CALL TO ORDER The Zoning Board of Adjustment of the City of North Richland Hills, Texas met in work session on the 22nd day of June 2023 at 6:30 p.m., prior to the 7:00 p.m. regular Zoning Board of Adjustment meeting in the City Council Workroom. Present: Thomas Duer Chair, Place 5 Jim Kemp Place 1 Steve Koons Place 4 Doris Elston Place 7 Absent: Dustin Conniff Place 2, Alternate Scott Walsh Place 3, Alternate Bill Gibbs Place 6 Staff Members: Clayton Husband Principal Planner Emily Marlow Planning Technician Chair Duer called the work session to order at 6:36 p.m. 1 PLANNING DIRECTOR REPORT Principal Planner Clayton Husband discussed new developments in the city and upcoming events. Chair Duer and Mr. Husband discussed the progress of improvements on Bedford-Euless Road and the two new Braums locations in the city. Board Member Kemp and Mr. Husband discussed the status of commercial projects in City Point. Chair Duer, Board Member Kemp, and Mr. Husband discussed the development of June 22, 2023 Zoning Board of Adjustment Meeting Minutes Page 1 of 5 the new Peppa Pig amusement park. Board Member Koons and Mr. Husband discussed the status of the Starbucks at Davis Boulevard and the Marriott Hotel in HomeTown. 2 DISCUSS ITEMS FROM THE REGULAR ZONING BOARD OF ADJUSTMENT MEETING. Mr. Husband discussed item C.1. Board Member Koons asked Mr. Husband if a carport would satisfy the parking requirements of the ordinance. Mr. Husband stated that this would not satisfy the requirements as it is not enclosed. Chair Duer and Mr. Husband clarified the location of Mackey Creek and noted the houses located in the floodway. Chair Duer and Mr. Husband discussed the risk of flooding in the area. Chair Duer adjourned the work session at 6:54. REGULAR MEETING: 7:00 PM A. June 22, 2023 Zoning Board of Adjustment Meeting Minutes Page 2 of 5 A.2 PUBLIC COMMENTS There were no requests to speak from the public. B. MINUTES B.1 APPROVE MINUTES OF THE JANUARY 26, 2023, ZONING BOARD OF ADJUSTMENT MEETING. APPROVED A MOTION WAS MADE BY BOARD MEMBER KEMP, SECONDED BY VICE CHAIR KOONS TO APPROVE THE MINUTES OF THE JANUARY 26, 2023, ZONING BOARD OF ADJUSTMENT MEETING. MOTION TO APPROVE CARRIED 4-0. C. GENERAL ITEMS C.1 ZBA23-0008 PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM KENNETH KELLEY FOR A VARIANCE FROM SECTION 118-831 (MINIMUM PARKING REQUIREMENTS) OF THE NORTH RICHLAND HILLS ZONING ORDINANCE AT 4513 MACKEY DRIVE, BEING 0.303 ACRES DESCRIBED AS LOT 5, BLOCK 9, SKYLINE HOMES ADDITION. APPROVED Chair Duer read the rules and regulations of the Zoning Board of Adjustment. Chair Duer opened the public hearing and called for Principal Planner Clayton Husband to introduce the request. Mr. Husband introduced the request. Chair Duer called for the applicant to present the request and be sworn in prior to speaking. Joseph Johnson, 4513 Mackey Drive, North Richland Hills, Texas, was sworn in by Chair Duer and presented the request. Mr. Johnson discussed how he purchased the house 11 years ago, and that the main selling point was the large converted garage, which acted as living and entertaining space. He stated that he has no intention to rebuild the fireplace in the converted area. June 22, 2023 Zoning Board of Adjustment Meeting Minutes Page 3 of 5 Chair Duer called for anyone wishing to speak for or against the request to come forward. Leah Chance McCann, 4512 Mackey Drive, North Richland Hills, Texas, spoke in favor of the request. Mrs. McCann stated that she hasd lived across from the subject property her entire life and that she remembered when the garage conversion was completed. She discussed her experience with Mackey Creek and how it has not caused problems in her time living at the property. She stated there were no parking issues at the subject property and that the driveway accommodated the parking needs. Kenneth Kelley, 612 Shawnee Road, Waxahachie, Texas, spoke in favor of the request. Mr. Kelley discussed the layout of the house and how it does not accommodate living space and a garage. He asked if there was an ordinance preventing conversions when it was completed. Chair Duer clarified that the request does not concern garage conversions, but the parking standards in the Zoning Ordinance. Greg McCann, 4512 Mackey Drive, North Richland Hills, Texas, spoke in favor of the request. Mr. McCann stated that there are no parking issues on the property and that overflow parking is accommodated by the dead end at Mackey Drive. Jamara Kraatz, 6809 Briley Drive, North Richland Hills, Texas, spoke in favor of the request. Dale Morrow, 4516 Mackey Drive, North Richland Hills, Texas, spoke in favor of the request. Chair Duer called for anyone wishing to speak for or against the request to come forward. There being no one else wishing to speak, Chair Duer closed the public hearing. Chair Duer called for Principal Planner Clayton Husband to present the staff report. Mr. Husband presented the staff report. Chair Duer, Vice Chair Koons, and Mr. Husband discussed how the regulatory floodway designated area on the property affected construction on the property. Chair Duer and Board Member Kemp clarified that a detached garage could not be built on the property due to the floodway location. June 22, 2023 Zoning Board of Adjustment Meeting Minutes Page 4 of 5 A MOTION WAS MADE BY BOARD MEMBER KEMP, SECONDED BY VICE CHAIR KOONS TO APPROVE ZBA23-0008, SUBJECT TO THE CONDITION THAT A FIREPLACE IS PROHIBITED FROM BEING CONSTRUCTED IN THE CONVERTED AREA. MOTION TO APPROVE CARRIED 4-0. D.
