Anderle City Attorney CALL TO ORDER Mayor McCarty called the meeting to order at 5:31 p.m. 1. DISCUSS ITEMS FROM REGULAR CITY COUNCIL MEETING. City Council had no questions for staff. 2. DISCUSS THE FISCAL YEAR 2027 PROPOSED BUDGET FOR THE SPECIAL REVENUE FUNDS. City Council received a presentation from Director of Budget and Research Chase Fosse. The Fiscal Year 2027 Special Revenue Funds presentation provided an overview of each fund's purpose, primary revenue sources, and proposed expenditures for the upcoming fiscal year. Overall proposed spending across these funds decreases from approximately $7.1 million in Fiscal Year 2026 to $4.4 million in Fiscal Year 2027, largely due to the conclusion of several one-time capital project transfers, especially within the Drainage Utility Fund. Several funds, including Promotional, Special Investigations, and June 22, 2026 City Council Meeting Minutes Page 1 of 13 Gas Development, show increases tied to higher revenues or expanded program needs. Others, such as PEG and Municipal Court, reflect reductions following the removal of prior one-time expenses. Mr. Fosse provided a timeline of next steps leading to final budget adoption. 3. DISCUSS PROPOSED AMENDMENTS TO THE CITY'S CODE OF ORDINANCES, CHAPTER 50, ARTICLE IV REGULATION OF SEX OFFENDER RESIDENCY. City Council received a presentation from Police Chief Jeff Garner. The presentation outlined a proposed amendment to the city's Sex Offender Residency Restrictions ordinance, increasing the residency buffer from 1,000 feet to 2,000 feet and expanding definitions of areas where children commonly gather by establishing "child safety zones." The amendment also adds new provisions including a loitering restriction, revised definitions for temporary and permanent residences, and specific regulations for Halloween activities. Staff noted that most surrounding cities have already adopted similar 2,000-foot restrictions, and maintaining the current standard could make North Richland Hills a more attractive location for offender residency. Under the proposal, existing residents would be grandfathered, while violators would be subject to misdemeanor penalties and potential injunctive relief. 4. REVIEW AND DISCUSS POTENTIAL AMENDMENTS TO CHAPTER 118 (ZONING), SECTIONS 118-631 AND 118-633 REGARDING DATA CENTER FACILITIES. At the request of City Attorney Bradley Anderle, Mayor McCarty announced at 6:01 p.m. that the City Council would convene to Executive Session as authorized by Chapter 551, Texas Government Code, Section 551.071: Consultation with City Attorney on items listed on the work session, specifically item 4. Executive Session began at 6:02 p.m. and recessed at 6:19 p.m. Mayor McCarty reconvened work session at 6:20 p.m., with the same members present. City Council received a presentation from Director of Planning Cori Reaume. The presentation provided an overview of current data center regulations, including definitions for small-scale and general facilities and existing requirements for equipment screening, generator testing hours, and noise limits. It outlined how data centers are permitted only in specific industrial zoning districts, with small-scale facilities allowed in C-2 under certain conditions. Ms. Reaume highlighted public concerns regarding water usage, power demand and rates, noise, and grid stability, noting the need to update regulations as interest in data center development continues to grow. The presentation also summarized actions taken in other communities such as moratoriums, checklists, town halls, and regulatory changes. She outlined upcoming steps that include community meetings, gathering City Council feedback, and initiating required public hearings. FUTURE AGENDA ITEM(S) There were no requests from City Council for future agenda items. CITY MANAGER REPORT City Manager Paulette Hartman reported on the utility billing efficiency audit and informed City Council that residents will receive a customer service survey with their water bill. The survey will begin July 1 and will remain open for six weeks. EXECUTIVE SESSION 1. If there is no opposition from the Council, he recommends any remaining speakers following the 30-minute time limit for public comments be heard after city business is complete and that the time limit be extended for the remaining speakers. There was no opposition from Council. Bobby Gomez, 7714 Sable Lane, commented on work session item 3, proposed amendments to Chapter 50, Article IV regulation of sex offender residency. PUBLIC HEARINGS C.1 ZC26-0158, ORDINANCE NO. 3961, PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM DENT TEX FOR A