"K NOKTH KICHLAND HILLS PLANNING AND ZONING COMMISSION MEMORANDUM FROM: Planning & Zoning Department DATE: September 19, 2024 SUBJECT: Presentation regarding zoning standards related to quick service restaurants with drive-through service. PRESENTER: Clayton Comstock, Managing Director of Development Services SUMMARY: The 2023 NRH Citizen Survey clearly indicated that NRH residents desire more full- service restaurants over fast food establishments. When asked whether they would like to see more of each, 70 percent of respondents replied "yes" for full-service/sit down restaurants, while only 15 percent replied "yes" of drive-through restaurants. Over the last ten years however, fast casual and drive-through fast food restaurants generally developed at faster pace than full-service restaurants. On November 9, 2015, City Council approved Ordinance No. 3382, which made several amendments to the zoning ordinance related to restaurants and drive-through service. As part of these amendments, three new land use types for restaurants were added to the land use tables. These include full service restaurant, fast casual restaurant, and quick service restaurant. Definitions for each land use type were also added to the ordinance. At that time, the zoning ordinance did not specifically define or distinguish fast food restaurants. The "restaurant or cafeteria" use was permitted by right in all nonresidential zoning districts. However, the use "drive-through buildings of less than 1,400 square feet" did and still does require approval by special use permit in commercial and industrial districts. The zoning ordinance also did not include any site development standards for restaurants with drive-through service. The 2015 amendment added standards that included drive- through stacking depths; location and orientation of menu boards, speakers and pick-up windows; and design and dimensions of drive through lanes. These standards, which are described below, help ensure that restaurants with drive-through service are compatible with adjacent uses and provide improved traffic circulation and pedestrian safety on the site. These standards are used during the review of zoning cases and site plans for any restaurant that provides drive-through service. They apply to both quick service (fast food) restaurants and a fast-casual restaurant that might provide drive-through service, such as Panera Bread or Chipotle. "K NOKTH KICHLAND HILLS (26) Restaurants with drive-through service. For restaurants that provide drive-through service,the following standards shall apply upon new construction; or to any building remodeling, alteration, addition, or expansion where the value of the improvements exceed 50 percent of the current appraised value of the existing structure,excluding the value of the land,or increases the square footage of the building by 30 percent or more. a. Location requirements. A restaurant with drive-through service must have its primary driveway access on an arterial roadway,as identified on the Thoroughfare Plan. b. Window location. Drive through windows must not face a public street. c. Menu boards and speakers. Menu boards and speakers must be located at least 50 feet from the property line of a residential use. Speakers must be oriented to face away from the property line of a residential use. d. Drive through lanes. All drive through lanes must comply with the following standards: 1. The drive through lane must have a minimum width of ten feet and a maximum width of 15 feet. 2. The drive-through lane must be separated from traffic aisles, other stacking lanes, and parking areas with striping,curbing, landscaping,or the use of alternative paving materials. 3. The entrance to the drive through lane must be clearly marked and located at least 50 feet from all public streets. 4. A drive through lane is not permitted to be located between the building and a public street. 5. A drive-through lane must not interfere with the use of parking spaces, interior pedestrian circulation,or access to any public street. e. Special use permit provision. In order to respond to unique aspects of the site or building, such as infill development, modifications to or deviations from these standards may be approved through approval of a special use permit. On February 13, 2017, City Council approved Ordinance No. 3448, which modified the land use tables to require special use permit approval for all quick service restaurants in all zoning districts where the use is authorized. Prior to this amendment, quick service restaurants were allowed by right in the C-2 (Commercial) and OC (Outdoor Commercial) zoning districts. At the work session, staff will present information regarding quick service restaurants, drive through standards, and the review process associated with this land use. Managing Director of Development Services Clayton Comstock discussed the proposed rules of procedure for the Commission. Vice Chair Stamps and Mr. Comstock discussed the process for removing items from a consent agenda. Chair Welborn, Vice Chair Stamps, Commissioner Narayana, Commissioner Ross, and Mr. Comstock discussed modifications to rule 3.6 regarding avoiding commissioner discussions with applicants about pending business before the Commission outside of the public meeting. Chair Welborn, Commissioner Narayana, and Mr. Comstock discussed the process for placing items for discussion on a future work session agenda. A motion was made by Commissioner Ross, seconded by Commissioner Goetz, to approve the rules of procedure subject to