PRESENTER: Clayton Husband, Principal Planner SUMMARY: On behalf of Blanchedim LLC, Blanche Dimuangala is requesting a special use permit for an event center in a lease space on a 12.98-acre property located at 7620 NE Loop 820. GENERAL DESCRIPTION: The property is in the North Hills Village shopping center, located at the southwest corner of Boulevard 26 and NE Loop 820. The site is developed with multitenant shopping center. The applicant proposes to renovate and occupy a lease space in the southeast portion of the property for an event center. The space is adjacent to the Home Zone Furniture store. The applicant proposes to open a 4,700-square foot event center that would provide a venue for weddings, parties, corporate and office events, and similar types of gatherings. The facility would include space for event seating and an area for catering services. The operation of the facility does not include food preparation or cooking. Information about the business and conceptual floor plans of the space are attached. The special use permit is for the use, not the specific company requesting the use. The property is zoned C-2 (Commercial). An event center is not a specifically listed land use but is similar in nature to a private club in terms of operational characteristics, traffic generation, service demands, occupancy loads, and similar characteristics. Since a private club requires approval of a special use permit (SUP) in this zoning district, the application is being processed in a similar manner to provide an opportunity to review the suitability of the use at this location. Past requests for this type of use have been processed in the same manner. The proposed conditions of approval for this special use permit are attached. Applications for special use permits provide an opportunity to address modifications to specific site development and building design standards for the site. These conditions are based on the applicant's proposed development of the property. These conditions may be modified throughout the public hearing process, but they are subject to final approval by City Council. NORTH I* I HLAND HILLS As part of special use permit requests, the Planning and Zoning Commission and City Council may require certain property improvements as a condition of SUP approval. These improvements are intended to address nonconforming features of properties and provide suggested enhancements that would help bring the property closer to compliance with current development standards. The following is a list of nonconforming features identified on the property. 1. Building and site lighting. Any nonconforming wall pack and flood light fixtures on the building could be replaced with conforming fixtures. The fixtures should comply with the standards contained in Section 118-728 of the zoning ordinance. 2. Refuse container enclosures. Enclosures could be constructed or renovated for all refuse containers on the lot. The enclosures should comply with the standards contained in Section 118-874 of the zoning ordinance. These standards generally include a masonry enclosure, pedestrian access gates, and opaque metal gates. 3. Parking lot landscaping. The landscaping regulations require one large tree be planted per 20 parking spaces in a landscaped island. Landscape islands could be constructed in the parking lot area. VISION2030 COMPREHENSIVE PLAN: This area is designated on the Land Use Plan as Retail Commercial. The Retail Commercial land use category provides sites for community and regional shopping centers, commercial establishments, and employment centers. These sites are typically located on highways and major thoroughfares at key intersections. CURRENT ZONING: The property is zoned C-2 (Commercial). This district is intended to provide for the development of retail and general business uses primarily to serve the community and region. Uses include a wide variety of business activities and may involve limited outdoor storage, service, or display. The C-2 district should be located away from low and medium density residential development and should be used as a buffer between retail and industrial uses. The following regulations shall be specific to this special use permit. Where these regulations conflict with or overlap another ordinance, easement, covenant, or deed restriction, the more stringent restriction shall prevail. A. Permitted land uses. A special use permit is authorized for an event center on the property. B. Site development standards. Development of the property shall comply with the development standards of the C-2 (Commercial) zoning district and the standards described below. 1. The site improvements must be constructed as shown on the site plan attached as Exhibit "C" and as follows: C. Operational standards. The operation of the event center must comply with the standards described below. 1. The size of the event center must not exceed five thousand (5,000) square feet in floor area. 2. Outdoor events are prohibited. All activities must take place within the building. D. Expiration. The special use permit will expire three (3) years from the effective date of this ordinance. If the event center is still in operation at the time of expiration, the business shall be considered a legal non-conforming use and may continue operation subject to the standards described in Section 118-153 of the zoning ordinance. E. Amendments to Approved Special Use Permits. An amendment or revision to the special use permit will be processed in the same manner as the original approval. The application for an amendment or revision must include all land described in the original ordinance that approved the special use permit. F. Administrative Approval of Site Plans. The development is subject to final approval of a site plan package. Site plans that comply with all development-related ordinances, and this Ordinance may be administratively approved by the Development Review Committee. The city manager or designee may approve minor amendments or revisions to the standards provided the amendment or revisions does not significantly: 1. Alter the basic relationship of the proposed uses to adjacent uses; 2. Change the uses approved; 3. Increase approved densities, height, site coverage, or floor areas; 4. PRESENTER: Cori Reaume, Director of Planning GENERAL DESCRIPTION: In an effort to continue refining the City's Code of Ordinances in the spirit of clarity and efficiency, this ordinance update is being proposed by staff for consideration. The definition for rear yard open space from the city's zoning ordinance is listed below: r...Y 2L!22 2p.2 means an area reserved as an open space in the rear portion of a yard which extends from one side property line to another side property line and abutting the rear property line. The rear yard open space shall not protrude beyond the two most extreme corners of the main structure and no part of a residential dwelling unit may be constructed so as to occupy any portion of the rear yard open space. The requirements for rear yard open space are outlined within the various zoning districts' "Lot and Area Requirements," along with building setbacks, minimum lot size, etc. Section 118-718 (Accessory Buildings and Structures) includes references indicating that accessory structures, including sheds, carports, etc., would have no impact on the calculation of rear-yard open space. It would seem that the rear yard open space requirement was introduced to ensure that when a lot is developed, a portion (typically around 20%) would remain open and not be covered by the primary structure (home). However, this regulation doesn't restrict how homeowners use their backyards. Since accessory structures like sheds and carports are excluded from the requirement, it appears the intent was to preserve open space during initial development, while still allowing residents to fully use their yards for outdoor amenities and personal enjoyment. After reviewing our comparison cities, it seems most utilize a maximum lot coverage (or impervious coverage) percentage rather than the rear yard open space calculation. Additionally, many communities provide for a maximum percentage of front yards which may be paved. In conjunction with a recommendation on allowing for certain garage enclosures, staff would like to present some findings and lead a discussion about possible changes to these regulations. NORTH RI HLAND HILLS Staff will propose for discussion a few options to address challenges identified from the existing code requirements, including: • Replacement of rear-yard open space requirement with a maximum lot coverage requirement throughout typical residential districts o Max. lot coverage could vary by lot size and/or zoning district o Separate front-yard paving requirements could apply o Definition to be clarified — structures or any impermeable surface • Modification of rear-yard open space definition & references to include a broader "usable open space" o This could require a minimum contiguous area of a specified square footage and/or could clarify that a significant percentage (50% or more) of the usable open space be located in a rear yard • Modification of rear-yard open space requirement to include clarification that RYOS applies only to new construction or "major renovation," thereby eliminating challenges with minor renovations. Of the aforementioned approaches, we may be able to consider some hybrid approach that allows the city to stay flexible, while still honoring the tradition of mandating a significant continuous open area in the "backyard." Due to the complexity of the various options being presented, staff will recommend continuation of the public hearing to a later date where a final draft may be presented based on Commission feedback. RECOMMENDATION: Continue public hearing to the next regularly scheduled Commission meeting on January 15, 2026 at 7.00 p.m.
