In order to address the City Council during public comments, a Public Meeting Appearance Form must be completed and presented to the City Secretary prior to the start of the City Council meeting. B. GENERAL ITEMS B.1 Approve Resolution No. 2025-045, canvassing the results of the November 4, 2025 Special Election and declaring the results of the Charter Amendment Election. CITIZENS PRESENTATION An opportunity for citizens to address the City Council on matters which are not scheduled for consideration by the City Council or another City Board or Commission at a later date. In order to address the City Council during citizens presentation, a Public Meeting Appearance Form must be completed and presented to the City Secretary prior to the start of the City Council meeting. EXECUTIVE SESSION The City Council may enter into closed Executive Session as authorized by Chapter 551, Texas Government Code. Executive Session may be held at the end of the Regular Session or at any time during the meeting that a need arises for the City Council to seek advice from the city attorney (551.071) as to the posted subject matter of this City Council meeting. The City Council may confer privately with its attorney to seek legal advice on any matter listed on the agenda or on any matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551, Texas Government Code. Monday, November 17, 2025 City Council Agenda Page 3 of 3 "I"wFt h^JOKTH KIC:HLAND HILLS CITY COUNCIL MEMORANDUM FROM: The Office of the City Manager DATE: November 17, 2025 SUBJECT: Approve Resolution No. 2025-045, canvassing the results of the November 4, 2025 Special Election and declaring the results of the Charter Amendment Election. PRESENTER: Alicia Richardson, City Secretary/Chief Governance Officer SUMMARY: The City Council is required to canvass the votes cast at the Special Election held on November 4, 2025. Resolution No. 2025-045 formally accepts and declares the results of the Charter Amendment Election. GENERAL DESCRIPTION: In compliance with the Charter of the City of North Richland Hills, Chapter 9 of the Texas Government Code, and the Texas Election Code, the City Council shall meet to canvass the results of the election. The unofficial results received from Tarrant County Elections listed below do not include all absentee or provisional votes. Staff will provide updated unofficial results from Tarrant County at the meeting. PROPOSITION TOTAL TOTAL FOR AGAINST Proposition A 8018 2250 Shall Article V, Section 3 of the North Richland Hills Home Rule Charter be amended to provide that the Mayor and Council members shall be elected for three-year terms; to provide that the Mayor and Council members must be elected by a majority vote; to provide for the transition to three-year terms by establishing an election schedule; and Section 3A (3,4,5) be added to define the positions of Mayor and Council members; to provide that 730 days served constitutes a three-year term; to provide that a person who vacates their office after serving 360 days has served a term; and Section 7 be amended to provide that in the event there is one vacancy in any office with a three-year term with an unexpired term of 364 days or less the vacancy may be filled by appointment of the Mayor with approval of council; to provide that vacancies in any office with a three-year term with an unexpired term of greater than 364 days must be filled by special election within 120 days of the vacancy? Proposition B 1 8145 2158 Shall Section 3A (1,2) be added to Article V of the North Richland Hills Home Rule Charter to provide that a Council member shall be limited to three (3) terms as a Council member, but may serve three (3) additional terms as Mayor; to provide that the Mayor shall be limited to three (3) terms as Mayor, but may serve three additional terms as Council member? "I"wFt h^JOKTH KIC:HLAND HILLS Proposition C 92151 1069 Shall Article V, Section 3 of the North Richland Hills Home Rule Charter be amended to provide that a Mayor or Council member shall automatically resign their office upon becoming a candidate for any office of profit or trust other than the office then held; and to provide for filling the vacancy in the manner consistent with filling of vacancies? Proposition D 1 75501 2505 Shall Article VI, Section 7(1) of the North Richland Hills Home Rule Charter be amended to strike the requirement that the term of the municipal court judge coincide with the term of the Mayor? Proposition E 1 78661 2237 Shall Article XIV, Section 1 of the North Richland Hills Home Rule Charter be amended to provide that Planning and Zoning Commission members shall serve terms that are the same length as the term of the Mayor and Council members; and to provide that the appointment and duration of members' terms shall coincide with the terms of Council members? Proposition F 1 8262 1 1738 Shall Article IX, Section 4 of the North Richland Hills Home Rule Charter be amended to delete references to $50,000 as the minimum purchase amount for competitive bidding; and to provide that all purchases must be competitively bid if competitive bidding is required by State law? RECOMMENDATION: Approve Resolution No. 2025-045, as presented by staff. RESOLUTION NO. 2025-045 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, CANVASSING THE ELECTION RESULTS OF THE NOVEMBER 4, 2025 SPECIAL ELECTION ON PROPOSED CHARTER AMENDMENTS; DECLARING AMENDMENTS ADOPTED; AND PROVIDING EFFECTIVE DATE. WHEREAS, the North Richland Hills City Charter was adopted on November 3, 1964, creating a home rule charter and the City Council/City Manager form of government for the City of North Richland Hills ("City"); and WHEREAS, Article XVIII, Section 21 of the Charter states that the Charter may be amended no more than once every two years; and WHEREAS, the City Charter was previously amended by election in 1969, 19747 19817 19877 19927 2001, with the last amendment being in 2023; and WHEREAS, on January 27, 2025, the City Council adopted Resolution No. 2025-008 appointing the City Council to serve as the Charter Review Commission to review the City Charter and make recommendations for amendments; and WHEREAS, the City Council, at its July 28, 2025, meeting, adopted Ordinance No. 3915, ordering a Special Election on November 4, 2025, for the purpose of submitting to the qualified voters, for adoption or rejection, proposed Charter amendments, and repealing Ordinance No. 3914; and WHEREAS, an election was duly held on November 4, 2025, to allow duly qualified voters to vote on six (6) propositions; and WHEREAS, the City Council finds that all procedural and substantive requirements were met for the holding of said election and that it was held pursuant to and in accordance with the laws of the State of Texas; and WHEREAS, the City Council has met to canvass the votes cast in such election and accept the tabulations provided by Tarrant County Elections Administrator (Exhibit A). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, THAT: Section 1: The City Council hereby finds that the recitals set forth above are true and correct and are incorporated into this Resolution as if written herein. Section 2: The City Council declares and orders that the following numbered propositions are hereby declared to have PASSED by a majority of the qualified voters of the City of North Richland Hills. Section 3: The City Secretary/Chief Governance Officer is ordered to cause the Charter to be changed and reprinted to reflect the changes brought about by the propositions which passed in the election of November 4, 2025. Resolution No. 2025-045 Page 2 of 4 Section 4: The City Secretary/Chief Governance Officer is ordered to certify an authenticated copy of the amendments to the secretary of state as required by Chapter 9 of the Texas Local Government Code. Section 5: This Resolution shall take effect and be in full force and effect from and after the date of its adoption, and it is so resolved; and all Resolutions of the City Council of the City in conflict herewith are hereby amended or repealed to the extent of such conflict.
