Chair Welborn and the applicant discussed the potential for redevelopment of the adjacent office site as an extension of the development. Commissioner Goetz and the applicant discussed the plans for the creation of a homeowner's association for proposed development or if it would be absorbed into an existing Hometown association. Commissioner Narayana and the applicant discussed the drainage easement on the property in relation to the location of the offsite parking areas, parking easements, sidewalks on adjacent properties, and the use of city-owned property on the south. Chair Welborn, Commissioner Ross, and the applicant discussed the price points of townhouses and property tax comparisons for the properties. Alternate Carpenter and the applicant discussed the speed tables and green streets in the site design. Alternate Kerby and the applicant discussed the parking spaces planned for each residence. Chair Welborn and the applicant discussed the maintenance of the green streets, and the overall number of units proposed in relation to the dimensions of the property. Commissioner Narayana and the applicant discussed the design of residences where the front of a house faced the side of another house. Chair Welborn, Commissioner Narayana, and the applicant discussed the design of the side elevations of houses and the inclusion of porches, covered stoops, and similar features. Chair Welborn and the applicant discussed the possible home builders for the development. Alternate Carpenter and the applicant discussed sound attenuation for the homes on the north side of the development adjacent to Birdville High School property. Commissioner Ross asked to review the emails and public input submitted for the case. Copies of emails were distributed to the Commission. Chair Welborn and the applicant discussed lot dimensions for the detached and townhouse lots and the economic rationale regarding the density in phases of Hometown. Commissioner McMahon and the applicant discussed the dead end mews and streets in relation to emergency vehicle access and deliveries. Chair Welborn and the applicant discussed parking management in relation to the Hometown homeowner's association. Commissioner Narayana and the applicant discussed the plans for fire sprinkler systems in all houses. Commissioner Goetz spoke in support of the application. Chair Welborn spoke in support of the application. Commissioner Ross spoke in opposition to the application due to its location. Commissioner Narayana spoke in support of the application and stated it's the best option for the property. PRESENTER: Clayton Husband, Principal Planner SUMMARY: On behalf of Davis Blvd JVA LLC, Samuel Tully is requesting approval of a final plat of The Hills at Davis Park. The 3.925-acre commercial site is located on the east side of Davis Boulevard between Thornbridge Drive and Timber Drive. GENERAL DESCRIPTION: The property under consideration is a 3.925-acre site on the east side of Davis Boulevard between Thornbridge Drive and Timber Drive. The site is currently developed with a vacant single-family residence. The property is zoned 0-1 (Office) and the applicant intends to develop professional, administrative, medical, and general business offices on the site. The proposed development includes six lots. The lots generally range in size from 14,728 to 58,898 square feet. Four lots have frontage on Davis Boulevard, with two lots located interior to the site. The plat includes a common access easement that connects all lots to the proposed driveway on Davis Boulevard. This plat only requires approval by the Planning and Zoning Commission. The project design includes a proposed detention pond in the southwest portion of Lot 6, which is noted by a drainage easement on the lot. Detention ponds require approval of a special use permit by the Planning and Zoning Commission and City Council. This is a separate application that would be submitted and considered at a later date. The site is adjacent on three sides to single-family residential zoning. Common questions regarding development standards adjacent to residential uses are summarized below: o Minimum 35-foot building setback from all residentially zoned properties. o Minimum 15-foot landscape buffer from all residentially zoned properties, to include one large tree per 30 linear feet. o Minimum six (6)-foot tall masonry wall on common property line. NORTH RIICHLAND HILLS o Outdoor lighting (i.e. parking lot lights) within 100 feet of residential property may not exceed 20 feet in height and must be shielded to minimum glare and light trespass on to adjacent residential properties. o Minimum 25-foot setback for any refuse containers and enclosures. o Building heights may vary depending on their setback. For every 1 foot of building setback from residential property line, the building can be up to 1.5 feet tall. VISION2030 COMPREHENSIVE PLAN: This area is designated on the Vision203O Land Use Plan as Office Commercial. This designation encourages professional, medical, and administrative office as well as limited commercial establishments that benefit adjacent and nearby residential areas, and in which all business and commerce is conducted indoors. It encourages the development of a variety of office types including traditional office buildings, executive suites, and co-working spaces. CURRENT ZONING: The property is zoned 0-1 (Office). This district is intended to permit the professional and organizational office needs of the community. The zoning was approved by City Council on September 23, 2024 (Ordinance 3868). TRANSPORTATION PLAN: The development has frontage on the following streets. Right-of-way dedication is not required for the property. The City of North Richland Hills received this plat on April 23, 2025. The Development Review Committee reviewed this plat on April 29, 2025.The following Development Review Committee comments represent the written statement of the conditions for CONDITIONAL APPROVAL of the plat by the Planning and Zoning Commission. In addition to the DRC comments included in this letter, review comments for this project are noted on a marked-up plat drawing. The marked-up plat is intended to supplement the comments in this letter. 