Applicant Representative Aaron Adair with 1611 Golf Club, located at 6001 Parker Boulevard presented the request. Mr. Adair provided interior concept renderings and sign elevations for the proposed signage. Mr. Husband presented staffs report stating Section 106-13(b)(1) of the sign regulations permits a structure to have wall signage on a maximum of three building faces, and those building faces must have a street frontage or public entrance. The applicant proposes to construct wall signs on all four faces of the building. The size of the additional signs are compliant with sign regulations. Mr. Husband informed the Board they can approve the request as presented, approve the variance with conditions, or deny the variance. January 27, 2025 Sign Review Board Meeting Minutes Page 2 of 4 D.2 SRB25-0015 PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM NRH2O FAMILY WATER PARK FOR A VARIANCE TO CHAPTER 106 (SIGNS) OF THE NORTH RICHLAND HILLS CODE OF ORDINANCES AT 9001 BOULEVARD 26, BEING 16.57 ACRES DESCRIBED AS TRACT 4, DELILAH MANNING SURVEY, ABSTRACT 1046. APPROVED Chair McCarty opened the public hearing and called on Principal Planner Clayton Husband to introduce the item. Mr. Husband informed the Board the applicant is requesting a variance to Chapter 106 (Signs) of the North Richland Hills Code of Ordinances to allow a 92-square-foot monument sign on the property. Mr. Husband presented the item on behalf of NRH2O stating the location of the proposed sign is located at 9001 Boulevard 26. The sign exceeds the allowed height and square footage standards. Mr. Husband presented staffs report stating Section 106-13(a)(2) of the sign regulations permits a property to have one monument sign per street frontage. The sign structure must be constructed of masonry and may be seven (7) feet tall and 75 square feet in size. The message area on the sign may be 50 square feet, and the area must be surrounded by at least eight inches of masonry on all sides. The proposed sign structure is 92 square feet in area, being six (6) feet in height and 15.5 feet in width overall. The sign message area includes an electronic message sign (32 square feet) and graphic components (36 square feet). The design of the sign includes a masonry base and cap, but masonry is not included on the sides of the sign. Mr. Husband informed the Board they can approve the request as presented, approve the variance with conditions, or deny the variance. Director of Parks and Recreation Adrien Pekurney answered a question from the board regarding visibility of the new sign. Ms. Pekurney stated one tree in this location had died and has been removed and the proposed sign would move closer to Boulevard 26, which would improve visibility. PRESENTER: Clayton Husband, Principal Planner SUMMARY: On behalf of Outfront Media Inc., Anna Saravia is requesting a permit for nonconformity to Chapter 106 (Signs) of the North Richland Hills Code of Ordinances. The applicant is requesting to convert one side of an existing billboard sign to a digital billboard sign at 6200 NE Loop 820. GENERAL DESCRIPTION: The property is located on the south side of NE Loop 820 in the Dallas Area Rapid Transit (DART) right-of-way for TEXRail. The sign is located between Iron Horse Golf Course and the Community Enrichment Center property on Meadow Lakes Drive. The property is zoned PD (Planned Development). Outfront Media is requesting approval of a permit to remove one existing nonconforming billboard sign face and construct a digital billboard sign face in its place. The application and supporting materials are attached. The materials include pertinent information and correspondence, a site survey and site plan, and construction drawings for the sign. In September 2012, the Sign Review Board approved a request to construct the billboard sign at this location. The scope of that application included relocating the sign from the north side of NE Loop 820 to its current location on the south side of the freeway. The relocation was related to the imminent construction of bridges associated with the expansion of NE Loop 820. The approval also included the conversion of one sign face to a digital billboard face and the addition masonry cladding around the support pole for the sign. When the sign was constructed, the masonry exterior was added to the pole, but the owner at that time, CBS Outdoor Advertising, chose not to add the digital billboard face. However, a permit was issued to the current owner, Outfront Media, in November 2024, to convert the approved sign face. The application under consideration would apply to the other sign face on the billboard sign. Section 106-9 of the Signs chapter of the North Richland Hills City Code of Ordinances allows the Sign Review Board to authorize the reconstruction or relocation of a nonconforming billboard, including its conversion to digital technology. Digital billboards NORTH KI HLAND HILLS may only replace existing nonconforming off -premise billboards located on nonresidential lots that have frontage on NE Loop 820 and State Highway 121. Subsequent approval by the Texas Department of Transportation (TxDOT) is not required for the digital billboard. The City of North Richland Hills has been a TxDOT Certified City since 2011 and may exercise control over commercial signs within the city limits. A permit issued by the City is acceptable instead of a permit issued by TxDOT within the certified area. Digital billboards are subject to certain design standards required by Section 106-12(b) of the Sign chapter. The following is a summary of the primary design standards associated with the request. A complete copy of the standards is attached for reference. Sign Area Billboard signs are limited to 672 square feet in total display area. The proposed digital billboard meets this with this standard, measuring 14 feet in height and 48 feet in width. Sign Height The maximum height permitted for digital billboards is based on the grade level of the main traveled way closest to the sign. The height limit must not exceed an overall height of 42.5 feet from the centerline of the main traveled way. When the sign relocation was approved in 2012, a variance to the height standard was granted as a condition of approval. The variance was associated with DART's required 25-foot clearance between the top of the rails and the bottom of the billboard. While the billboard sign itself has an overall height of fifty (50) feet, the top of the sign is approximately 65 feet above the main travel lanes on NE Loop 820. The sign complies with this standard, proposed sign face conversion would not increase the height of the sign. F1MMT Support structure The support structure for digital billboards must be clad