'- BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICmAND HILLS, 'l'EDS: ARTICLE 1. BUILDING OODE Section 1.01 Adoption of Code. . The Southern Standard BUilding Code, 1960-1961 Revision, as adopted by the Southern BUilding Code Congress, a copy of which is on file in the office of the City Secretary of the City of North Richland Hills, Texas, is hereby adopted and designated as the Building Code of the City of North Richland Hills, Texas, the same as though such code were copied at length herein, subject, however, to the following omissions, amendments and additions. . a. Section l02.1(b) of said code is hereby amended to read: "The bu11ding official shall be appointed by the City Manager with the approval and consent of the City Council. His appointment Over 200 - 1 for each additional 50 persons. 1 Urinal shall be provided for each 50 men. p. Section 108.2, sub-paragraph "du of said code is amended to read: No work shall be done on any part of a building or structure beyond the point indicated in each successive inspection without first obtaining the written approval of the Building Official" or the designing archétect or engineer in cases proceeding under the provisions of Section 105.6 hereof. q. Section 105.1(d) is amended to read as follows: "(d} Where construction is commenced before a permit is obtained, the permit fee shall be doubled upon the third violation within any twelve months period." r. Section 605.5, FIRE-PROTECTIVE REQUIREMENTS - TYPE IV - NON-COMBUSTIBLE, is amended so that the next to the last category in the table prescribing the requirements for Exterior Walls is changed to read as follows: I , I I I N.C.~ I I I For one-story buildings not exceeding 211000 sq. ft. in area when the exterior wall is facing and lQcated 8 ft. or more from common property or interior lot lines in the se- cond fire district. s. Section 1700.2 is amended by deleting the last sentence in Sub-paragraph (b) and deleting Sub-paragraph (d) in its entirety. . t. Section 1701.7 is amended by deleting the last paragraph of such section. u. Shingle nailing boards shall be securely nailed to each stud with two (2) 8d nails. It -'5- Section 1.02. Building Contractor's Bond. The bond required under the provisions of Section 106.2 of such code shall be executed by the contractor or builder as Principal and by a corporate surety duly authorizèd to do business underthe laws of the state of Texas. Such bond shall be on substantially the same form as that shown on Exhibit A attached hereto and made a part hereof by reference. EXHIBIT. This bond shall cover all building operations of the said within the City of North Richland Hills, ~xas, ror the period of one year from the date of the approval and filing thereof, unless sonner cancelled in the manner hereinafter provided. It ia understood, however, that the surety herein reserves unto itself the right to cancel this bond after thirty (30) days written notice of such intention has been given to the City; but this privilege of cancellation shall not affect any liability that may have arisen hereunder up to the time the same is actually cancelled, in accordance with the terms hereof. It is further agreed by the contractorl1 principal, herein, that in event of cancellation of this bond as above provided; then that such cancellation shall automatically cancel his permit and that he will immediately cease operations as such contrac- tor until another bond is furnished as required by the Building Code. And it is further understood and agreed that this bond may be sued upon in the name of any prson, firm or corporation injured by any act constituting a breach of the conditions hereof, and that the same shall not be -7- void upon one recovery, but may be sued upon from time to time until the whole amount of .the penalty is reoovered. It is unlaw£ul £or any person, rirm or corporation to erect or cause to be erected, substantially alter or cause to be substantially altered, remodel or cause to be remodeled, move or cause to be moved, wreck or cause to be wrecked, any building, house, or other similar structure without first having obtained from the City Engineer a building permit authorizing such action. Section 2.02. Fees. For moving of a house or building in, through or upon streets, alleys, avenues, or public grounds, the sum òf $25.00 for the first day and $10.00 foreach additional day, or fraction tJœ reof, that the house or building is in or on the streetl1 alleysl1 avenues, or public grounds. Wrecking permits - $2.00 for first 2500 sq. ft., $0.50 for each additional 1000 sq. ft. or fraction tbreof. ARTICLE 3 TEMPORARY OCCUPANCY OF STREETS WITH BUILDING MAZERIAL,ETC. Section 3.01. Permit and Bond. Hereafter any person or personsl1 firm or corporation desiring to temporarily occupy any portion of any public streetl1 alley or sidewalk within the City of North Richland Hills, Texas for the purpose of placing thereon material