AN ORDINANCE DEFINING CERTAIN TERMS; ADOPTING THE NATIONAL
ELECTRIC CODE; ADOPTING THE RULES AND REGULATIONS OF TEXAS
ELECTRIC SERVICE COMPANY; PROVIDING CERTAIN STANDARDS OF
ELECTRICAL INSTALLATION; PROVIDING FOR THE CREATION AND
DUTIES OF AN ELECTRICAL BOARD; PROVIDING FOR REGISTRATION
OF ELECTRICIANS; PROVIDING FOR THE ISSUANCE OF WORK PERMITS;
PROVIDING A PENALTY FOR VIOLATIONS AND REPEALING ALL ORDI-
NANCES AND PARTS OF ORDINANCES IN CONFLICT HERETO; PROVID-
ING A SAVING CLAUSE; AND PROVIDING THAT THIS ORDINANCE SHALL
BE IN FORCE AND EFFECT FROM AND AFTER THE DATE OF ITS ADOPT-
ION AND PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS,
TEXAS that:
DIVISION 1. GENERALLY
SECTION 1. SHORT TITLE.
The title of this ordinance shall be "The North Richland Hills Electrical
Code", and it may be cited as such.
SECTION 2. DEFINITIONS.
Generally. For the purposes of this ordinance, certain terms, phrases,
words and their derivatives shall be construed as set out in this section.
Words used in the singular include the plural and the plural includes the
singular. Words used in the masculine gender include the feminine, and the
feminine includes the masculine. Words used in any regulation or standard
of the National Board of Fire Underwriters used as a standard of good
practice shall, if defined therein, have the meanings assigned them. Words
relating to building and building use, when not otherwise separately de-
fined, shall have meanings which conform to the meanings set out in the
building code and zoning ordinance of the city, otherwise, they shall have
their usual meanin~.
Approved shall mean approved by the office of the chief electrical in-
spector or the National Board of Fire Underwriters or any equivalent or
similar organization whose approval is signified by a UL label or its
equivalent.

Authorized person shall mean any individual, firm or corporation who or
which is licensed under the provisions of this ordinance to do the work
as permitted under the specific provisions of this ordinance.
City shall mean the territory within the corporate limits of the City of
North Richland Hills or the legally constituted governing body thereof,
its agents and its officers.
Conductor shall mean a wire or cable or other form of metal suitable for
carrying electric current or potential.
Electrical contractor shall mean any person engaged in the business of
installing or altering, by contract, electrical conductors or equipment.
Such term shall include any authorized person, whether actually doing
electrical work or not, and any authorized person who sub-contracts to
do such work, but it shall not include bona fide employees employed by
such contractor to do or supervise such work.
Electrical sign contractor shall mean any person, firm or corporation
engaged in the business of fabrication, manufacture, erection or repair
of incandescent signs, gaseous tubing, outline lighting, or border
lighting which are operated, illuminated or controlled by electrical
energy. Such term shall include any authorized person whether actually
doing electrical sign work or not, and any authorized person who sub-
contracts to do such work, but it shall not include bona fide employees
employed by such contractor to do or supervise such work.
Electrician shall mean a person who is engaged in the trade of business
of electrical construction and who is qualified under the terms and pro-
visions of this ordinance. Persons while engaged in the manufacture,
fabrication or assembly of products, equipment, or devices wherein
electrical wiring, apparatus, other devices or equipment is installed,
incorporated or otherwise attached or used are specifically exempt from this
ordinance.
Electrical construction shall mean and include all work and materials used
in installing, maintaining, or extending a system of electircal wiring and
all appurtenances, apparatus or equipment used in connection therewith,
inside of or attached to any building, structure, lot or premises. Conductors
placed under at least two inches of concrete beneath a building, or
conductors within a building in conduit or duct and enclosed by concrete or
brick not less than two inches thick shall be considered outside the building.

Equipment shall mean conductors, material, fittings, devices, appliances,
fixtures, apparatus, motors, and the like, used as a part of or in con-
nection with, an electrical installation.
Inspector shall mean any individual who has been deputized by the city
as an electrical inspector.
Journeyman electrician shall mean any individual who possesses the nec-
essary qualifications, training and technical knowledge to install,
maintain and extend electrical conductors and equipment and capable of
doing such work in accordance with standard rules and regulation govern-
ing such work.
Master electrician shall mean any individual who possesses the necessary
qualifications, training and technical knowledge to plan, layout and
supervise the installation, maintenance and extension of electrical con-
ductors and equipment.
Person shall mean a natural person, his heirs, executors, administrators
or assigns, and also includes a firm, partnership, or corporation, its
or their successors or assigns, or the agent of any of the aforesaid.
Registered, when used with the words "electrical contractor", "electrician"
or the like, shall mean that the person has made application to the elec-
trical board and has satisfied the board that he is qualified to do the
work'sta~ed in the application, and that he has paid the necessary re-
gistration fees to date, and that his name is carried in the records of
the chief electrical inspector as a person authorized to do electrical
work as defined in this ordinance.

Special permission shall mean the written consent of the office of the
chief electrical inspector.
Special ruling shall mean a written ruling filed in the office of the
chief electrical inspector.
SECTION 3. PURPOSE OF ORDINANCE.
The purpose of this ordinance is the practical safeguarding of persons
and of buildings .and their contents from electrical hazards arising
from the use of electricity for light, heat, power, radio, signaling
and for other purposes.

