PRESENTER: Clayton Husband, Principal Planner SUMMARY Hamilton Duffy PC and Bohannan Dentistry are requesting approval of a variance to the screening requirements for outdoor refuse containers to allow a wood screening fence for a container on a commercial lot located at 8237 and 8241 Mid-Cities Boulevard. BACKGROUND INFORMATION The property under consideration includes two commercial lots totaling 1.01 acres in the Pavilion Park office development. The nr: office park includes 11 buildings located on the north side of Mid- Cities Boulevard just east of Davis Boulevard. The two properties r .. ' included in the application are located on the east end of office park. '�� One building faces Mid-Cities Boulevard and is occupied by a � �� °r dentist office. The other building is located behind the dentist office and interior to the site and is occupied by an engineering firm and a y surveyor office. The two buildings share a refuse container that is in the parking area between the buildings. The property is zoned C-1 � / � L`'' (Commercial) On October 13, 2023, code compliance officers conducted a routine � inspection of the office park development. During the inspection it was noted that the refuse container serving the two lots did note. include the required screening fence. The owners were advised that fi t the screening must be installed by October 27, 2023. Follow-up inspections were conducted on the property on February 12 and July 24, 2024, where it was observed that the screening fence had not been installed. On August 15, 2024, the owner submitted a fence permit to construct a screening fence for the container. During the review of the application, it was noted that proposed fence would be constructed of wood rather than masonry materials as required by the zoning ordinance. The applicant was advised that the design must be adjusted to comply with "K NOKTH KICHLAND HILLS these standards. Rather than adjust the design, the applicant has applied for variance to allow a wood fence instead of a masonry fence. The variance application and supporting materials are attached. The materials include a copy of the application explaining the reasoning for the variance request, plans showing the proposed improvements to the property, photos, and other documents. An analysis of the request and relevant codes is below. ANALYSIS The variance request is related to the screening standards for outdoor refuse containers contained in Sectii, ,ir.........11'8 , ,; , of the zoning ordinance. The screening standards apply to all refuse containers, trash dumpsters, compactors, and similar containers used for the disposal of waste. A complete copy of the standards is attached and include container enclosure materials and dimension standards, location and orientation requirements, setbacks, landscape screening, and recycling containers. The variance request is related to standards as they apply to container enclosure materials and dimensions, as summarized in the table below. The adjacent property is vacant. The proposed screening fence is an eight-foot tall wood fence with opaque wood gates. The type of wood material is not specified. The dimensions of the enclosure are twelve feet wide by eight feet deep. The materials for the fence and gate and the dimensions of the enclosure are not compliant with zoning ordinance standards. The material standards are intended to provide for durable materials that can withstand the activities associated with servicing the container on a weekly basis. The dimensional standards provide sufficient space for servicing an eight-cubic yard container, which is six feet wide by five and one-half feet deep. "K NOKTH KICHLAND HILLS VIEW OF CONTAINER BETWEEN BUILDINGS CONTAINER LOCATION IN PARKING AREA FINDINGS FOR VARIANCE APPROVAL Section 11 11 „y of the zoning ordinance authorizes the Zoning Board of Adjustment ...to authorize upon appeal, in specific cases, such variance from the terms of [the Zoning Ordinance] as will not be contrary to the public interest and where, because of special conditions, the enforcement of the [Zoning Ordinance] would result in an unnecessary hardship." In exercising it powers to grant a variance, the board of adjustment must make specific findings and show in its minutes that: a. Literal enforcement of the controls will create an unnecessary hardship or practical difficulty in the development of the affected property. b. The situation causing the hardship or difficulty is neither self-imposed nor generally affecting all or most properties in the same zoning district. c. The relief sought will not injure the permitted use of adjacent conforming property. d. The granting of the variance will be in harmony with the spirit and purposes of these regulations. OPTIONS FOR BOARD CONSIDERATION The Zoning Board of Adjustment has the following options on this application. 1. Approve the variance as presented. This action would allow a wood container screen to be constructed as proposed. 2. Approve the variance in part and/orwith conditions. This action would allow a wood container screen to be constructed, subject to the owner making modifications to its size, location, or design as directed by the Board. These modifications could include fence material standards, landscaping, dimensions, and similar improvements. 