HomeMy WebLinkAboutOrdinance 3933 ORDINANCE NO. 3933 AN ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, AMENDING CHAPTER 2 - ADMINISTRATION, ARTICLE III - BOARDS, COMMISSIONS AND COMMITTEES OF THE CODE OF ORDINANCES, CITY OF NORTH RICHLAND HILLS, TEXAS, ADDING A NEW DIVISION 5 — ADVISORY COMMITTEE ON SENIOR AFFAIRS; CREATION; MEMBERSHIP, APPOINTMENT, AND TERMS; PURPOSE; APPOINTMENT OF CHAIRPERSON; MEETING FREQUENCY; AMENDING SECTION 2-122(A), LIMITATION ON THE POWERS OF CERTAIN BOARDS; PROVIDING THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of North Richland Hills, Texas ("the City") is a home rule city acting under its power adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City Council recognizes the growing population of senior citizens and the importance of ensuring their voices are heard in shaping programs and services that affect their well-being; and WHEREAS, the City Council seeks to align existing community resources with the needs of its aging population through structured civic engagement; and WHEREAS, the City Council deems it necessary to amend the Code of Ordinances governing the City's Boards, Commissions, and Committees to establish an Advisory Committee on Senior Affairs. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: SECTION 1. The City Council hereby finds the recitals above to be true and correct, and such recitals are hereby incorporated into this Ordinance as if written herein. SECTION 2. That Chapter 2 — Administration, Article III — Board, Commissions, and Committees, of the Code of Ordinances, City of North Richland Hills, Texas, be amended to add Division 5 —Advisory Committee on Senior Affairs to read as follows: "§ 2-231. Creation of the Advisory Committee on Senior Affairs. There is hereby established an Advisory Committee on Senior Affairs ("Committee") to enhance communication and outreach for the senior citizen population. The Committee is responsible for supporting through community education the senior-related programs and services available in North Richland Hills. The Committee serves in an advisory Ordinance No.3933 Page 1 of 4 capacity in matters pertaining to its senior citizens, helps identify the needs of senior citizens and enhance their quality of life, and uses all available resources to inform senior citizens of community services. The Committee shall serve purely in an advisory capacity with no judiciary power. § 2-232. Membership, Appointment and Term. (a) The Committee shall consist of seven (7) residents of the City of North Richland Hills, who must be at least 55 years of age; two non-voting staff members, the city manager or their designee and the NRH Senior Center manager; and a member of the City Council, to be appointed by the mayor, to serve as a liaison. (b) An ex-officio member from each of the following organizations — Community Enrichment Center Senior Network, Social Transportation for Seniors, Northeast Transportation Services (NETS), and Serving our Seniors (Mid-Cities Care Corps) may also serve on the Committee. (c) Each member will serve in numbered places and the council member whose place- number coincides with the numbered place shall nominate a person to serve in that place. The actual appointment will be subject to the approval of the City Council. Members shall serve terms that are of the same length as the Mayor and Council members, unless appointed to fulfill a vacancy. (d) No member shall serve more than three (3) consecutive terms. § 2-233. Purpose. The purpose of the Committee is as follows: (a) Promote awareness of existing resources and services available to seniors. (b) Serve as a liaison between the senior community and the City of North Richland Hills by seeking input to enrich and enhance the health and quality of life of seniors in the community. (c) To form partnerships in the community to educate, inform, and improve the quality of life for seniors. (d) Collaborate with local organizations, the NRH Senior Center, nonprofits, and agencies serving older adults. (e) Assist in promoting events and initiatives for seniors. § 2-234. Meetings. (a) At the first regular meeting following the appointment of new Committee members by the City Council, the Committee shall select from the members a Chair and Vice- Chair for a one (1) year term and shall serve until their successors are appointed. Ordinance No.3933 Page 2 of 4 (b) Regular meetings shall be held quarterly, unless directed otherwise at the request of the Chair or City Council. (c) Majority of regular members shall constitute a quorum (4 members present). (d) All meetings of the Committee shall be in accordance with the Texas Open Meetings Act. (e) Minutes of each meeting shall be approved by a majority of the Committee and forwarded to the City Secretary/Chief Governance Officer for file. (f) The Committee shall receive reports from local resources and associations that serve the aging population on how their services have been utilized by the population, as well as from City departments on any projects or activities that may affect the senior citizen population. § 2-235. Reporting. By October 1 of each year, the Committee shall submit a written report to the City Council on the status of its activities to date, findings, and trends and needs of the senior citizen population. § 2-236. Liaison Staff Member. The city manager shall appoint a staff member who shall be responsible for coordinating meetings, posting agendas, providing access to relevant data and resources, and facilitating communication between the Committee and City Administration. § 2-237 through § 2-249. (Reserved)" SECTION 3. That Chapter 2 — Administration, Article III — Board, Commissions, and Committees, Section 2-122(a), Limitation on the powers of certain boards, of the Code of Ordinances, City of North Richland Hills, Texas be amended to read as follows: "(a) Application of section. This section shall pertain to the following boards and commissions of the city, which are advisory bodies to the City Council: (1) Advisory Committee on Senior Affairs; (2) Animal Control Shelter Advisory Committee; (3) Keep North Richland Hills Beautiful Commission; (4) Library Board; (5) Parks and Recreation Board; and (6) Teen Court Advisory Board." SECTION 4. This Ordinance shall be cumulative of all provisions of the Code of Ordinances, City of North Richland Hills, Texas, except where the provisions of this Ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. Ordinance No.3933 Page 3 of 4 SECTION 5. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 6. This Ordinance shall be in full force and effect from and after its passage. AND IT IS SO ORDAINED. PASSED AND APPROVED on this 27th day of October, 2025.
