the abandonment of a 17,775-square-foot unimproved right-of-way for Guy Street. Approval of a final plat is required prior to the issuance of a building permit for the site. CITY COUNCIL: The City Council will consider this preliminary plat at the September 9, 2024, meeting following action by the Planning and Zoning Commission. DRC REVIEW & RECOMMENDATION: The Development Review Committee (DRC) recommends approval of the plat subject to the attached DRC comments. These comments include minor revisions to notations and labeling on the drawing and the dedication of a common access easement through the property.
