SUMMARY:
The minutes are approved by majority vote of the Board at the Zoning Board of

GENERAL DESCRIPTION:
The Planning and Zoning Office prepares action minutes for each Zoning Board of
Adjustment meeting. The minutes from each meeting are placed on a later agenda for
review and approval by the Board. Upon approval of the minutes, an electronic copy will
be uploaded to the City's website.

work session on the 26th day of September 2024, at 6.30 p.m. in the City Council
Chamber prior to the 7.00 p.m. regular Zoning Board of Adjustment meeting.

B. GENERAL ITEMS
ZBA24-0015 PUBLIC HEARING AND CONSIDERATION OF A REQUEST
FROM BRYCE DAHM FOR A VARIANCE FROM SECTION 118-313 (REAR
YARD OPEN SPACE AND REAR BUILDING LINE) OF THE NORTH
RICHLAND HILLS ZONING ORDINANCE AT 5901 CAMBRIDGE DRIVE,
BEING 0.202 ACRES DESCRIBED AS LOT 11, BLOCK 1, CAMBRIDGE
PLACE.
Vice Chair Koons read the rules and regulations of the Zoning Board of Adjustment.
He stated since there are only four regular members present at the meeting, any
action by the Board must be approved by a unanimous vote.
Vice Chair Koons opened the public hearing and called for Principal Planner Clayton
Husband to introduce the request. Mr. Husband introduced the request.
Vice Chair Koons called for the applicant to present the request and be sworn in
prior to speaking.

Bryce Dahm, 5901 Cambridge Drive, North Richland Hills, Texas, was sworn in by
Vice Chair Koons and presented the request. He described their process of hiring
contractor for the covered patio construction, the issuance of stop work orders in
July 2023 and June 2024 due to permits not being requested or issued, the lack of
responsiveness from the contractor, and discussions with City building inspection
staff about necessary permits and inspections to continue the work. Mr. Dahm
described the benefits of the construction, the effect on surrounding properties, and
support from neighbors regarding the request.
Vice Chair Koons and the applicant discussed the veracity of the contractor's
statements to the applicant about their applying for building permits. Mr. Dahm stated
he ultimately submitted the permit applications on his own behalf.
Vice Chair Koons called for anyone wishing to speak for or against the request to
come forward. There being no one else wishing to speak, Vice Chair Koons closed
the public hearing.
Board Member Foster and the applicant discussed the involvement of the
homeowner's association.
Board Member Foster and Mr. Husband discussed the requirements for public
notification of variance requests.
Board Member Kemp and Mr. Husband discussed the requirements for posting
building permits on the property.
Vice Chair Koons called for Principal Planner Clayton Husband to present the staff
report. Mr. Husband presented the staff report.
Board Member Kemp stated the rear yard open space requirement should be
reevaluated given that lot sizes have gotten smaller on average since that standard
was adopted.
A MOTION WAS MADE BY BOARD MEMBER KEMP, SECONDED BY BOARD
MEMBER ELSTON, TO APPROVE ZBA24-0015 AS PRESENTED.
THE MOTION CARRIED 4-0.

Larry Fortney for a variance from Section 118-718 (Accessory
buildings and structures) of the North Richland Hills zoning
ordinance at 8013 Mickey Street, being 0.15 acres described as Lot
13R2, Block 2, W.E. Odell Addition.

SUMMARY
Larry Fortney is requesting approval of a variance from Section 118-718 (d) to allow a
carport to encroach the six-foot side building line on the east side of the lot. The property
is located at 8013 Mickey Street.
BACKGROUND INFORMATION
The property is located on the north side of Mickey Street east of Smithfield Road. The
property is zoned R-3 (Single-Family Residential) and is developed with a single-family
residence constructed in 1962. The property is part of the original Lot 13, Block 2, W.E.
Odell Addition in Smithfield, which was platted in 1947, and the original lot extended
between Odell Street and Mickey Street. The lot was subdivided into two lots in 2006,
and Lot 13R2 is currently a 6,600-square-foot lot fronting Mickey Street. The lot is
rectangular in shape, being 60 feet wide and 110 feet deep. The property is owned by the
applicant as a rental house, and the applicant lives across the street.
In February 2025, the owner applied for a building permit
to construct a carport over the driveway on the east side
of the house. As part of the plan review, it was noted that
the carport would encroach the side building Tine. The `
owner considered modifications to the carport location
and dimensions in order to comply with the standards.
However, the owner ultimately decided to seek a
variance to allow the structure to be constructed at the
proposed location.
The variance application and supporting materials are
attached. The materials include a copy of the application
explaining the reasoning for the variance request and other relevant documents. An
analysis of the request and relevant codes is below.
NORTH RIICHLAND HILLS
ANALYSIS
The variance request is related to standards for carports, which are contained in .c ii.o.n
l,l -7,�. .� „) of the zoning ordinance.
The carport would be constructed on the east side of the house. The house is located 17
feet from the east property line. The carport is 240 square feet in area, measuring 12 feet
wide and 20 feet deep. The applicant has not indicated the exact location where the
carport would be constructed. However, the location is variable based on the available
space between the house and property line and the carport dimensions. If the carport
were located one foot from the house, it would encroach the side building line by two feet,
leaving a four-foot setback. The exhibits below show this possible location of the carport
and the proposed design.