SECTION 4. APPLICAT~ON OF ORDINANCE.
(a) Generally. The prOV1S10ns of this ordinance shall apply to all
installations of the work done on electrical conductors, fittings,
devices, motors, appliances, fixtures, signs and gaseous tubing, here-
in after referred to as "electrical equipment", within or on public
and private buildings and premises, except as otherwise provided in this
section.
(b) Public utilities. The prov1s10ns of this ordinance shall not apply
to installations used by electricity supply, or communication agencies
in the generation, transmission or distribution of electricity or for
signals or the transmission of intelligence when located within or on
buildings or premises used exclusively by such an agency or on public
thoroughfares; provided, however that such agencies excepted are op-
erating under a franchise agreement within the city.
(c) Federal buildings. This ordinance shall be construed to be applic-
able to any building which is owned and operated by the United States
government.
(d) City departments and buildings. The various departments and build-
ings of the city shall be subject to the provisions of this ordinance
insofar as the same may be applicable, but shall be exempt from the re-
quirement of fees, and providing the city may use qualified personel with-
in the employment of the city to perform service and, or installations
within or on public buildings or premises.
(e) Electric signs, gaseous tubing, etc. This ordinance shall apply to
all forms of electrical signs, gaseous tubings and outline lighting
conductors and equipment.
SECTION 5. GENERAL STANDARDS FOR INSTALLATIONS AND EQUIPMENT; NATIONAL
ELECTRICAL CODE ADOPTED.
All electrical equipment installed or used in the city and all install-
ations of electrical equipment shall be reasonable safe to persons and
property and in conformity with the standards provided in the 1968
edition of the National Electrical Code of the National Fire Protection
Association, and with the provisions of this ordinance and applicable
state statutes and any rules and regulations issued by authority there-
of and its amendments thereto. A copy of the National Electrical Code
referred to herein is on file in the office of the City Secretary for
reference and inspection and the same is hereby adopted and made a part
of this ordinance to the same extent as if set out herein in full.

qonformity of electrical equipment with the applicable standards of the
Underwirters Laboratories, Inc., shall be prima facie evidence that such
equipment is reasonably safe to persons and property. Conformity of
electrical installations with the applicable standards set forth in the 1968
Edition of the National Electrical Code shall be prima facie evidence that
such installations are reasonably safe to persons and property.
On all installations of electrical conductors or equipment hereafter made
and all existing installations which are altered, all work shall be done
in a manner that will conform with the requirements for sufficient and a
safe electrical system. Repair and maintenance work shall be such that,
if any electrical conductors or equipment are removed and later replaced,
they shall be replaced in a manner which conforms with this ordinance.
Installation or work done in conformance with the National Electrical
Code referred to above, be considered as fully complying with this
ordinance. With the exception that the minimum service allowed in both
new and altered systems be as follows: one hundred (100) amperes to and
including twelve hundred (1200) square feet of floor space. One hundred
and fifty (150) amperes - twelve hundred and one (1201) to two thousand
(2,000) square feet of floor space. If above two thousand (2,000) square
feet - two hundred (200) amperes minimum.
Aluminum conductors shall have connectors of proper size and approved for
such connection. All aluminum connectors, lugs and splice connections
shall be treated with approved inhibitor for minimum wire size of No.8.
All conductors of all wire sizes shall be treated with approved inhibitors
that are connected to breakers, lugs and other approved terminals in service
panel~ meter sockets, gutters or junction boxes. All conductors shall be
wire brushed or scraped to remove oxide film immediately before inserting
into connectors.
SECTION 6. AOOPTION OF RUlES AND R.EX}ULATIONS OF MUNICIPAL UTIUTIES
AND TEXAS ELECTRIC SERVICE COMPANY
Rules and regulations of the Texas Electric Service Company relating to
service and meter installations for the kind and character of service to
be rendered, as passed and approved by the City Council from time to time,
are incorporated herein and made part of this ordinance. The Texas Electric
Service Company shall be required to furnish written notice of any changes
in rules and regulations or additions thereto to each registered electrical
contractor and to the City.
SECTION 7. SUPERVISION OF WORK
In the actual work of installing, maintaining, altering, or repairing any
electric conductors or equipment for which a permit is required by this
ordinance, there shall be present and in direct supervision a qualified
electrician of the proper classification. Should it come to the notice
of the chief electrical inspector or his inspectors, that such supervision
and control are not being maintained, the inspector may order the work to
be discontinued and the person to whom the permit has been issued shall
discontinue further work until proper supervision has been employed or
supplied. Nothing herein shall be construed' as prohibiting the employment
of apprentices or unskilled laborers assisting a person duly registered and
qualified under the provisions of this ordinance.

SECTION 8. WHO PERMITTED TO MAKE CONNECTIONS BETWEEN SERVICE AND
SERVICE ENTRANCE CONOOCTORS.
Only authorized employees of the Electric Supply Agency shall be permitted
to make the connection between the Electric Supply Agency's service
conductors and the customer's service entrance conductors.
SECTION 9. WHO PERMITTED TO CONNECT OR DISCONNECT METERS.
When new electrical meters are installed or existing electrical meters
are to be relocated, the disconnection, connection, or reconnection to
the meter shall be made only by authorized employees of the Electric
Supply Agency supplying the service.
SECTION 10. UNAUTHORIZED CHANGE OR ALTERATION OF CONDUCTORS OR
EQUIPMENT.
It shall be unlawful for any unauthorized person to, in any manner, change
or alter electrical conductors or equipment in or on any building. If, in
the course of the erection of a building, or structure, electrical
conductors or equipment are in such position as to interfere with the
erection or completion of the structure, notice shall be immediately given
the authorized person or firm installing the electrical conductors or
equipment, and the needed change shall be made by such authorized person
or firm.
SECTION 11. INSTALLATIONS TO CONFORM TO APPROVED SPECIFICATIONS.
The installation of electrical equipment, within or attached to buildings
or structures, shall be done in accordance with specifications previously
submitted to and approved by the chief electrical inspector. Complete
descriptions of proposed work may be required by the chief electrical
inspector. When drawings are requested, they shall be to a definite scale,
showing the point at which service connection is required, the size of the
service and subfeeders, the location of service switches and center of
distribution, the arrangement of circuits and the mnnber of outlets
connected thereto.
SECTION 12. INSTALLA TIONS IN COMMERCIAL AND INDUSTRIAL BUILDINGS,
PUBLIC MEETING PLACES, AND MULTI FAMILY IMELLINGS.
(a) All electrical installations in commercial building, public meeting
places, and industrial buildings shall be accomplished in approved metal
raceways as provided in the National Electric Code. In no instance shall
Thin Wall or EMT Conduit be installed in concrete walls or slabs. Romex
may be used only where concealed in conjunction with wood framing and
where such type of construction is permitted as follows: Romex may be

used in Single Family and Multi Family dwellings not to exceed two (2)
stories in height, provided however, that copper conductors are used
in all sizes smaller than one (1) in Multi Family installations. And
provided that all main feeders be placed in approved metal raceways,
and further provided that all conductors passing through concrete and/or
floors be in approved sleeves.
(b) In interpreting this section, the following definitions will be
applicable:
(1)
Commercial buildings shall mean a place where commodities,
goods, wares or merchandise is bought or sold.
(2)
Industrial building shall mean a place where labor is employed
to conduct a business such as, but not confined to, manufac-
turing, processing, developing, storing or repairing goods,
wares and merchandise.
(3)
Public meeting place shall mean a room or space used for
assembly or educational occupancy for fifty (50) or more
occupants or which has a floor space of seven hundred and
fifty (750) square feet or more used for such purposes.
Single Family Dwelling shall mean a dwelling housing one (1)
family.
(4)