1. The zoning for the property requires a front building line of 25 feet adjacent to the Davis Boulevard frontage. Add the building line to the plat. NRH Subdivision Regulations§110-201(Requirements for all plat drawings—building setback lines) 2. Delete note 5 or revise as noted on the marked-up drawing. While it is not necessary to reference the zoning designation on the plat as the zoning could change in the future, the property is currently zoned 0-1 (Office). GENERAL DESCRIPTION: In anticipation of increased interest in data center development and in keeping with the goal of proactive planning, staff is proposing the addition of two new use categories to the Table of Permitted Uses: "Data Center, General" and "Data Center, Small-Scale." This dual-category approach will allow the City to differentiate between larger, utility-scale facilities and smaller, lower-impact operations, and to tailor zoning permissions accordingly based on the scale of the project and possible impacts to nearby properties. The proposed amendment is the result of a comprehensive review of how other communities—some nearby, and others who have been recognized for a forward-thinking approach to data centers — are addressing the rise in data center development. It also considers feedback from prospective data center developers to better understand their operational needs and siting considerations. By establishing distance requirements between cooling equipment and residential properties—particularly for the "Data Center, Small-Scale" category—we are enabling these facilities to be permitted byright in select commercial zoning districts where impacts can be effectively managed. This not only upholds the City's commitment to neighborhood protection but also supports the Council's goals of regulatory efficiency and a business- friendly environment. Larger-scale data centers, classified under "Data Center, General," would remain subject to a Special Use Permit in more sensitive or transitional areas, allowing for more thorough review and public input when appropriate. This approach attempts to strike the right balance between encouraging innovation and economic development, while ensuring our zoning regulations protect community character and livability. NORTH RICHLAND HILLS Proposed Definitions: The definitions for the two categories of data center are listed below, with the sole difference being the size of the building or buildings. A building or group of buildings in excess of 10,000 total square feet primarily used to house computers and/or related equipment for the purpose of collection, storage, management, processing, or retrieval and distribution of digital data, which houses computer and/or network equipment, systems, servers, appliances, and other associated components related to computing and digital data operations. Data Center, Small-scale. A building or group of buildings not to exceed 10,000 total square feet primarily used to house computers and/or related equipment for the purpose of collection, storage, management, processing, or retrieval and distribution of digital data, which houses computer and/or network equipment, systems, servers, appliances, and other associated components related to computing and digital data operations. Proposed Inclusion in Table of Permitted Uses: The table below outlines the addition of the two uses, specifying that either would be allowed by right in the 1-1 and 1-2 districts. In the C-2 district, a small-scale data center would be permitted by right, whereas a large-scale data center would need special use permit approval. In the C-1 district, only a small-scale center could be approved by special use permit. [#]=Conditions. SECTION 3: THAT the Comprehensive Zoning Ordinance and Code of Ordinances of the City of North Richland Hills be amended by adding the following to Section 118-633 - "Legend for section 118-631; special land use regulations" of Chapter 118 of the North Richland Hills Code of Ordinances, to read as follows. SECTION 5: This Ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of North Richland Hills, Texas, as amended, except when the provisions of this Ordinance are in direct conflict with the provisions of such ordinances and such code, in which event the conflicting provisions of such ordinances and such code are hereby repealed. SECTION 6: It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable, and if any section, paragraph, sentence, clause, or phrase of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining sections, paragraphs, sentences, clauses, and phrases of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional section, paragraph, sentence, clause or phrase. Ordinance No. **** Page 3 of 6 SECTION 7: Any person, firm or corporation violating any provision of the Zoning Ordinance and the zoning map of the City of North Richland Hills as amended hereby shall be deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount not to exceed Two Thousand Dollars ($2,000.00). Each day any such violation shall be allowed to continue shall constitute a separate violation and punishable hereunder. SECTION 8: All rights and remedies of the City of North Richland Hills are expressly saved as to any and all violations of the provisions of any ordinances governing zoning that have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 9: The City Secretary is hereby authorized and directed to cause the publication of the descriptive caption and penalty clause of this ordinance as required by law, if applicable.
