August 06, 2026 Planning and Zoning Commission Meeting Minutes Page 1 of 4 Director of Planning Cori Reaume discussed items on the regular meeting agenda. A.3 DISCUSSION REGARDING REVISIONS TO THE ZONING ORDINANCE TO ENSURE COMPLIANCE WITH TEXAS LOCAL GOVERNMENT CODE. Director of Planning Cori Reaume discussed key text revisions that will be considered by the Planning and Zoning Commission in September. She stated these revisions are clean-up items necessitated by changes to state law including the Zoning Board of Adjustment, no-impact home-based businesses, building materials, notice and signage requirements for zoning changes, and the table of land uses. B. FUTURE AGENDA ITEM(S) There were no requests from Planning and Zoning Commission for future agenda items. C. EXECUTIVE SESSION Chair Carpenter announced at 6:31 p.m. that the Planning and Zoning Commission would adjourn into Executive Session as authorized by Chapter 551, Texas Local Government Code, Section 551.071, to seek advice from the city attorney as to the posted subject matter for item D.1 (PLAT26-0115). PRESENTER: Clayton Husband, Principal Planner SUMMARY: Gregory Ricks is requesting a zoning change from AG (Agricultural) to R-1 (Single-Family Residential) on 1.92 acres located at 7412 Bursey Road. GENERAL DESCRIPTION: The property under consideration is a 1.92-acre tract located on the south side of Bursey Road between Londonderry Drive and Hunter Lane. The applicant is requesting a zoning change to R-1 (Single-Family Residential) with the intent to plat the property for the construction of a new single-family residence. The character of the area is low-density single-family residential. Most properties to the east and west are zoned R-1 (Single-Family Residential), with most of the lots on the south side of Bursey Road are large estate lots generally two acres in size. Neighborhoods to the south and northeast are zoned R-2 (Single-Family Residential). The neighborhood to the northwest includes large estate lots zoned AG (Agricultural) and R-1 (Single-Family Residential). While the AG (Agricultural) district is primarily intended to protect land suited for agricultural uses from incompatible uses, it is also a holding zone intended to preserve land suited for eventual development into other uses. This allowed for zoning changes to be considered at a time when reasonable development of a site was suitable based on long-range plans, availability of public services, and market conditions. VISION2030 COMPREHENSIVE PLAN: This area is designated on the Vision203O Land Use Plan as Low Density Residential. This designation promotes quality neighborhoods of conventional suburban single-family detached homes. General characteristics of these neighborhoods include a density of two to six dwelling units per acre and houses of one- and two-stories. CURRENT ZONING: The property is currently zoned (AG Agricultural). The AG district is intended to preserve lands best suited for agricultural use from encroachment of incompatible uses, and to preserve in agricultural use, land suited to eventual development into other uses pending proper timing for practical economical provisions of utilities, major streets, schools, and other facilities so that reasonable development will occur. PRESENTER: Clayton Husband, Principal Planner SUMMARY: On behalf of TX Circle 182 LLC (owner) and The Axe & Horn Meadery LLC (applicant), Wilson Whitaker Rynell is requesting a special development plan to allow a winery (meadery) in a building suite on 8.32 acres located at 8204 Northeast Parkway. GENERAL DESCRIPTION: The property is located on the south side of Northeast Parkway east of Davis Boulevard. The 8.32-acre property is developed with five commercial buildings totaling 116,000 square feet. The applicant proposes to lease a 900-square foot suite in the building at 8204 Northeast Parkway to open a new business, The Axe & Horn Meadery, for the operation of a small-scale meadery specializing in the production, packaging, and sale of mead. A statement from the applicant that describes the business operation is attached. At the time the property was originally developed in 1986, the property and surrounding area was zoned 1-2 (Medium Industrial) The property was rezoned to TOD (Transit Oriented Development) in 2009 as part of the zoning change for the 279-acre Smithfield TOD district. The property is located within the TOD General Mixed Use character zone of the Smithfield Transit Oriented Development (TOD) district. This area is intended for a wide range of retail, office, residential, and industrial uses. The applicant is seeking a winery permit from the Texas Alcoholic Beverage Commission. This type of permit would allow for the manufacture of wine and fruit brandy, as well as bottling, labeling, and packaging. Wine includes any juice fermented from grapes, berries, other fruits, or honey. Since mead is fermented from honey, it is considered wine under state alcohol laws. This permit also allows for tasting rooms, to-go sales, and tours. The TOD General Mixed Use character zone permits brewpubs, tap rooms, and wine bars through special use permit approval. While this zone also allows for some light industrial and manufacturing uses, a brewery, distillery, or winery are not specifically NORTH RI HLAND HILLS called out as permitted uses. However, in the Industrial zoning districts these uses require approval of a special use permit. These uses could be considered compatible with the purpose and intent of the TOD General Mixed Use area; but, since the TOD district does not reference the winery use, approval of a Special Development Plan would be