Multi Family Dwelling shall mean a dwelling housing more
than one (1) family.
SECTION 13. ANCHORAGE FOR SERVICE DROPS.
The point of attachment of service drop conductors to a structure shall
be installed in such a manner that the minimum clearances from ground will
be maintained in accordance with Article 230-24 (b) of the NEe; it shall
be of sufficient strength to support the service drop conductors, equivalent
to a 5/£311 X 26" steel, galvanized eye bolt with 24" thread. Joslyn #9626,
or equivalent; or, if an additional structure is needed to supply the
necessary height, shall be comparable to Porcelain Products, Inc. #2075
Mast Kits or Crouse-Hinds Service Entrance Mast Kit #FMK 600 or equal,
consisting of service entrance, cap roof mounting plate, roof flashing
and storm cellar, conduit hangers with log screws and reducers. All service
heads must not exceed twelve (12) inches from point of attachment.
SECTION 14. OVERCU~T DEVICES AND PANELS.
Over current devices and panels shall not be installed within a clothes

91oset, storage closet cabinet, toilet, bathroom, near easily ignitable
material, or immediately over any fixture, or appliance. Panels must be
readily accessible and be provided with maì~ line disconnect~.
SECTION 15. SALE OF UNAPPROVED EQUIPMENT, MATERIAL, CONDUCTORS, ETC.,
PROHIBITED.
It shall be unlawful for any person to sell, expose for sale, offer to
sell, dispose as a premium, or offer for rent and to repair any electrical
material, conductors, equipment, apparatus, or appliance within the city
for use in the city which is not approved by the chief electrical inspector
or which does not have affixed thereto a UL label or which have not pre-
viously been approved by the Underwriters Laboratories or some similar or
equivalent organization.
SECTION 16. POSTING AND SERVICE OF NOTICES AND ORDERS UNDER ORDINANCE.
When any order or notice is issued pursuant to the provisions of this
ordinance to any person who cannot be found after a reasonable search,
such order or notice may be served by posting it in a conspicious place
upon the premises occupied by him or upon the premises where the defects
are alleged to exist. Such posting of the notice shall be considered
equivalent to personal service of such order or notice. An order sent by
mail in a sealed envelope with postage prepaid and directed to the address
of the electrical contractor, owner, lessee or occupant of the premises
shall be equivalent to personal service of such order.
Electrical inspectors are hereby empowered to attach to the nearest
electrical cabinet or equipment feeding defective or hazardous wiring
any official notice or seal to prevent use of electricity in that area,
and it shall be unlawful for any other person to place or attach such
seal, or to break, change, destroy, tear, mutilate, cover or otherwise
deface or injure any such official notice or seal posted by an electrical
inspector.
SECTION 17. ORDINANCE DOES NOT AFFECT LIABILITY FOR DAMAGES.
This ordinance shall not be construed to relieve from or lessen the
responsibility or liability of any party owning, operating, controlling
or installing any electrical equipment for damages to persons or property
caused by any defect therein, nor shall the city be held as assuming any
such liability, by reason of the inspection or reinspection authorized
herein or the certificate of approval issued as herein provided, or by
reason of the approval or disapproval of any equipment authorized herein.

SECTION 18. ELECTRIC FENCES.
It shall be unlawful for any person to install or operate an electric
fence within the corporate limits of the city of North Richland Hills,
be it of the battery or transformer type.
DIVISION 2. ELECTRICAL INSPECTORS
SECTION 19. CHIEF INSPECTOR GENERALLY-OFFICE CREATED; QUALIFICATIONS.
There is hereby created the office of chief electrical inspector. The
person chosen to fill the office of chief electrical inspector shall be
of good moral character, shall be possessed of such executive ability
as is required for the performance of his duties and shall have a thorough
knowledge of the standard materials and methods used in the installation
of electrical conductors and equipment. He shall be well versed in ap-
proved methods of construction for safety to persons and property, and
in the provisions of the National Electrical Code referred to herein.
SECTION 20. SAME-APPOINTMENT; SUPERVISION.
The chief electrical inspector shall be appointed by the City Manager
and he shall serve under the supervision and direction of the City Man-
ager. The Chief Electrical Inspector shall take and subscribe an oath.
He shall be removed from office for good cause only. The compensation
paid the Chief Electrical Inspector shall be determined by the City Man-
ager.
SECTION 21. SAME-GENERAL DUTIES.
It shall be the duty of the chief electrical inspector to enforce the
provisions of this ordinance. He shall, upon application, grant permits
for the installation, extension, or alteration of electrical conductors
and equipment, and shall make inspections of all electrical work, as
provided for in this ordinance. He shall keep complete records of all
permits issued, inspections and reinspect ions made and other official
work performed in accordance with the provisions of this ordinance.
SECTION 22. SA~1E--EMPLOYMENT OF INSPECTORS.
The chief electrical inspector is empowered to employ, after recelvlng
the approval of the City Manager, any inspectors and/or clerical personel
necessary for the proper conduct of his office and the inspection of
electrical installations as provided for in this ordinance. The chief
electrical inspector may delegate any of his powers or duties to any of
assistant inspectors, who shall be designated as electrical inspectors,