Zoning Ordinance] as will not be contrary to the public interest and where, because of
special conditions, the enforcement of the [Zoning Ordinance] would result in an
unnecessary hardship."
NORTH RI HLAND HILLS
In exercising it powers to grant a variance, the board of adjustment must make specific
findings and show in its minutes that:
a. Literal enforcement of the controls will create an unnecessary hardship or practical
difficulty in the development of the affected property.
b. The situation causing the hardship or difficulty is neither self-imposed nor generally
affecting all or most properties in the same zoning district.
c. The relief sought will not injure the permitted use of adjacent conforming property.
d. The granting of the variance will be in harmony with the spirit and purposes of
these regulations.
OPTIONS FOR BOARD CONSIDERATION
The Zoning Board of Adjustment has the following options on this application.
1. Approve the variance as presented. This action would approve a variance to the
building line setbacks for the structure and allow the carport to be constructed as
presented.
2. Approve the variance with conditions. This action would approve a variance to the
building line setbacks for the structure, subject to the owner making modifications
to its size, location, or design as directed by the Board.
3. Deny the variance. This action would require the structure to be built in compliance
with building line setbacks.

The following information was submitted with the application on the NRH E-SERVICES PORTAL on March 6,
2025.
DESCRIPTION
Construct/install carport to protect vehicle from hail/storm damage.
1. LIST THE PERTINENT SECTION(S) OF THE ZONING ORDINANCE AND INDICATE THE SPECIFIC
VARIANCES BEING REQUESTED.IF NECESSARY,USE A SEPARATE SHEET.
The city has requirements regarding setbacks on property lines for construction of carports. f want to
construct a carport and need to waive some of these requirements.
2. STATE THE GROUNDS FOR THE REQUEST AND DESCRIBE ANY SPECIAL CONDITIONS THAT CAUSE
HARDSHIPS THAT, IN YOUR OPINION, JUSTIFY THE VARIANCE(S) BEING REQUESTED. EXAMPLES OF
SPECIAL CONDITIONS ARE:TOPOGRAPHY,CREEKS,UTILITY LINES,IRREGULAR LOT OR TRACT SHAPES,
ETC.THE ZONING BOARD OF ADJUSTMENT MUST DETERMINE THAT SPECIAL CONDITIONS EXIST BEFORE
MAKING A MOTION TO APPROVE A REQUEST. IF IT IS DETERMINED THAT SPECIAL CONDITIONS DO NOT
EXIST,THE MOTION MUST BE TO DENY THE REQUEST.
There are carports that have been installed over the years on Mickey Street that do not adhere to the city's
requirements. We are trying to protect vehicles from hail/storm damage.
3. EXPLAIN ANY SPECIAL CIRCUMSTANCES, IF APPLICABLE, NOT CONSIDERED BY THE ZONING
ORDINANCE. EXAMPLES: (1) IF THE SUBDIVISION PLAT WAS APPROVED PRIOR TO THE CURRENT
ZONING ORDINANCE REQUIREMENTS; OR (2)THE ZONING ORDINANCE WAS AMENDED OR A POLICY
CHANGE WAS ADOPTED AFTER SUBMITTING AN APPLICATION FOR A BUILDING PERMIT OR OTHER
PHASE OF THE DEVELOPMENT PROCESS.
We personally know of NRH city employees/inspectors and their neighbors that have carports that do not
adhere to these same city requirements.

Cut leg fee has a maximum of 12"adjustment possible,either front to back or side to side.Please note,side to side on unlevel lots will result in gap
underneath doors.
When building over obstacles such as R.V there's need to be clear of obstacles,tree branches around the perimeter and at least 8'above leg height.
Note,ground must be level.
Installation
Seller will not be responsible for ruts,sprinkler heads, eptic systems,or any other hidden obstacles,so please mark anything you think we may
damage while approaching or working on your site.
Warranty
All*new*units have a one-year leak warranty and one-year workmanship warranty.

