HomeMy WebLinkAboutOrdinance 0316 '~ · ORDINANCE NO. 316 AN ORDINANCE ESTABLISIDNG A PARKS AND RECREA- TION COMMISSION; PROVIDING FOR THE NUMBER OF MEMBERS AND TERM OF OFFICE; FIXING THE METHOD OF APPOINTING THE FIRST CHAIRMAN THEREOF; FOR ELECTION OF THE CHAIRMAN BY THE COMMISSION THEREAFTER; AND PRESCRIBING ITS DUTIES WHICH SHALL BE ADVISORY AND SUBJECT TO SUPERVISION OF THE COUNCIL; REPEALING PRIOR ORDINANCES; PROVIDING A SAVINGS CLAUSE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: I. · There is hereby created and established a Parks and Recreation Commission to be composed of seven (7) members, each of whom shall be a resident of the City of North Richland Hills, Texas. All members shall serve without compensation. II. The Mayor shall appoint all members to this Commission, subject to the confirmation and approval of the City Council of North Richland Hills, Tarrant County, Texas. Members shall be appointed to a specific place numbered one (1) through seven (7), consecutively. Each member shall serve a term of three (3) full years except the first Commission shall serve a term of the following: Places one (1), two (2) and three (3) shall serve until May 1,1973; Places four (4) and five (5) shall serve until May 1,1972; and Places six (6) and seven (7) shall serve until May 1, 1971. Vacancies shall be filled by appointment by the Mayor, subj ect to the approval of the City Council, as heretofore provided. III. · The Mayor, subj ect to the approval of the City Council, shall appoint the first Chairman of the Commission, who shall serve as Chairman until his term as such has expired. Thereafter and annually at the first meeting ~ ......... ~~ ~ . . . of the Commission following May 1 of each year, the Commission shall elect its own Chairman for the ensuing period of one year. IV. . The Commission shall act in an advisory capacity to the Mayor and City Council and shall also act in an administrative capacity under the supervision of the City Council in carrying out the Council's instruc- tions, directings, and policy with reference to public parks and recrea- tion. '- It shall be the duty of the Commission to immediately and at all times thereafter make continuous study of the needs of the City for the establishment of public parks and recreation facilities, to investigate and determine the locations or sites at which public parks and recrea- tion facilities should be made available within the municipal limits, suggest means of acquiring and developing such facilities and furnish the City Council with over-all plans and specifications for development and improvement of all such facilities and to report to the City Council the result of its studies, recommendations, plans and specifications into effect, but only upon the specific approval and under the specific directions of the Council. In the performance of these duties said Com- mission shall act in an administrative capacity and is hereby given such specific authority as may be required in carrying out the directions, orders and general policy of the City Council, and in carrying out these duties said Commission is hereby authorized to employ such personnel as may be required. It is, nevertheless, here specifically provided that said Commission shall have no authority to spend nor to commit the City to the expenditure of any funds or monies whatsoever, except under the specific authorization and direction of the City Council. V. The Commission shall hold regular monthly meetings at such time and place as it may fix, and such special meetings as may be called by the Chairman or at the request of any two (2) members of the Commission. The Commission is hereby authorized to provide for the election of a Vice- Chairman, who shall preside in the absence of the Chairman, and is further authorized to prescribe such rules and regu- lations governing its own proceedings as it may deem advisable. VI. e This Ordinance hereby repeals and supercedes Ordinance Num- ber 51 and any other Ordinance that may be in conflict here'With, as this Ordinance takes the place of Ordinance Number 51 and other Ordinances l.. j _/ ,....- .... -.. þ · · · ',,-- , ~ that may concern the Parks and Recreation Commission. VII. Should any Section or part of this Ordinance be held to be invalid for any reason, such holding shall not be construed as affecting the validity of any other Section or part thereof, it being the intent that the remainder of any such or part hereof shall stand, notwithstanding the invalidity of any such Section or part hereof. VIII. The fact that the prior Parks and Recreation Commission Ordi- nance were inadequate for the present needs of the City of North Richland Hills, Texas, and the City Council feels that this Commission is of utmost importance to the development and public welfare of this City, the fact that this Ordinance creates two (2) additional places to this Commission and the same should be appointed immediately creates an emergency and public necessity demanding that this Ordinance be passed as an emergency measure and that all rules requiring more than one (1) reading of this Ordinance be suspended and the same shall take effect immediately from and after its passage.