~ncluding the power of arrest, or cause of arrest, of any person vio-
lating any of the provisions of this ordinance.
SECTION 23. SAME-SPECIAL RULINGS.
If a special ruling by the chief electrical inspector is necessary to
govern electrical construction for some particular occupancy or building
not covered by this ordinance or by the National Electrical OOde, where-
by all wiring for similar types of occupancy or building will be changed
in the future, a copy of such ruling shall be filed in the office of the
chief electrical inspector.
SECTION 24. SAME-APPROVAL OF EQUIPMENT, MATERIAL, CONDUCTORS, ETC.
The chief electrical inspector shall approve for sale at retail such
electrical equipment, material, conductors, apparatus or appliances as
are reasonable safe to persons and property. Conformity of such equip-
ment and material with the standards of the Underwriters Laboratories,
Inc., shall be prima facie evidence that such equipment is reasonably
safe to persons and property.
Should any material or equipment be submitted for approval which is not
listed as approved by the Underwriters Laboratories, Inc., the chief
electrical inspector shall, within ten (10) days of the receipt of written
request for special approval, approve, provisionally approve or disapprove
such electrical material or equipment. Approval shall be based on reason-
able safety to persons or property and material and equipment shall be
considered as adequate for approval if the standards of the Underwriters
Laboratories, Inc. are met. When material or equipment is approved by
the chief electrical inspector, such approval shall continue until the
material or workmanship on the article approved is changed. When the
material or workmanship is changed, the article shall be reexamined for
approval.
When no applicable standard can be used to determine whether an article
is reasonably safe, the chief electrical inspector may grant provisional
approval and allow its sale until such time as it can be determined
whether the article is safe to persons or property.
When an article is disapproved by the chief electrical inspector, the
decision may be appealed for review by the electrical board as provided
in this ordinance.
The chief electrical inspector shall keep in his office a complete list
of electrical equipment, material appliances and devices approved, pro-
visionally approved or disapproved for sale within the city. This list
shall be available to the public during regular working hours.

~ECTION 25. SAME--AUTHORITY TO STOP WORK.
In case any work is begun where a permit is required by this ordinance,
but without permission being first secured therefore, or if electrical
installations are otherwise being made in violation of this ordinance,
the chief electrical inspector shall have the power to stop such work
at once and to order any and all persons engaged therein to stop and
desist therefrom until the proper permission is secured. Such action
shall not defer any other penalties which may be applicable under this
ordinance.
SECTION 26. SAME--MODIFICATION OR WAIVER OF REGULATIONS.
The electrical regulations of this ordinance may be modified or waived
by special permission in particular cases where such modification or
waiver is reasonable, does not differ from the intent of this ordinance
and does not create an injustice. Such permission shall in all cases be
obtained from the chief electrical inspector in writing prior to start-
ing the work and a copy of the permission shall be filed in the office
of the chief electrical inspector.
SECTION 21. PROHIBITED INTERESTS.
It shall be unlawful for the chief electrical inspector or any of his
inspectors to engage in the business of selling, installing or mainten-
ance of electrical conduetors, devices, appliances, apparatus or equip-
ment, and they shall have no financial interest in any concern engaged
in such business in the city of North Richland Hills, Texas, at any
time while holding such office as herein provided for.
SECTION 28. LIABLILITY FOR DAMAGES.
~~ere action is taken by the chief electrical inspector or his inspectors
to enforce the provisions of this ordinance; such acts shall be done in
the name of, and on behalf of the city, and the inspectors, in so acting
for the city, shall not render themselves personally liable for any dam-
age which may accrue to persons or property as a result of any act com-
mitted in good faith in the discharge of their duties, and any suit
brought against any inspector by reason therof shall be defended by the
City Attorney until final termination of the preceedings contained there-
in.
SECTION 29. POLICE POWERS.
The chief electrical inspector and his inspectors shall have full police
,power and shall have the right to arrest any person who violates any of

the regulations of this ordinance. Whenever, in the opinion of an
electrical inspector, it shall be necessary to call upon the police de-
partment for aid and assistance in making an arrest or stopping work,
he shall have the authority to do so, and it shall be the duty of any
member of the Police Department, when called upon by such inspector, to
act immediately in giving the required assistance.
SECTION 30. RIGHT OF ENTRY.
The chief electrical inspector and his inspectors shall have the right,
during reasonable hours, to enter any building or premises within the
corporate limits of North Richland Hills in the discharge of their official
duties, or for the purpose of making any inspection, reinspection or test
of the electrical equipment or installation contained therein.
SECTION 31. INSPECTIONS GENERALLY.
Upon the completion of any electrical installation for which a permit
has been obtained under this ordinance, it shall be the duty of the person
making the installation to notify the electrical inspector, who shall in-
spect the installation within forty-eight (48) hours, exclusive of Satur-
days, Sundays, and holidays, of the time such notice is given.
When any electrical equipment is to be hidden from view by the permanent
placement of parts of the building, the person installing the equipment
shall notify the electrical inspector and such equipment shall not be
concealed until it has been inspected, approved or authorized by the
electrical inspector. On large installations, where the concealment"of
equipment proceeds continuously, the person installing the electrical
equipment shall give the electrical inspector due notice and inspections
shall be made periodically during the progress of work.
The electrical inspector shall have the authority to require building
contractors to open work which in any manner conceals electrical wiring
that has been closed without his knowledge or permission, and in no case
shall the inspector issue clearance until satisfied that the work is in
accordance with the provisions of this ordinance. Inspectors shall also
have the right to refuse to issue a clearance on any wiring that is con-
cealed in such a manner that it cannot be fully determined that it has
been done in accordance with this ordinance.
If, upon inspection under this section, the installation is not found to
be fully in conformity with the provisions of this ordinance, the elect-
rical inspector shall immediately notify the person making the install-
ation of the existing defects.