Completion/Payment
You or an authorized adult representative must be at the site when we arrive to show us the site selected for the building.Upon completion,you
will be asked to sign a completion certificate and pay the installer in full.They will accept your cash or check or they will contact our office to process your
debit/credit card.If payment in full is not received,a Mechanic's Lien may be placed on the property until the balance is paid in full.

when,the wind makes the install dangerous for the install crew to work and days that the customer's site is too muddy to work or access.
Permits
It is your responsibility to secure any permits required.Check with your local city/county government offices if you are not sure if a permit is
required.We must have a copy of your permit prior to scheduling your installation.If we have to be involved in the permitting of your building,additional
charges will be incurred.Ask your salesperson about Permit Fee%
Roof Style for Buildings over 36'Long
Vertical roofs are required for buildings over 36'long.We will not be responsible for leaks or other roof issues on buildings 36'in length or longer
with a boxed eave or regular roof.

Castle Fdetal Buildings comes with a 1.ymr maintenano warraft fmm date of installatlon,that covers general leaks,repairs and rust to the metal or frame
of the building.ALL BUILDINGS HAVE A ROOF SNOWLOAD OF 25 LBS PER SQUARE FOOT and can be designed to exceed load at an additional cost.
LEAK Warranty
Leaks that occur in the roof of the building where metal is fastened to frame are covered in this 1-year maintenance warranty.(Overlaps on Horizontal Metal
are not covered in the warranty as buildings longer than 35ft should have a vertical metal application to avoid leak potential.)No warranty is provided for
leaking at base rail.
RUST Warranty
Tht 12-giVge steel option carries a 20 year no rust IIrnft§Lwan30ty.if the frame rusts within 20 years we will repair and/or replace it.ShWMetai is
painted with the Sherwin Williams paint which we warranty for 20 years after installation against rusting fading,peeling and/or peeling.We will replace the
defective parts within 20 years of original purchase should these rust through to point of instability.Chemicals,salts or damage to the metal that causes the
paint to chip,fade,bubble or peel is not covered.
30 Day Warranty.
Doors:For the first 30 days after installation,your walk-in door and roll-up door will be repaired or replaced if there is a manufacturing defect with the door.If
the door does not close,fasten properly,or the door handle/lock does not operate properly,or you notice any damages to the door at the time of installation
it should be reported to info@castlebuildingsinc.com or call 903-498-8899.Castle Metal Buildings is not responsible for repairs to doors or buildings where
� 7NIQU� and the wind blows the door open and causes damage.Customers may purchase doors and pay to have them replaced.
When a building settles over several weeks the customer may e$perience the tension of the door being tighter or the walk-in door being more difficult to
close.After 30 days Castle Metal Buildings Inc will send a contractor back to adjust the door for a return trip fee of$75.00.Walk in doors ONLY OPEN to the
outside.Doorknobs&locks,manufacturing defects including rut are covered under the 1-year maintenance warranty.A 14-day warranty covers any issue
with the door opening or closing improperly after installation,R Ii-Up doors have a 3'gap at the top of the d99r,Options for a TOP CLOSURE are available for
purchase through a 3rd party vendor which the customer canself-install.Manufacturer defects including rust and breakage of the sliding latches or handles
are covered under the 1-year maintenance warranty.A 30-day Warranty covers any issues with the opening and closing of the roll up door.Latches&handles
are only available for installation on the outside of the roll-up door.
ADVISEMENT:"Customer is advised that any alterations they mOke to the building,as installed,may void certain warranties.Alterations include,but are not
limited to,electrical,plumbing,or aftermarket doors,shelving,or insulation!

• Seller warrants windows,entry doors,and roll up doors for 90 days against workmanship defects.Components are guaranteed to be free of defects
for 1 year.
• Uneven or unlevel site installations are installed as-is and the only warranties issued are the rust through warranties.
• The replacement or repair of any defective workmanship or defective materials shall constitute fulfillment of all liabilities of Castle Metal Buildings,
Inc under this warranty.
• Sellers liability for any breach of warranty is limited to repair or replacement,at seller's option.Seller makes no warranties,expressed or implied,
other than those expressly stated herein.Seller makes no warranty of merchantability or fitness for any particular purpose and shall not be liable for
any incidental or consequential damages,including but not limited to damage to contents or any other property.
• Buyer agrees any legal disagreement or litigation will take place in the state of Texas and in no circumstances will Castle Metal Buildings,Inc be
responsible for loss of use,lost profits,lost commercial use,or lost economic damages or any losses or damages arising therefrom.Any and all
implied warranties are expressly disclaimed,and the sole warranty provided is the express limited warranty stated in this document.This warranty
will not apply to any Castle Metal Buildings,Inc product or any part thereof which has been damaged by adverse weather conditions,earthquake,
