J. EXECUTIVE SESSION
The City Council may enter into closed Executive Session as authorized by
Chapter 551, Texas Government Code. Executive Session may be held at
the end of the Regular Session or at any time during the meeting that a need
arises for the City Council to seek advice from the city attorney (551.071) as
to the posted subject matter of this City Council meeting.
The City Council may confer privately with its attorney to seek legal advice on
any matter listed on the agenda or on any matter in which the duty of the
attorney to the governmental body under the Texas Disciplinary Rules of
Professional Conduct of the State Bar of Texas clearly conflicts with Chapter
551, Texas Government Code.
1. Section 551.071: Consultation with City Attorney to seek advice about
pending or contemplated litigation or on a matter in which the duty of
the attorney to the governmental body under the Texas Disciplinary
Rules of Professional Conduct of the State Bar of Texas clearly

SUBJECT: Approve Resolution No. 2025-027, canvassing the results of the May
3, 2025 General Election.
PRESENTER: Alicia Richardson, City Secretary/Chief Governance Officer
SUMMARY:
The City Council is required to canvass the votes cast at the City Council General
Election held on May 3, 2025. Resolution No. 2025-027, formally accepts the results of
the election and declares the winning candidates.
GENERAL DESCRIPTION:
The Texas Election Code requires that the City Council meet no earlier than the third
(3rd) day and no later than the eleventh (11t") day after the General Election to canvass
the results of the election. The City Council cannot canvass the election results until
the Early Voting Ballot Board has verified and counted all provisional ballots or timely
received ballots from outside the United States.
The table below consists of the results posted on Tarrant County's website (timestamp
May 3, 2025, 11-02.30). The results do not include all provisional ballots or timely
received ballots from outside the United States. The additional ballots will not affect the
outcome of the election results. Staff will receive the final unofficial results from Tarrant
County before the meeting. The resolution will be updated to reflect the final unofficial
results and presented at the meeting.

RESOLUTION NO. 2025-027
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORTH
RICHLAND HILLS, TEXAS, CANVASSING THE ELECTION RESULTS
OF THE MAY 3, 2025 GENERAL ELECTION; AND DECLARING
CANDIDATES ELECTED TO OFFICE.
WHEREAS, the City of North Richland Hills, Texas ("City") is a home rule city acting
under its charter adopted by the electorate pursuant to Article XI, Section
5 of the Texas Constitution and Chapter 9 of the Local Government Code;
and
WHEREAS, the City of North Richland Hills Charter provides that city elections shall be
held in accordance with laws of the State of Texas; and
WHEREAS, Section 41.001(a) of the Texas Election Code, as amended by the 84tn
Texas Legislature, establishes the first Saturday in May as a uniform
election date for the purposes of conducting a General Election; and
WHEREAS, Section 3.004(b) of the Texas Election Code provides that the governing
body of a municipality shall be the authority to order a General Election for
the purposes of electing members to the governing body; and
WHEREAS, the City Council approved Resolution No. 2025-016, calling the General
Election of May 3, 2025 for the purpose of electing council members to
serve on City Council in Places 1, 37 5, and 7; and
WHEREAS, an election was duly held in the City of North Richland Hills on the 3rd day
of May, 2025 to elect Council Places 1, 37 5, and 7; and
WHEREAS, the City Council has met to canvass the votes cast in such election and
accept the tabulations provided by Tarrant County Elections Administrator
(Exhibit A).

GENERAL DESCRIPTION:
In accordance with the Election Code, the newly elected officials will officially be sworn
in, and oaths administered by the city secretary. The ceremonial oath of office and
swearing in will take place on May 14, 2025. The following candidates have been
elected to office.

The City Secretary's Office prepares action minutes for each City Council meeting. The
minutes for the previous meeting are placed on the consent agenda for review and
approval by the City Council, which contributes to a time-efficient meeting. Upon
approval of the minutes, an electronic copy will be uploaded to the City's website.

City Council, Ms. Ormbsy, and staff discussed audit recommendations, unassigned
funds, and the city's standard for fund balances.

Council member Vaughn presented his proposed amendments for the March 24, 2025
City Council meeting minutes. City Council discussed the city's practice for minutes to
include the subject and action taken by the City Council, proposed amendments, the
video for work sessions being available on the website, and official record for City
Council meetings.