SECTION 32. CERIFICATES OF APPROVAL.
(a) When the electrical inspector finds the installation to be Qo..n:(qItIning
with the provisions of this ordinance, he shall issue to the person,
making the installation a certificate of approval, authorizing the use
of the installation and connection to the supply of electricity. The
inspector shall so notify the electric service.
(b) When a certificate of approval is issued authorizing the connection
and use of a temporary installation, such certificate shall expire at a
time to be stated therein and shall be revocable for cause by the chief
electrical inspector.
(c) Permission may be given authorizing the connection and use of certain
specified portions of an incompleted installation. Such permission shall
be revocable at the discretion of the chief electrical inspector.
(d) In no case shall certificates of approval be issued on installations
or parts of installations where the work installed does not conform to
the to the requirements of this ordinance. No certificate of approval
shall be issued unless the electric conductors or equipment has been in-
stalled in strict conformity with the provisions of this ordinance and
the statutes of the state, and unless the installation is made in com-
pliance with nationally approved methods of construction for safety to
life and property.
(e) The chief electrical inspector shall be deemed the judge of whether
the installation of electric conductors and equipment has been made in
accordance with the requirements of this ordinance.
(f) It shall be unlawful for any person, to make connection to a supply
of electricity or to supply electricity to any electrical equipment for
which a permit is required by this ordinance, or which has been dis-
connected by the order of the chief electrical inspector, until a certif-
icate of approval has been issued by the electrical inspector authorizing
the connection and use of such equipment; provided, however, that the
electrical inspector may authorize a temporary connection:
SECTION 33. PERIODIC REINSPECTIONS.
The electrical inspector shall periodically reinspect existing install-
ations of electrical conductors and equipment.
When the installation of any conductors or equipment is found to be in
a dangerous or unsafe condition, the person, owning, using or operating
the installation shall be notified in writing and shall make the necessary
repairs or changes required to place such conductors or equipment in safe
condition and have such work completed within the period specified by the
chief electrical inspector.

SECTION 34. REINSPECTIONS.
It shall be unlawful for any person or firm to occupy any building
involving a change of billing, ownership, use, or occupancy with the
service either on, or off, without first contacting the office of the
chief electrical inspector, paying the fee, and requesting a reinspection
of such location. Upon approval the inspector shall so notify the electric
service company, and only after such notification can permanent service be
supplied this location.
SECTION 35. AUTHORITY TO ORDER REPAIR OF OR DISCONNECTION OF SERVICE
TO DANGEROUS ~UIPMENT.
When any electrical equipment is found by the electrical inspector to be
dangerous to persons or property because it is defective or improperly
installed, the person responsible for the equipment shall be notified as
required in Section 16 of this ordinance and shall make any changes or
repairs required, in the judgment of the electrical inspector, to place
such equipment in safe condition. If such work is not completed within
fifteen (15) days or any longer period specified by the electrical
inspector in such notice, the inspector shall have the authority to dis-
connect or order the discontinuance of electric service to the electrical
equipment. In cases of emergency, when necessary for safety to persons
or property, or when electrical equipment may interfere with the work of
the Fire Department, the electrical inspector shall have the authority
to immediately disconnect or cause the disconnection of any electrical
equipment.
DIVISION :3. ELECTRICAL BOARD GENERALLY.
SECTION 36. CREATED; COMPOSITION.
There is hereby created an Electrical Board which shall consist of the
Chief Electrical Inspector, an appointee of the City of North Richland
Hills, Texas, other than the Chief Electrical Inspector, who is a
registered engineer in the State of Texas, and three (3) other members
appointed by the City Council as follows: Two (2) electrical contractors
who are engaged in the business of installation of electrical equipment
within the corporate City Limits and who are licensed ~ electricians.
One (1) licensed journeyman electrician, or master electrician, who is
licensed by the City of North Richland Hills, but who is not engaged in
the business of contracting nor employed by an electrical contractor
serving on the Electrical Board.
SECTION 37. TERMS OF REMOVAL OF MEMBERS.
The members of the Electrical Board shall hold office from the date of
their appointment and qualification until they are replaced by the Council
or until they should resign.

pECTION 38. ~mERS TO SERVE WITHOUT COMPENSATION.
The members of the electrical board shall serve without compensation.
SECTION 39. CHAIRMAN AND SECRETARY; PROCEDURE AND ORDER OF BUSINESS.
(a) The Chief Electrical Inspector shall act as secretary to the board.
(b) The electrical board shall select a chairman and shall prescribe a
procedure and order of business for hearing applications by persons desiring
to engage in the electrical business with the city, for hearing appeals from
the decisions of the chief electrical inspector, and for formulating recom-
mendations to the Council pertinent to this ordinance as they may request,
or as the need may arise.
SECTION 40. QUORUM.
Three (3) members of the Board present at any meeting shall constitute a
quorum for the transaction of any business or the carrying out of any duties.
but any action taken at any meeting shall require the affirmative vote of at
least three (3) members. The Chairman of any meeting of the board shall vote.
The Chief Electrical Inspector shall not vote when the board is reviewing a
decision made by him.
SECTION 41. APPEALS FROM DECISIONS OF CHIEF ELECTRICAL INSPECTOR AND BOARD.
Any person may file an appeal with the electrical board for a review of any
decision of the chief electrical inspector, provided that such appeal is
made in writing within five (5) days after such person shall have been noti-
fied of such decision by the electrical inspector. Upon request of such
appeal, the board shall proceed to determine whether the action of the chief
electrical inspector complies with this ordinance and within five (5) days
shall make a decision in accordance with its findings. Appeal from the de-
cisions of the Electrical Board must be directed to the proper court of re-
cords.
SECTION 42. RECORDS TO BE KEPI'.
The electrical board shall keep a minute book in which shall be recorded
all transactions and business of the board. The minute book and other
records shall be kept in a manner designated by the secretary of the
board.
DIVISION 4. REGISTRATION OF ELECTRICIANS.
SECTION 43. REQUIRED; EXCEPTIONS.
(a) It shall be unlawful for any person, who is not registered as a