or rubbishfor or from building operationsl1 or for any excavation of any area under sùch streetl1 alley or sidewalk or for any purpose whatsoever connected with the erection, removal, alteration or repair of any building or other structure, shall apply to the City Engineer for a permit for such temporary occupation as aforesaid, and it shall be unlawful to œeupy or obstruct any street, alley or sidewalk, as aforesaid, without a written permit therefor Cpom the City Engineer which permit shall not be issued until the person, persons, firm or corporation applying therefor shall have first presented a building permit therefor issued by the City Engineer, together with a bond approved by the City Council, conditioned that the principal therein will discharge -10- all claims o~ every character arising ~rom or occasioned by such occupancy o~ such street, alley or sidewalk, or the construction or reþair o~ such buildihg or the making o~ such excavation and discharge all judgments obtained, together with all oosts attached thereto against the City o~ North Richland Hills, 'Texas, by reason of any such claim, injury or damage sustained, and every person 'or persons, ~irm or corporation carrying on any such excavation or bUilding operation shall keep all streets, alleys and sidewalks adjaoent to such excavatiÒns or building operations oarried on by them, in a olean and orderly condition, and unobstructed, except as provided herein, during such operation, and at the expiration of the timestipuJ.a ted in the permit a~oresaid, they shall restore all such streets, alleys and sidewalks to as good condition as they were be~ore the beginning of such operations. ARTICLE 4 CONSTRUCTION OF SIDEWALKS AND CURBS seotion 4.01. License and Permit Required. Hereafter no person or persons, firm or corporation, shall lay, construct, buildl1 repair or re-build any side- walks, curbs, gutter or driveway on any street, alley or thoroughfare within said City, without first having obtained from the City Engineer a license to do such work, having made and exeouted a Bond to said City in the sUm of Twenty-Five Hundred Dollars ($2500.00), having paid a license fee o~ Ten Dollars ($10.00) per annum, and having obtained a permit from the City Engineer of the City of North Richland Hillsl1 Texas, to do such work. Provided, however, that in residential construction only the oonstruction of sidewalks, curbs, gutters, driveways, and drive, approaches appurtenant toa residence may be be inoluded in the building con- tractor's permit for the constructDn of an indiv~dual -11- residence if application to construct such sidewalks, curbs, gutters, driveways, and drive approaohes is made at the time the building permit is applied for. Provided, further, that the preceding sentenoe shall allow only the building oontractor himself to oonstruct curbs, gutters, sidewalks, driveways, and drive approaohes on his bUilding oontraotor's bond with- out the neoessity of making a separate ceaent bond for their construction, and the preoeding sentence shall not apply if the building contractor oontraot with another to construot the sidewalks, ourbs, gutters, drivewaysl1 and drive ap- proaohes. The building oontractor shall have the oons- truction of such sidewalks, curbs, gutters, driveways, and drive approaches inspeoted and approved by the building offioial of the City of North Riehland Hills, Texas. Where the building contractor avails himself of the provisions of this section, he shall be responsible for the construction and maintenance of such concrete construction:ia the same manner as individuals holding a license to do concrete work, and his building contractor's bond shall be amended and suplemented to comply with this section. Section 4.02. Requisite of License and Bond. The License hereinhefore mentioned shall be issued and approved by the City Engineer, and before the issuance of the same, the applicant shall file in the office of the City Engineer a statement of his qualifications, together with a surety oompany bond in the penal sum of Twenty Five Hundred Dollars ($2500.00), conditioned that said applicant will indemnify. and saVe harmless the City of North Richland HiIB, Texas, from any and all damages of every character arising from or caused direotly or indirectly by negligence in the doing of said work, or for any imperfect or inadequate work done by the applicant, and that he will maintain said work in a good and workmanlike state of repair for and during a period of two years from and after its com- pletion and acceptance by the City. Said statement of qualifications approved by the City Engineer, together with bond, license, and date of issuanoe shall be filed by said City Engineer with the City -12- secretary. The applicant shall also state in his application for license, his place of businessl1 and shall notify the city Engineer immediately of æy and every change in the address or style of his