required to authorize the use. The proposed conditions of approval for this special development plan are attached, which are based on the applicant's proposed development of the property. These conditions may be modified throughout the public hearing process, but they are subject to final approval by City Council. Special Development Plans Special Development Plans are intended to allow applicants development flexibility to address specific market opportunities and/or contexts. An application for a Special Development Plan may only be approved by the City Council after a recommendation has been made by Planning and Zoning Commission. In evaluating a Special Development Plan, the Planning and Zoning Commission and City Council shall consider the extent to which the application meets the following: o the goals and intent of Transit Oriented Development in the city; o provides an alternative "Master Plan" approach by consolidating multiple properties to create a predictable, market responsive development for the area; o fits the adjoining context by providing appropriate transitions; o provides public benefits such as usable civic and open spaces, livable streets, structured and shared parking, and linkages to transit; and o does not hinder future opportunities for higher intensity transit-oriented development LAND USE PLAN & CURRENT ZONING: This area is designated on the Land Use Plan and is zoned Transit Oriented Development. The purpose of the transit oriented development code is to support the development of the community's station areas into pedestrian-oriented, mixed-use urban neighborhoods, with convenient access to rail transit, shopping, employment, housing, and neighborhood retail services. The proposed business will operate as a small-scale meadery specializing in the production, packaging, and sale of mead. Mead is an alcoholic beverage produced through the fermentation of honey and water, similar in regulatory classification to wine.The business will manufacture mead on-site in limited production volumes and offer both business-to-business and direct-to-consumer sales. B2B sales will be the main focus of the operation,and there will be no bar service on-site, and no expected increase in vehicular traffic. Operations will primarily consist of receiving ingredients,fermentation,aging, packaging,storage, and customer deliveries. Production activities occur indoors within enclosed commercial space and do not involve significant noise,vibration,emissions,or other impacts typically associated with heavy industrial uses. Deliveries to my facility will be limited to normal business hours and consist primarily of ingredients, packaging materials,and standard commercial supplies. The tasting room component will provide customers an opportunity to sample products and purchase packaged mead for off-premise consumption in accordance with all applicable federal,state,and local regulations.This location that I leased is a commercial park,so foot traffic is already close to zero.The proposed use is expected to generate minimal traffic beyond that associated with comparable commercial park areas. No outdoor manufacturing activities are proposed.All production,storage,and customer service activities will occur within the leased premises. As the first winery/meadery operation proposed within North Richland Hills,we look forward to working with City staff to ensure the project meets all applicable zoning,development,and permitting requirements.We believe the business will provide a unique product,contribute to economic development, and expand the variety of options at local dining and entertainment businesses available to residents and visitors. The following regulations shall be specific to this Special Development Plan. Where these regulations conflict with or overlap another ordinance, easement, covenant or deed restriction, the more stringent restriction shall prevail. A. Permitted Land Uses. Uses in this SDP shall be limited to those permitted in the TOD General Mixed Use -Smithfield character zone of the TOD (Transit Oriented Development)district with the addition of the following. 1. Winery or meadery B. Building form and development standards. Development of the property must comply with the development standards of the TOD (Transit Oriented Development) district and the standards described below. 1. The site improvements must be constructed as shown on the site plan attached as Exhibit „C .11 2. The winery or meadery lease area must not exceed one thousand (1,000) square feet within the building. C. Expiration.The special development plan will expire three (3) years from the effective date of this ordinance. If the winery or meadery use is still in operation at the time of expiration, the business shall be considered a legal non-conforming use and may continue operation subject to the standards described in Section 118-153 of the zoning ordinance. D. Amendments to Approved Special Development Plans. An amendment or revision to the special development plan will be processed in the same manner as the original approval. The application for an amendment or revision must include all land described in the original ordinance that approved the special development plan. The city manager or designee may approve minor amendments or revisions to the standards provided the amendment or revisions dos not significantly: 1. Alter the basic relationship of the proposed uses to adjacent uses; 2. Change the uses approved; 3. Increase approved densities, height, site coverage, or floor areas; 4. Decrease on-site parking requirements; 5. Reduce minimum yards or setbacks; or 6. Change traffic patterns.