qualified electrician in accordance with the prov~s~ons of this division
to engage in the business of electrical construction, or in the business
of any of the classifications prescribed herein, or to make any repairs,
alterations, additions, or changes to any existing system of electrical
conductors, wiring, apparatus, or equipment within the limits of the City
of North Hichland Hills, except as otherwise provided in this section.
(b) The following classes of work may be carried out by persons who are
not registered electricians:
(1) The replacement of lamps and fuses and the connection of
portable devices to suitable receptacles which have been
permanently installed.
(2) The installation, alteration or repa~r~ng of any w~rlng, de-
vices or equipment for the operation of signal or the trans-
mission of intelligence, where such wiring, devices, appliances
or equipment are operated at a voltage not exceeding twenty
four (24) volts, between conductors, and do not include gener-
ating or transforming equipment.
(3) The installation, alteration or repair of electric wiring,
devices, appliances, and equipment installed ~y or for an
electrical public service corporation operating under a
franchise from the city when for the use of such corporation
in the generation, transmission, distribution or metering of
the electrical energy or for the use of such a corporation
in the operation of street railways, signals or the trans-
mission of intelligences as specified in Section 4.
(4) Any work involved in the manufacture or test of electrical
materials, devices, appliances or apparatus, but not includ-
ing any installation wiring other than that required for
testing purposes, if such equipment as completed is approved
by the chief electrical inspector before it is installed or
used within the City.
(5) Any work involved in any factory in the manufacture, fabri-
cation or test of products, equipment or devices wherein
electrical wiring, apparatus, devices or equipment is in-
stalled fabricated, manufactured, incorporated or otherwise
attached.
SECTION 44. GRADES OF LICENSE.
(a) There shall be two (2) grades of licenses and one (1) grade of temp-
orary working permit as follows:
(1) A Master electrician's license, which shall entitle the holder
to contract for and engage in the business of electrical wiring
of any nature, and to employ and supervise journeyman electricians.

(2) A Journeyman electricians license, which shall entitle the
holder thereof to perform any type of electrical work under
the supervision of a Master electrician, or to perform any
type of sign work as outlined by the ordinances of the city
of North Richland Hills, under the supervision of a Master
sign electrician, but in no case shall a journeyman elec-
trician contract for or engage in the business of electrical
work of any nature, nor perform electrical work of any nature,
except under the supervision of either a Master electrician
or a Master Sign electrician.
(b) A temporary working permit which shall entitle an unlicensed elec-
trical worker with at least four (4) years of experience in the insta-
llation of electrical equipment to perform work in the capacity of a
journeyman electrician until the next regular examination date, at which
time such worker must appear before the Electrical Board and be examined
in the manner required herein for a journeyman electricians license. If
such worker fails to pass the journeyman electrician's examination, he
shall not be permitted to work in the capacity of a Journeyman electrician
until such later time as he is able to pass such examination. No tem-
porary working permits shall be renewed.
SECTION 45. RECIPROCAL AGREEMENT.
(a) Electricians holding a currently valid license or certificate of
registration in another city with whom the city of North Richland Hills
has a reciprocal licensing agreement may apply for and receive a similar
license or certificate of registration in the city of North Richland
Hills without taking an examination, provided the following conditions
are complied with:
(1) He shall submit evidence satisfactory to a majority of the
Electrical Board that his license or certificate of regis-
tration was issued under conditions not less restrictive than
required by the North Richland Hills Electrical Code for iss-
uance of a certificate of registration, and that an electrician
holding a certificate of registration issued by the city of
North Richland Hills would be permitted to apply for and re-
ceive a similar certificate of registration or license in such
city under reciprocal conditions.
(2) He shall pay the registration fee required and comply with
all other requirements of the North Hichland Hills Electrical
Code.
SECTION 46. LICENSING PROCEDURE AND REQUIREMENTS.
(a) An applicant for a license shall file a written application with the

Secretary of the Board at least thirty (30) days before the date set for
examinations, stating the grade of license for which he wishes to be ex-
amined, and submitting documentary proof satisfactory to the Board of his
qualifications to take such an examination, and shall pay to said Secretary
the fee hereinafter provided when said application is filed. An applicant
for a temporary working permit shall file a written application with the
Chief Electrical Inspector.
(b) Applicants for Master electricain license shall pay an examination
fee of ten dollars ($10.00), shall be of good moral character, and shall
have had at least four (4) years experience as a journeyman electrician
in the installation of electrical equipment, as defined by this ordinance;
or in lieu of such experience shall have graduated, after majoring in
electrical engineering, from an accredited college or university, and shall
have had at least one (1) year of practical electrical experience as de-
fined by this ordinance; or in lieu of either of the above requirements
shall have had either two (2) years college credit while majoring in elect-
rical engineering in an accredited college or university or be a graduate
of a recognized electrical trade school, and shall have had at least two
(2) years practical electrical experience. The Board shall be the sole
judge as to whether or not the trade school is recognized.
(c) Applicants for journeyman electrician license shall pay an examination
fee of five dollars ($5.00), shall be of good moral character, and shall
have had at least four (4) years experience in the installation of elect-
rical equipment, as defined by this ordinance. There shall be no examination
for temporary working permits, but any applicant for such a permit shall
have had experience equal to that required for an applicant for a journey-
man electricians license, and shall pay a fee of five dollars ($5.00).
(d) Any applicant who passes an examination for any grade of license and
fails to obtain the license of that grade by paying the fee as prescribed
herein within a period of two (2) years shall forfeit his right to ob-
tain such license until he again qualifies himself by passing another ex-
amination as required herein.
SECTION 47. TRANSFER, ALTERATION, ETC., OF CERTIFICATE OR LICENSE.
It shall be unlawful for any person to lend, rent, or transfer his certif-
icate of registration or any rights therein contained to any other person,
and for any person to make use of any such rights which are not actually
his own.
SECTION 48. CERTIFICATE TO BE DISPLAYED OR CARRIED ON PERSON.
Every holder of an electrician's certificate, or license, shall carry his
registration certificate, or license, on his person at all times while do-
ing electrical work and shall produoe and exhibit it when requested by
'any inspector or officer of the city.