3. Deny the variance. PRESENTER: Clayton Husband, Principal Planner SUMMARY Rachel Blair is requesting approval of a variance to the front yard fencing standards on a residential lot located at 8341 Odell Street. BACKGROUND INFORMATION The property is located on the north side of Odell Street east of Davis Boulevard, between Eli Smith Way and Tradonna Lane. The lot is 6,746 square feet (0.155 acres) in size. The house was constructed in 1997 and has approximately 1,278 square feet of living area, per Tarrant Appraisal District records. On July 17, 2024, City staff received a complaint that a fence was being constructed on the property, including in the front yard area. City records indicated a permit had not been issued, and an inspection of property was conducted on July 19, 2024. A stop work order was placed on the property noting that the fence was installed without a permit and that the front yard portion of the fence was not permitted at this location. A copy of the inspection report and photos are attached. Buzz Custom Fence, the owner's contractor, applied for a fence permit on July 25, 2024, to construct a four-foot tall ornamental metal fence on the property and in the front yard area. As part of the review, the applicant was advised that a fence could not be constructed between the house and the front property line as the lot does not have at least 100 feet of street frontage. The code permits a fence to be constructed between the front corners of the house and the side property lines. The applicant was advised that the front yard portion of the fence would have to be removed. A follow-up inspection was conducted on October 1, 2024, to determine if the fence had been removed. It was noted that the fence was still in place, and the owner advised that the front yard portion would need to be removed. Rather than remove the fence, the applicant has applied for variance. The materials include a copy of the application explaining the reasoning for the variance request, a survey of the lot, a plot plan showing the proposed improvements to the property, and other related documents. An analysis of the request and relevant codes is below. ANALYSIS The applicant constructed a four-foot tall ornamental metal fence in the front yard of the property, extending from the front of the house to the front property line. The fence extends across the front property line and along both sides of the driveway, and it includes pedestrian gates on both sides of the driveway. The lot in question is 65 feet wide at the front property line, 104 feet deep, and has a 20-foot front building line. The property is zoned R-8 (Single-Family Detached Zero Lot Line Residential). The variance request is related to the front and fence standards contained in Section a y Section ..................... „,11,11,.::,, ,,L(q„), of the zoning ordinance. The zoning ordinance further defines front yard as "the area extending across the entire width of the lot and situated between the front lot line and the most extreme corners of the building." The design of front yard fences is conditioned on the following standards- 1. The property must have at least 100 feet of street frontage. 2. The fence must not exceed four feet in height. However, a fence may be up to six feet in height if the property has at least 200 feet of street frontage. 3. The fence must be ornamental metal material and may have brick or stone columns. The columns must be spaced 20 to 50 feet apart and not exceed four feet in height. 4. Private entry driveway gates may be permitted as part of a front yard fence. The gates must be set back at least 20 feet from the property line to accommodate on-site queueing of one vehicle. As constructed, the fence is forty- eight (48) inches tall. ,a. r o„, r r. ;h FRONT YARD FENCE For reference, there are not any front yard fences on lots on Odell Street east of Davis Boulevard. There are not any lots that front this part of Odell Street that have a width greater than 100 feet. The lots are generally 60 to 65 feet wide on the north side of Odell Street and are part of the Odell Addition and Stonybrooke South Addition. Lots on the "K NOKTH KICHLAND HILLS south side are in the Villas at Smithfield subdivision and are 40 to 45 feet wide. None of the lots on the street meet the standard to allow a front yard fence. City staff is unaware of any existing front yard fences on lots of this width anywhere within the city. There was one variance approved in last 10 years for a front yard fence on lot less than 100 feet of frontage. A variance for a four-foot tall fence on an 88-foot-wide lot was approved on May 23, 2019, for property on Bursey Road. The existence of a front yard fence in the city does not establish a hardship or precedent for the approval or denial of the proposed application. FINDINGS FOR VARIANCE APPROVAL Section 11 11 „( „y of the zoning ordinance authorizes the Zoning Board of Adjustment ...to authorize upon appeal, in specific cases, such variance from the terms of [the Zoning Ordinance] as will not be contrary to the public interest and where, because of special conditions, the enforcement of the [Zoning