CALL TO ORDER The Zoning Board of Adjustment of the City of North Richland Hills, Texas met in work session on the 22nd day of September 2022 at 6:30 p.m. prior to the 7:00 p.m. regular Zoning Board of Adjustment meeting in the City Council Workroom. Present: Tom Duer Chair, Place 5 Jim Kemp Place 1 Bill Gibbs Place 6 Doris Elston Place 7 Absent: Steve Koons Place 4, Vice Chair Crystal Ndidi Ibe Place 3, Alternate Staff Members: Clayton Comstock Planning Director Chair Duer called the work session to order at 6:42 p.m. 1 PLANNING DIRECTOR REPORT Planning Director Clayton Comstock provided an update on development projects across North Richland Hills. 2 DISCUSS ITEMS FROM THE REGULAR ZONING BOARD OF ADJUSTMENT MEETING. Mr. Comstock summarized the item on the agenda. Chair Duer adjourned the work session at 6:59 p.m. REGULAR MEETING: 7:00 PM A. A.2 PUBLIC COMMENTS There were no requests to speak from the public. B. MINUTES B.1 APPROVE MINUTES OF THE JUNE 23, 2022, ZONING BOARD OF ADJUSTMENT MEETING. APPROVED A MOTION WAS MADE BY BOARD MEMBER KEMP, SECONDED BY BOARD MEMBER GIBBS TO APPROVE THE MINUTES OF THE JUNE 23, 2022 ZONING BOARD OF ADJUSTMENT MEETING. MOTION TO APPROVE CARRIED 4-0. C. GENERAL ITEMS C.1 ZBA22-0005 PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM NORBERTO SAEZ FOR A VARIANCE FROM SECTION 118-722 (SWIMMING POOLS) OF THE NORTH RICHLAND HILLS ZONING ORDINANCE AT 8117 BEVERLY DRIVE, BEING 0.288 ACRES DESCRIBED AS LOT 7, BLOCK 6, SHADY OAKS, THIRD FILING. September 22, 2022 Zoning Board of Adjustment Meeting Minutes Page 2 of 4 APPROVED Chair Duer read the rules and regulations of the Zoning Board of Adjustment. Chair Duer opened the public hearing and called for Planning Director Clayton Comstock to introduce the request. Mr. Comstock introduced the request. Chair Duer called for the applicant to present the request and be sworn in prior to speaking. Norberto Saez, 8117 Beverly Drive, North Richland Hills, Texas, was sworn in by Chair Duer and presented the request. Mr. Saez discussed how the location of the detached garage and house on the property impacted the developable area in the rear yard. He stated that the costs associated with placing a pool in the rear yard were increased due to this layout and that these costs would not be present if the pool was placed in his side yard. He also discussed how the curve of Grand View Drive affected the shape of his lot and left a large side yard. Chair Duer called Planning Director Clayton Comstock to present the staff report. Mr. Comstock presented the staff report. Chair Duer called for anyone wishing to speak for or against the request to come forward. Randy Huzenlaub, 8304 Shady Oaks Drive, North Richland Hills, Texas, came forward to speak. Mr. Huzenlaub stated that he is the president of the neighborhood's homeowners' association and shared his concerns regarding the maintenance of the pool. He also shared his concerns regarding code enforcement within the Shady Oaks neighborhood. Mr. Comstock discussed the process for inspections and code enforcement within the city. Sandra Huzenlaub, 8304 Shady Oaks Drive, North Richland Hills, Texas, discussed her experience with code enforcement cases in the neighborhood and also state her concerns regarding the maintenance of the pool. Chair Duer, Mr. Comstock, and Mrs. Huzenlaub discussed code issues and actions on properties in the Shady Oaks neighborhood. September 22, 2022 Zoning Board of Adjustment Meeting Minutes Page 3 of 4 Chair Duer called for anyone wishing to speak for or against the request to come forward. There being no one else wishing to speak, Chair Duer closed the public hearing. Chair Duer clarified that the pool would be constructed in-ground. Chair Duer, Board Member Kemp, and Mr. Comstock discussed fencing requirements for pools. Mr. Saez stated that he planned to build an additional fence around the pool for safety. Board Member Gibbs and Mr. Comstock discussed the standards for irregularly shaped lots. A MOTION WAS MADE BY BOARD MEMBER GIBBS, SECONDED BY CHAIR DUER, TO APPROVE ZBA22-0005 WITH THE CONDITION THAT A SECOND FENCE AND GATE BE CONSTRUCTED INTERIOR TO THE PROPERTY TO FURTHER PROTECT THE SWIMMING POOL AREA. MOTION TO APPROVE CARRIED 4-0. D.