?ECTION 49. SUSPENSION OF CERTIFICATE OR LICENSE.
(a) The Electrical Board of the city of North Hichland Hills, upon
recommendation by the Chief Electrical Inspector, may suspend any license
issued or renewed under the terms of this ordinance for any violation of
the terms of this ordinance by the holder of such license or any period
up to six (6) months, and during the time of such suspension such license
shall be and become null and void. After the termination of such period
of suspension, such license shall again be valid and effective, provided
that renewal fees which have become due thereon, as hereinafter set out,
were paid when due. If, with any three (3) year period, the holder of
any license issued under the terms hereof shall have been suspended three
(3) or more times for violations of the provisions of this ordinance, the
Electrical Board of the city of North Richland Hills may revoke and can-
cel such license, and upon such revocation and cancellation said license
shall be and become null and void and cannot be renewed thereafter.
(b) The Electrical Board of the city of North Richland Hills may revoke
and cancel any license issued or renewed under the terms of this ordi-
nance if and when it has evidence that the holder of any license in in-
competent or otherwise unfit to perform in a safe manner electrical equip-
ment installations as provided herein, or if and when it determines that
the holder of any license is not of good moral character, and upon revo-
cation and cancellation such license shall be and become null and void,
and cannot be renewed thereafter.
(c) Upon conviction for a violation of any provision of this ordinance
in any court having jurisdiction thereof of any holder of any license
issued or renewed under the terms of this ordinance, such person so con-
victed shall have his license automatically suspended for a period of
one (1) year for the first such conviction, and for a pèriodof two (2)
years for the second such conviction, and during the time of such sus-
pension, such license shall be and become null and void. After the termi-
nation of such period of suspension, such license shall again be valid and
effective, provided that renewal fees which may have become due thereon as
hereinafter set out, were paid when due. If, within any three (3) year
period, the holder of any license issued under the terms hereof shall have
been convicted three (3) or more times for a violation of any of the pro-
visions of this ordinance, such holder of such license shall have his
license automatically revoked and cancelled, and upon such revocation
and cancellation said license shall be and become null and void, and can-
not be renewed thereafter.
SECTION 50. CERTIFICATE OR LICENSE FEES.
(a) The first annual fee for a Master electrician's license shall be
one hundred dollars ($100.00) for the first year, payable in full and
in advance, and the annual renewal fee for such a license shall be

~wenty five dollars ($25.00) payable in full on the expiration of the
annual period for which a license fee was paid theretofore.
(b) The first annual fee for a Journeyman electrician's license shall
be ten dollars ($10.00) for the first year, payable in full and in ad-
vance, and the annual renewal fee for such a license shall be three dollars
($3.00) payable in full on the expiration of the annual period for which
a license fee was paid theretofore. There shall be a fee of five dollars
($5.00) for a temporary working permit.
SECTION 51. CERTIFICATE OR LICENSE RENEWAL.
(a) Any holder of any license of any grade who shall fail to pay the
annual renewal fee due for a renewal of such license within thirty (30)
days of the date the same becomes due, shall be required to pay as a
renewal fee for such license from the date the fee became due. It shall
be unlawful for any work to be performed within this thirty (30) day
period within the corporate limits of this city.
(b) Any holder of any renewable license of any grade who shall fail to
pay any renewal fee due for such license within two (2) years after the
date such fee becomes due, shall forfeit such license, and the same shall
be and become null and void from and after the expiration of said two (2)
year period.
SECTION 52. EXPIRED OR REVOKED CERTIFICATE OR LICENSE.
(a) It shall be unlawful for any person, firm, or corporation who is
not the holder of an unexpired, unrevoked license, or temporary working
permit to engage in any business or perform any work in connection with
constructing, installing, maintaining, extending, repairing, or replacing
any electrical wiring, apparatus or equipment of any voltage in excess of
twenty-four (24) volts, or to perform such work in connection with remote-
control, low-energy power, low-voltage power, or signal circuits of any
voltage, except that a helper or an apprentice electrician may perform
work laid out for him by a holder of a license if he is in the presence
of and being supervised by the holder of such license, and if the license
is such as to permit the holder thereof to do such work.
(b) It shall be unlawful for the holder of any license or temporary
working permit issued under the provisions of this ordinance to engage in
any phase of the electrical business or to perform any work at the elect-
rical trade other than such business or work authorized by the class of
license or permit held by him, except that a helper or an apprentice elect-
rician may perform work laid out for him by a holder of a license enabling
said holder to do such work, and then only while he is in the presence of
and being supervised by the holder of a license.
(c) Every person desiring to engage in any business or perform any work
for which a license is required under the provisions of this ordinance,

~hall appear befor the Electrical Board and pass an examination as to
his qualifications and competency for the class of license desired by
him as required by the provisions of this ordinance, with the exception
of those licensed under a reciprocal agreement, or those presenting to
the Chief Electrical Inspector a valid license from a city with a total
population of one hundred-fifty thousand (150,000) or greater. In which
case upon payment of the applicable fees a license may be granted with-
out an examination.
DIVISION 5. WORK PERMITS
SECTION 53. REQUIRED; EXCEPTIONS.
(a) It shall be unlawful for any person to install or cause to be in-
stalled any electrical conductors or equipment within or on any building,
structure or premises, publically or privately owned, or to make or cause
to be made any alteration in or addition to any existing electrical con-
ductors or equipment, without securing a permit therefor from the chief
electrical inspector, except as otherwise provided in this ordinance, and
except that no permit will be required to execute any of the following
classes of electrical work:
(1) The replacement of lamps, fuses or the connection of portable
electrical equipment to suitable permanently installed recept-
acles.
(2) Any work involved in the manufacture, fabricating, repair or
testing of electrical equipment, products, apparatus or devices
manufactured, produced or used in any factory or manufacturing
faci li ty .
(b) A permit shall be secured for all electric signs manfactured by
registered electrical sign contractors which are not approved by the
Underwriter's Laboratories and are to be sold, erected or installed in
the city.
(c) A permit shall be secured for all electrical changes, installations
and reV1Slons that are done on electrical elevators. No permit shall be
required when electrical conductors or equipment are being maintained by
repairs or replacement in kind.
SECTION 54. APPLICATION.
Application for a permit under this division, describing the work to be
done, shall be made to the chief electrical inspector by the person in-
stalling the work. The application shall be accompanied by such infor-
mation as may be necessary to determine whether the installation as de~
~cribed will be in conformity with the requiréments of this ordinance.

When required by the chief electrical inspector, the applicant shall
state the size of conductors to be used for all services, mains, feeders
and subfeeders, the size of main and subfeeder switches and fuses, the
area to be served by such conductors and the basis used in computing the
required sizes of such conductors.
SECTION 55. FEES.
(a) Any person granted a permit under this division shall pay to the
city a fee therefor to cover the cost of inspections under this ordinance.