Council member Vaughn called for a point of information. Mayor McCarty recognized
Council member Vaughn. Council member Vaughn stated that Council member Mitchell
is referencing two sets of minutes. Council member Mitchell noted that the March 24
meeting minutes reflect Council member Vaughn left during the work session. The
proposed revision submitted by Council member Vaughn states that he left the meeting in
protest. It was not clear or stated by Council member Vaughn that his departure was in
protest.
COUNCIL MEMBER BLAKE MOVED, SECONDED BY COUNCIL MEMBER
MITCHELL, TO SUSPEND DEBATE AND CALL FOR THE QUESTION.
Council member Vaughn moved to appeal the decision of the chair recognizing Council
member Blake's motion to suspend debate and call for the question.

1.1 ANNOUNCEMENTS
Associate Mayor Pro Tern Rodriguez made the following announcements.
Tuesday, April 29 is the last day for early voting and election day is this Saturday, May
3. Polling locations will be open from 7.00 a.m. to 7.00 p.m., including the Library, City

Hall and other locations in Tarrant County. You can find more information on the city's
website. Please contact the City Secretary's Office with any questions.
The Sounds of Spring Concert Series continues each Friday night through May 16 on
the plaza in front of City Hall. Admission is free. Seating starts at 6.00 p.m. and concerts
begin at 7.00 p.m. Seating is on the lawn, so don't forget to bring a blanket or lawn chair.
A variety of food trucks will be on-site for each concert. Please visit the city's website for
more details.
The NRH Library is hosting a Free Comic Book Day event from 10.00 a.m. to noon on
Saturday, May 10. There will theme crafts, a scavenger hunt, Pokemon Card Swap, and
free comics while supplies last. Family-friendly costumes are welcome and encouraged.
Come dressed as your favorite hero and join the fun! Contact the Library for more details
Kudos Korner - Todd Ryals, David Nichols and Chris Turner in Public Works - A resident
posted her appreciation for the city staff who coordinated the reconstruction of Lake
Side Circle. She said, "It's so nice now that its completed. Special thanks to Chris Turner
for being so responsive to messages and calls relating to the progress, making visits to
ensure the job was going well and meeting with neighbors to provide information.

Mayor McCarty stated that due to Council member Vaughn's threatened litigation against
the city that he would not participate in Executive Session for item 3, waiver of attorney
client privilege, related to Resolution No. 2025-021.
Council member Vaughn asked what law prohibits an elected official from attending
executive session.
City Attorney Bradley Anderle stated that legal advice is privileged and any person
adverse to the city's position defeats the purpose to receive legal advice. Due to Council
member Vaughn not recognizing his conflict of interest and threatened litigation, Mr.
Anderle recommended that City Council take action to exclude Council member Vaughn
from item 3 on the Executive Session.
Associate Mayor Pro Tern Rodriguez called for a point of information. Mayor McCarty
recognized Associate Mayor Pro Tern Rodriguez. Associate Mayor Pro Tern Rodriguez
asked if the city attorney could represent the city and the elected official who has
threatened litigation against the city and if the information discussed could be used
against the city. Mr. Anderle clarified that as the city attorney he cannot represent both
parties and the information discussed in Executive Session could be used against the
city.
Council member Vaughn called for a point of information. Mayor McCarty recognized
Council member Vaughn. Council member Vaughn asked for the topic for item F.5 on
the posted agenda. Mayor McCarty said that item F.5 is to discuss, consider, and act on
the release of information related to the special meeting held on April 9, 2025, and
Resolution 2025-021 , and consider and act on waiving the attorney-client privilege for
information that is to be released. Council member Vaughn asked why the discussion to
act on waiving the attorney-client privilege is in Executive Session and not open session.
Mayor McCarty said there are details regarding the city waiving the attorney-client
privilege.
Mr. Anderle advised his recommendation is that City Council receive his advice in
Executive Session before waiving their attorney-client privilege.
Council member Vaughn called for a point of information. Mayor McCarty recognized
Council member Vaughn. Council member Vaughn asked if there is a restriction for the

before the city received correspondence from Council member Vaughn's attorney.

SUBJECT: Consider Ordinance No. 3903, amending Section 106-13 (c) (3), City
of North Richland Hills, Code of Ordinances, Building and Land Use
Regulations, related to portable signs.
PRESENTER: Stefanie Martinez, Managing Director of Community Services
Summary:
The City Council is being asked to approve an ordinance amending the current sign
regulations, authorizing the City Manager or designee to approve, on a case-by-case
basis, allowance for temporary portable signs to be erected for more than 10 days or to
be placed closer than 100 feet apart.
General Description:
The City's current regulations regarding signs can be found within Chapter 106 of the
Code of Ordinances. Section 106-13 (c) regulates temporary signs, with a specific section
(3) addressing portable signs. This section currently allows for portable signs to be
erected for a maximum of 10 days, and requires any portable sign to be placed at least
100 feet away from any other portable sign on the lot.
Recently, the City received a request from Birdville ISD related to placing temporary
signage which would encourage or remind parents to complete registration for the
upcoming school year. A question was raised about extending the 10-day maximum time
period, but the ordinance in its current form does not provide an avenue by which staff
can approve an extension.
While staff does not propose a blanket extension in the time period for temporary portable
signage, the proposed request would provide an extension on the maximum approval by
the City Manager or designee, on a case-by-case basis. This extension could not exceed
30 days. In addition, the proposed ordinance would allow granting of exceptions to the
minimum 100' spacing requirement.