in a decorative material consisting of brick, stone, or other approved masonry material. The use of EIFS is not an approved finish material. The existing billboard complies with this standard. Permit for nonconformity The request is being processed as a permit for nonconformity. Approval would be associated with the sign permit for the digital conversion of the billboard, and approval does not run with the property in the same manner as a variance. If future improvements were proposed on the site, compliance with the standards would be evaluated again at that time. To Whom It May Concern: I am assisting Outfront Media LLC ("Outfront") with the submission of its Application for Sign Permit (the "Application"), which seeks permission to convert an existing off -premise billboard located at 6002 Loop 820 (the "Sign") to a digital billboard. The Application complies in all respects with all applicable state and local sign regulations. Accordingly, and as more fully explained herein, Outfront requests that its Application be approved. By way of background, the Sign is a legal nonconforming Sign Structure with back-to- back faces each measuring six hundred seventy-two square feet in size. In 2012, "pursuant to and in accordance with Section 106-12(b) of the North Richland Hills Code of Ordinances, the Flighway Beautification Act of 1965 and all city requirements," the City approved the application of CBS Outdoor, Outfront's corporate predecessor at the time, for the conversion of the Sign to incorporate a digital face,' CBS Outdoor ultimately did not pursue the conversion of the Sign. As such, the City -issued permit expired on March 21, 2013.2North Richland Hills Code of Ordinances, § 106-6(3) (providing for expiration of permit after ninety days from date of approval). Outfront is now once again pursuing the conversion of the Sign to incorporate digital faces. Based on discussion,,; with City staff since the expiration of the permit issued in 2012, Outfront understands the City may oppose the Application on various grounds,. The purpose of this letter, therefore, is to address and rebut those grounds in order to facilitate an effitcient application and permitting process. Building Inspections & Permits City of North Richland Hills August 29, 2024 Page 2 Outfront believes that the City may object, for example, to the Sign's proximity to Iron Horse Golf Club, based on the City's contention that the golf course is a "public space," Candidly, the City's sign regulations make clear that it is the City's intention "to comply with the federal Highway Beautification Act of 1965 ii,here applicable." North Richland [tills Code of Ordinances, § 106-1 (emphasis added). The federal Highway Beautification Act (1113A) is codified as 23 U.S.C. § 131. Importantly, the 1113A does not include any restrictions with respect to the required spacing between public spaces and outdoor advertising signs, and is therefore not applicable to Outfiront's Application. Even if codified restrictions were in place to require a certain amount of space between public spaces and off -premise signs, they still would not apply to Outfiront's Application. C13S Outdoor's representative and Mr. Pendley exchanged several ernails regarding this saute issue prior to and following the City's issuance of the original permit in 2012.' In 2010, CBS Outdoor's representative asked Mr. Pendley, "My next question is does the city consider the Iron. Horse Golf Course a public park or a scenic area?" Mr. Pendley responded: "We don't consider the golf course as a park." Mr. Pendley elaborated in a subsequent email sent on February 11, 2013, Although Iron Horse Golf Course is owned by the city and operated by 3 d party entity, it would be tough to consider it a public park since you have to pay green fees to use it. Obviously, it's not a forest, playground, nature preserve, or a designated scenic area.' Indeed, and as Mr. Pendley pointed out, the Golf Course could not be considered a public space since it requires the payment of a fee in order to play.' Accordingly, because Iron Horse Golf Course is not a public park or designated scenic area, its proximity to the Sign should not be taken into consideration in connection with Outfiront's Application. Outfront also anticipates the City may take issue with the proximity of the Sign to the sign located approximately one thousand feet west of the Sign, Which is situated oil and advertises Iron Horse Golf Course, Pertinently, Section 106-12(b)(7) or the city,s Code of Ordinances states, A minimum spacing of 1,500 shall be required between one digital billboard and any other digital or conventional billboard on the same side of the roadway racing the same direction. The City's sign regulations do riot define the term, "conventional billboard." However, the term "billboard sign" is defined in Section 106-2 of the City's Code of Ordinances as "an outdoor advertising structure which advertises a use, product, or service riot necessarily found on the premises. A billboard sign is also known as an off -site advertising sign." Although the City's Code does not define the term "off -site advertising sign," it does define "off' -premises sign" as "a sign displaying advertising copy that pertains to a business, person, organization, activity, event, place, set -vice, or product which is not principally located or primarily Manufactured or sold on t➢-re premises on which the sign is located," Iron Horse Golf Club's sign is, of course, not a digital billboard, and it does not constitute a conventional billboard either. The sign advertises the same business (the Golf Course) located on the same property on which the sign is situated. It there does not fit the definition of a "billboard sign" or an "off -premises sign," as set out in the City's sign regulations. Therefore, there is no legitimate basis to deny the Application based on the Sign's proximity to Iron Horse Golf Club's sign. Outfi-ont's Application complies in all respects with applicable regulations. The ordinance says that the sign has to be 1000' from a roadway exchange, What does the city consider a roadway exchange? The area where the sign would be located is not zone "Institutional", it attuallycaries a DART ROW designation and Is considered an unzoned district. Although Iron Horse Golf Course Is owned by the city and operated by 3'a party entity, It would be tough to consider It a public park since you have to pay green fees to use lit. Obviously, Its not a forest, playground, nature preserve, or a designated scenic area. Be that as it may, every though we may not consider it a public park, TXDOT Is within their prerogative to do so. Feel free to forward this e-mail to the TxDOT authorities for clarification.