revising Rule 2.4 to require that future agenda item topics be germane to the scope of the Commission's roles and responsibilities, and revising Rule 3.6 to state that individual commissioners should not discuss active applications or pending items with applicants outside of the public meeting. PRESENTER: Clayton Husband, Principal Planner SUMMARY: On behalf of Sandcap Davis N Tarrant LLC (property owner) and HTeaO (tenant), Interplan LLC is requesting a special use permit for a quick service restaurant on a 1.04- acre property located at 8368 Davis Boulevard. GENERAL DESCRIPTION: The 43,390-square foot site under consideration is located on the east side of Davis Boulevard, south of North Tarrant Parkway. The site is vacant and located between Caddo North Tarrant offices and Braum's and in front of B&B Theatres. The applicant proposes to develop a site for a new quick service restaurant, JI 1I 1f e , a drive-through iced tea business. A site plan package for the property is attached. Planned improvements to the site include construction of a new 2,000-square-foot building with drive-through service and associated site improvements. The zoning ordinance requires special use permit approval for a quick service restaurant. In addition, the ordinance includes specific standards for the design and layout of drive-through lanes, and the design complies with those standards. Landscaped areas on the property cover 39% of the site. These areas include a 15-foot- wide landscape setback adjacent to Davis Boulevard, landscaped areas adjacent to the drive-through lane, parking lot landscaping, and buffer areas between the drive-through lane and adjacent theatre and office properties. The parking lot contains 20 parking spaces and vehicle stacking area for 12 cars in the drive-through lane. The site has access to Davis Boulevard through common access easements on adjacent properties, but the site does not have direct driveway access to the street. The proposed conditions of approval for this special use permit are attached. Applications for special use permits provide an opportunity to address modifications to specific site "K NOKTH KICHLAND HILLS development and building design standards for the site. These conditions are based on the applicant's proposed development of the property. These conditions may be modified throughout the public hearing process, but they are subject to final approval by City Council. LAND USE PLAN: This area is designated on the Land Use Plan as Retail Commercial. The Retail Commercial land use category provides sites for community and regional shopping centers, commercial establishments, and employment centers. These sites are typically located on highways and major thoroughfares at key intersections. CURRENT ZONING: The property is currently zoned C-1 (Commercial). This district is intended to permit a variety of retail trade, personal and business services establishments, and offices principally serving community and regional needs. The district should be located on the periphery of residential neighborhoods and at intersections of major arterial streets. It is also appropriate for major retail corridors. The following regulations shall be specific to this Special Use Permit. Where these regulations conflict with or overlap another ordinance, easement, covenant, or deed restriction, the more stringent restriction shall prevail. A. Permitted land uses. A special use permit is authorized for a quick service restaurant on the property. B. Site development standards. Development of the property shall comply with the development standards of the C-1 (Commercial) zoning district and the standards described below. 1. The site improvements must be constructed as shown on the site plan attached as Exhibit „C .11 2. Landscaping must be installed as shown on the site plan attached as Exhibit "C." All trees planted on site must be container-grown trees. 3. The drive-through components on the site must comply with Section 118-633(26) of the zoning ordinance and the standard described below. a. The drive-through lane improvements must be constructed as shown on the special use permit exhibit attached as Exhibit "C," including pickup window, lane widths, pavement markings, and menu board locations. C. Building design standards. Building design and appearance must comply with the building elevations attached as Exhibit "C" and the standards described below. C. Expiration. The special use permit will expire three (3) years from the effective date of this ordinance. If the quick service restaurant is still in operation at the time of expiration, the business shall be considered a legal non-conforming use and may continue operation subject to the standards described in Section 118-153 of the zoning ordinance. D. Amendments to Approved Special Use Permits. An amendment or revision to the special use permit will be processed in the same manner as the original approval. The application for an amendment or revision must include all land described in the original ordinance that approved the special use permit. E. Administrative Approval of Site Plans. The development is subject to final approval of a site plan package. Site plans that comply with all development-related ordinances, and this Ordinance may be administratively approved by the Development Review Committee. The city manager or designee may approve minor amendments or revisions to the standards provided the amendment or revisions does not significantly: 1. Alter the basic relationship of the proposed uses to adjacent uses; 2.