AN ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS
AMENDING CHAPTER 106, SIGNS, OF THE CODE OF
ORDINANCES, NORTH RICHLAND HILLS, TEXAS TO REVISE
STANDARDS FOR PORTABLE SIGNS; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING FOR SEVERABILITY; ESTABLISHING A PENALTY;
PROVIDING FOR SAVINGS; PROVIDING FOR PUBLICATION;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of North Richland Hills, Texas is a home-rule municipality located
in Tarrant County, Texas acting under its charter adopted by the electorate
pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of
the Local Government Code; and
WHEREAS, the Sign Regulation Ordinance governs the use, size, location, construction,
and maintenance of signs with an intent to avoid visual clutter, which is
potentially harmful to traffic, pedestrian safety property values, business
opportunities, and community appearance; and
WHEREAS, the City Council desires to amend certain portions of the Sign Regulations
Ordinance regarding portable signs; and
WHEREAS, the City Council has determined that the proposed ordinance amendment
promotes the health, safety, morals, and the general welfare within the City
of North Richland Hills and is in the best interest of the City of North
Richland Hills;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS:
SECTION 1: That Chapter 106, Signs, in the Code of Ordinances, City of North
Richland Hills, Texas be amended in part by revising Section 106-13(c)(3)
— "Portable signs" to add
r. An exception may be granted by the City Manager or his/her designee
to allow for the placement of a portable sign closer than 100 feet from
another sign on a lot, and/or to allow for an extension of the time period
erected up to a maximum of 30 days.

SECTION 2: This Ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances, City of North Richland Hills, Texas, as amended,
except when the provisions of this Ordinance are in direct conflict with the
provisions of such ordinances and such code, in which event the
conflicting provisions of such ordinances and such code are hereby
repealed.
SECTION 3: It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, and phrases of this Ordinance
are severable, and if any section, paragraph, sentence, clause, or phrase
of this Ordinance shall be declared unconstitutional by the valid judgment
or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining sections, paragraphs, sentences,
clauses, and phrases of this Ordinance, since the same would have been
enacted by the City Council without the incorporation in this Ordinance of
any such unconstitutional section, paragraph, sentence, clause or phrase.
SECTION 4: Any person, firm or corporation violating any provision of the Sign
Regulations of the City of North Richland Hills as amended hereby shall
be deemed guilty of a misdemeanor and upon final conviction thereof
fined in an amount not to exceed Five Hundred Dollars ($500.00). Each
day any such violation shall be allowed to continue shall constitute a
separate violation and punishable hereunder.
SECTION 5: All rights and remedies of the City of North Richland Hills are expressly
saved as to any and all violations of the provisions of any ordinances
governing the sign regulations that have accrued at the time of the
effective date of this Ordinance; and, as to such accrued violations and all
pending litigation, both civil and criminal, whether pending in court or not,
under such ordinances, same shall not be affected by this Ordinance but
may be prosecuted until final disposition by the courts.
SECTION 6: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clause of this ordinance
as required by law, if applicable.
SECTION 7: This Ordinance shall be in full force and effect upon publication as
required by law.
AND IT IS SO ORDAINED.

Library in the Park returns on Tuesday mornings at 10.30 a.m. from May 20 through
June 10 with story time and songs at a different park each week. Participants can also
check out books, take home crafts and more. Visit the Library's website for locations
and more details.
The NRH Senior Center is hosting a health fair from 10 a.m. to 1 p.m. on Wednesday,
May 28 in the Grand Hall at the NRH Centre. There will be free health screenings and
information from numerous health and wellness providers. Everyone is welcome to
attend.
Kudos Korner:
Every Council Meeting, we spotlight our employees for the great things they do. Tonight
we recognize:
John Celis and Francisco Mercado in the Parks Department - A resident called the
Parks Administration from Adventure World Playground with praises for the employees
who maintain our parks. She said that while John and Francisco were emptying the
park's trash cans, they were very pleasant to park users and had a nice interaction with
her son. She added that she loves our parks and our employees are doing a great job.