(b) If the office of the chief electrical inspector is not notified with-
in seyenty-two (72) hours (Sundays and legal holidays excepted) after a
specific job is started, an investigation fee of two ($2.00) shall be
charged.

(c) The permit fees prescribed in subsection (a) shall include the cost
of the initial inspection and one reinspection as required by this ordi-
nance. If the electrical inspector is required to make a second reinspect-
ion, a fee of two dollars ($2.00) shall be charged to the ~lectrièal con-
tractor for the second reinspection and for each reinspection required
thereafter.
(d) All fees shall be due when the permit is issued. At the end of each
calendar month the chief electrical inspector shall render a statement
for the reinspection fees to the person owing same, and such charges shall
be paid to the city not later than the tenth day of the succeeding month.
Failumto pay such charges as herein provided may result in the for-
feiture of the rights of such person to obtain other permits or otherwise
engage in the installation, repair or maintenance of electrical conductors
or equipment until such charges are paid. The chief electrical inspector
is hereby empowered to suspend the permit privileges of any registered
contractor (electrical), electrical sign contractor, or elevator con-
tractor, who shall faiL to pay any just indebtedness to the city for
reinspection fees, until such registered contractor shall discharge and
pay to the city all just indebtedness then due and owing from such reg-
istered electrical contractor.
(e) An electrical permit may be cancelled by the applicant at any time
within six (6) months of the date of its issuance. If no work has been
done under such permit, the chief electrical inspector, when formally
requested in writing by the applicant, shall refund seventy-five per
cent (75%) of the permit fee paid, but in no case shall the city retain
less than two dollars ($2.00) nor more than ten dollars ($10.00) of the
fee paid to cover the cost of auditing the fee and preparing the request
for refund.
SECTION 56. ISSUANCE GENERALLY.
If it is found that the installation as described in an application under
this division will conform with all legal requirements and if the appli-
cant has complied with all provisions of this ordinance, a permit for
such installation shall be issued.
SECTION 57. NOT TO ISSUE TO CONTRACTORS FAILING TO CORRECT DEFECTS.
Failure on the part of any registered electrical contractor to correct
any defect, error, or deficiency in any work installed under the authority
of an electrical permit issued to him, within ten (10) calendar days after
written notification thereof by the chief electrical inspector or within
such further reasonable time as may, upon request, be prescr~bed, the
chief electrical inspector shall, without further notice, stop the issuance
of permits to such registered electrical contractor until such corrections
have been made, inspected, and approved. In addition thereto, the penalty
provided for violation of this ordinance may be enforced.

SECTION 58. EXPIRATION.
Every specific permit issued by the chief electrical inspector under
the provisions of this division shall expire by limitation and become
null and void if the work authorized by such permit has not been started
within six (6) months from the date of such permit, or if the work
authorized by such permit is suspended or abandoned at any time for a
period of twelve (12) months after the work is started. Before such
work can be started again, a new permit shall be obtained.
SECTION 59. REVOCATION.
The chief electrical inspector is authorized to revoke and declare null
and void any permit obtained under this division by fraud, misrepresen~
tation, or in any way contrary to the requirements of this ordinance.
Such a permit may also be revoked and declared null and void by the chief
electrical inspector for any violation of the provisions of this ordi-
nance or for any other just cause.
SECTION 60. DEVIATION FROM PElliVlIT; PERMIT DOES NOT AUTHORIZE VIOLATION
OF ORDINANCE.
No deviation shall be made from the installation described in the permit
issued under this division, without notifying the chief electrical in-
spector. The issuance of a permit shall not be taken as permission to
violate any of the requirements of this ordinance.
SECTION 61. SECURING PElli'HT FOR PERSON NOT ENTITLED THERETO.
It shall be unlawful for any person to secure for or furnish a permit
for the installation, alteration, or repair of electrical conductors or
equipment to ~ person not entitled to such permit under the regulations
of this ordinance.
SECTION 62. PENALTIES.
Any person who fails, neglects or refuses to comply with, or resists
the enforcement of any of the provisions of this ordinance shall be
fined not less than Ten dollars ($10.00), nor more than two hundred
dollars ($200.00) for each offense.
Each day that a violation is permitted to exist shall constitute a
separate offense.
SECTION 63. SAVING CLAUSE.

In the event that any section, paragraph, subdivision, clause, sentence,
or provision of this ordinance shall be adjudged by any court of competent
jurisdiction to be invalid, such judgment shall not affect, impair, in-
validate or nullify the remainder of this ordinance, but the effect there-
of shall be confined to the section, paragraph, subdivision, clause, sen-
tence or provision immediately involved in the controversy in which judg-
ment or decree shall be rendered.
SECTION 64. REPEALING CLAUSE.
This ordinance hereby repeals all ordinances and/or resolutions or parts
of ordinances and/or resolutions that in any manner conflict with or may
be incorporated herein.
SECTION 65. EMERGENCY CLAUSE.
The fact that it is to the best interest of the City and its inhabitants,
constitutes a measure for immediate preservation of the public peace,
property, health and safety of the City and its inhabitants, and creates
an emergency requiring this ordinance be passed as an emergency measure
on the day of its introduction and that this ordinance be effective from
and after its passage, and it is so ordained.

Members Present:
Floyd Jones, A.D. Pair, Mark West, and C.R. Ballenger
Meeting was c~lled to order by Floyd Jones who then asked for a teview of the
minutes of the preceeding meeting. Motion of approval of the minutes was made
by Mr. Pair, seconded by Mr. West. Motion carried unanimously. Mr. Ballenger
explained to the members of the Board that he had rewritten the Administrative
section of the electrical code of the City of North Richland Hills to adopt the
National Electrical Code, and up date the code in general as had been previously
discussed. Each member of the board then reviewed the entire ordinance as sub-
mitted, recommending minor changes. These changes inserted the board unanimously
authorizing Mr. Ballenger to present this draft to the City Manager, and further
recommend to the City Council that this ordinance be adopted as soon as pratical.
On motion by Mr. West, seconded by Mr. Pair meeting adjourned 6:45 P.M. March 12,
1970.