SPECIAL USE PERMIT FOR TRUCK RENTAL AT 7507 BOULEVARD 26, BEING 0.654 ACRES DESCRIBED AS LOT 10R, NORTH EDGLEY ADDITION. DENIED Mayor McCarty opened the public hearing for ZC26-0158, Ordinance No. 3961. Director of Planning Cori Reaume informed City Council the applicant is requesting a special use permit for 0.654 acres located at 7507 Boulevard 26. The area is designated on the Comprehensive Land Use Plan as retail commercial and the current zoning is C-2, commercial. Ms. Reaume provided site photos of the property. The Planning and Zoning Commission recommended denial at their May 21, 2026 meeting, with a vote of 7-0. In response to Council member Goetz's question, Ms. Reaume said that staff did not receive communication from the applicant regarding their absence from the City Council meeting. In response to Council member Delaney's question, Ms. Reaume said that the city did not receive comments from the public regarding the request. Mayor McCarty asked the City Secretary to call on those who completed a public meeting appearance form to speak during the public hearing. Mr. Bobby Gomez, 7714 Sable Lane, spoke in opposition. C.2 ZC26-0162, ORDINANCE NO. 3962, PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM WING AVIATION LLC FOR A REVISION TO PLANNED DEVELOPMENT 35 AT 6321 BOULEVARD 26, BEING 5.267 ACRES DESCRIBED AS LOT 6, BLOCK A, RICHLAND PLAZA ADDITION. CONTINUED Mayor McCarty opened the public hearing for ZC26-0162, Ordinance No. 3962. The city received a request from the applicant to continue the public hearing to the July 27 City Council meeting. Mayor McCarty asked the City Secretary to call on those who completed a public meeting appearance form to speak during the public hearing. Mr. Bobby Gomez, 7714 Sable Lane, spoke in support. There being no one else wishing to speak, Mayor McCarty entertained a motion to continue the public hearing to the July 27 City Council meeting. Seth Mullins, 8321 Saddlebrook Drive, with FlexPointe Ventures and Timothy Lucas 12332 Dogwood Spring Drive, Fort Worth, with Westwood Professional Services presented the request. Director of Planning Cori Reaume presented staffs report. The Planning and Zoning Commission at their May 21, 2026 meeting, denied the request with a vote of 4-3. CITIZENS PRESENTATION John Schleeter, 6553 Northern Dancer Drive, asked the city to recognize Pride Month. G. GENERAL ITEMS G.1 PRESENTATION BY THE 2025 CAPITAL PROGRAM ADVISORY COMMITTEE (CPAC) ON RECOMMENDATIONS FOR THE 2026 BOND ELECTION. APPROVED The City Council received a presentation from Capital Program Advisory Committee (CPAC) Chairs Tito Rodriguez and Richard Davis. The committee recommends four projects: public safety, streets, city services, and library for the 2026 Bond Election to be held on November 3, 2026. Proposition A Rebuild Fire Station 2 (10,712 square-foot facility) and Fire Station 3 (12,883 square-foot facility) $26,300,000 Proposition B Street Improvements (30 residential streets and 20 major streets) $84,260,000 Proposition C Rebuild City Services Complex (consolidation of parks operations, public works operations and fleet buildings) $24,700,000 Proposition D Library Improvements (Community Room expansion) $10,710,000 Mr. Davis reviewed the financial impact of the proposed 10-year program. Under the recommended schedule, debt would be issued annually from Fiscal Year 2028 through Fiscal Year 2037 in varying amounts. Bonds for street improvements would be issued throughout years 1-10; library improvement bonds in year 1; fire station bonds in years 2 June 22, 2026 City Council Meeting Minutes Page 9 of 13 and 3; and city service complex bonds in years 4-6. The model reflects an estimated 2.5-cent impact to the interest and sinking tax rate, with the debt rate remaining steady until Fiscal Year 2037, after which it begins to decline. Mr. Rodriguez reviewed three (3) non-bond election library projects: expansion of the library circulation room, separating the adult and children collections, and the addition of a second elevator. These projects could be funded through other sources, such as reserves or Certificates of Obligation. Staff does not anticipate these projects impacting the property tax rate. The total cost for the projects is $3,775,000. G.2 CONSIDER RESOLUTION NO. 2026-039, APPROVING AND AUTHORIZING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION IN AN AMOUNT NOT TO EXCEED $3,000,000; AND APPROVING AN EFFECTIVE DATE. City Council received a presentation from Director of Finance Stephen Barnes. The Certificates of Obligation in the amount of $3,000,000 is to purchase a fire engine and ambulance replacement.