Ordinance] would result in an unnecessary hardship." Screening wall and fence criteria generally. (a) Height. Walls and fences shall be no greater than eight feet in height. The height of a wall or fence shall be the vertical distance between the ground and the top of the wall or fence. In terrain where the ground slopes at a grade of ten percent or more, the wall or fence may be built in eight-foot horizontal stair step sections. The average height of each fence section shall be no greater than eight feet in height. Masonry columns may exceed the maximum height by no more than eight inches and shall not exceed the average height of the adjacent fence sections by more than eight inches. (b) Maintenance. (1) All screening and fences shall be adequately maintained, kept in good repair and in sound structural condition by the property owner and shall not create urban blight. Dilapidated fences shall be repaired or replaced in accordance with provisions of this article. (2) The property owner shall maintain fences, including those existing prior to the adoption of this section, at all times in a state of good repair, safe and secure condition, with all braces, bolts, nails, supporting frames and fastenings free from deterioration, termite infestation, rot, rust or loosening, and able to withstand at all times the wind pressure for which they were designed. (3) Property owners shall paint, stain and/or seal fence supports, gates, structural members and exterior surfaces as necessary to prevent rusting, peeling or blistering surfaces. Board-on- board and similar wood privacy fences may be painted or stained with natural wood colors. The use of high intensity, primary, metallic, or fluorescent colors shall be prohibited on any fence surface. (c) Front yards. Fences may only be allowed in front yards of property zoned for single-family residential and agricultural uses which have at least 100 feet of frontage on a street. Such fences shall be open air or nonsight-barring fences and shall meet the following standards: (1) Fences shall be wrought iron or ornamental metal, may have brick or stone columns spaced 20 to 50 feet on center, and shall be no greater than four feet in height. (2) Front yard fences greater than four feet and no higher than six feet in height may be permitted on residential lots greater than one acre in size with 200 feet or more of street frontage. Said fence shall be wrought iron or ornamental metal and shall have brick or stone columns spaced 20 to 50 feet on center. Such properties, if zoned AG, RE-1, or RE-2 may also be permitted a rural fence type as provided herein. (3) A Rural Fence may be permitted in the front yard of any property zoned AG or RE-1, with a minimum of one acre, and with at least 150 feet of frontage on a street. Said rural fence may not exceed five feet in height and may be one of the following fence types: mortised split rail, wrought iron or ornamental metal, tubular steel pipe, post-and-rail, or post-and-board. The use of cable may be permitted in conjunction with tubular steel pipe fencing. The use of continuous square mesh fencing, or"non-climb"fencing, and/or masonry columns spaced 20 to 50 feet on center may be used in conjunction with any of the aforementioned rural fence types. The use of barbed wire or electric fencing for the purpose of livestock containment shall only be permitted in conjunction with any of the aforementioned rural fence types. (4) Private entry driveway gates may be permitted for any property that is permitted a front yard fence. Said gates shall be set back from the planned ultimate right-of-way line as shown by the master thoroughfare plan a minimum of 20 feet to accommodate the on-site queuing of one vehicle. (d) Visibility triangle. All walls and fences located on a corner lot shall comply with any applicable visibility sight triangles as provided for in this chapter. When the rear yard of a first lot abuts the side yard of a second lot, no fence on the first lot shall encroach into the side yard adjacent to the street unless the fence complies with subsection (c)of this section. (f) Reverse frontage lots. When the rear yards of two corner lots abut, fences complying with this section may be constructed within the side yard adjacent to the street. (g) Prohibited fencing material. No fence shall be constructed of sheet/corrugated metal, plywood, concrete masonry unit block, or other materials not manufactured or designed for the primary purpose of fence construction. The use of W"or"diamond" mesh, or chain link fencing is not permitted forward of the principal building on the lot, nor along any street frontage. (h) Finished side facing thoroughfare. Wood fences adjacent to a collector or arterial street as identified on the master thoroughfare plan shall have the finished or smooth side of the fence facing the thoroughfare and fence posts shall face interior to the lot. (i) [Fence adjacent to screening wall.]Where a residential subdivision masonry screening wall is provided adjacent to a C-4-U collector street or larger as identified on the master thoroughfare plan, the height of a fence adjacent or perpendicular to the screening wall shall not exceed the height of the subdivision's screening wall.