firm. All such bonds shall be subject to the approval of the City AttorneYI1 andsball run for a period of one year from date, or until revoked as hereinafter provided. Such bond shall be on substantially the same form as that shown on EXhibit E attached hereto. (See Section 4.07, below.) Section 4.03. Effect of Bond Cancellation. The surety on such bonds may terminate its liability at anytime by giving the City Council of the City of North Richland Hi1B, Texas, five (5) days' notice in writing of. the surety·s 1ntention to do so and from and after said date, the surety will no longer be liable for any sub- sequent act of the principal. Such cancellationl1 however, shall of itself constitute and be a rescision and cancellation of the license held by such person or persons, firm or corporation until such time as another such bond has been filed with and accepted by the City,coveriàg the balance of the license year. section 4.04. Use of License by Others or Sub- Letting Prohibited. said licensee shall not permit the use of said license by any person, persons, firm or corporation not in his employ for the purpose of doing any work covered by this ordinance, nor shall he sub-let any work for which a license is 18fJuèd to him to any other person, persons, firm or corporation not having such a license. -13- Section 4.05. City Engineer to Be Given Notice of Com- mencement of operations. Said licensee shall notify the City Engineer of the date on which he intends to start operations on any new 1ADrk or contract. Section 4.06. Job Permit Required. Before commencing any job involving work covered by thls ordinance, the licensee shall make application to and obtain from the City Engineer a job permit and upon the issuance of such permit, covering work costing in excess of $25.0011 the City Engineer shall cóllect a job permit fee of $1.50 for each such permit. The application for a jOb permit shall show in detail the location, scope and nature of the work to be done on that particular job. Section 4.07. Exhibit A. NOW, THEREFORE, if said Principal shall during his continuance of said license indemnify and save harmless said City of North Richland Hills 11 Texas, from any and all damages of every character arising from, or caused directly or indirectly by any negli- gence in the doing of such work as above set forth under the terms of said ordinance No. and said license, òr for any imperfect or inadequate work done by said Principal under the terms of said Ordinance No. and 3aid license, and shall maintain said work in good and workmanlike state of repair for and during a period of two years from and after its completion and aoceptance by said City of North Richland Hills, Texas, then this obligation shall be null and void, otherwise to remain in full force and effect; providedl1 however, this bond is executed by the surety on the condition that its liability shall be limited by and subject to the conditions and provisions hereunder contained. Successive actions may be brought on this bond for successive breaches of its conditions or any of them; prpvided,Ìlowever, that the sum total of all liability of the Surety on anyone or all of such actions shall not exceed the sum of Two Thousand Five Hundred Dollars ($2,500.00). The liability of the Surety under this bond if not cancelled as hereinafter provided shall cease and determine of its own force and effect one year from the date hereof or hereon, saving and excepting for the maintenance for the work performed previous to the date of termination, and for such wOrk a liability of the surety for maintenance shall continue for two yæ rs from and after the date of the completion and acceptance -15- -~, of said work by the City, but no longer. It shall be unlawful for any person, persons, firm or corporationl1 or agent Or employee thereof, to build, erect, keep or maintain or permit or allow to be built, erected, kept or maintained, any barbed wire fence on or around any property or premises owneó or controlled by such person, persons, firm or corporation within the limits of the City of North Richland Hills, Texas. \ Seotion 5.02. Enalosure of swimming Pool. a. Every outdoor swimming pool shall be completely surrounded by a fence or wall not less than four feet in height'- which shall be so constructed as not to have openings, holes, or gaps larger than four inches in any dimension except for doors and gates; and if a piclçet fence is erected or maintained, the horizontal spacing between pickets shall not exceed four inches. A dwelling house, or accessory building may be used as part of such enclosure. b. All gates or doors opening through such enclosure shall be equipped with a self-closing and self-laúèhing device for keeping the gate or dOor securely closed at all times when not in actual use, except that the door of any dwelling which forms a part of the enclosure need not be so equipped. c. This requirement shall be applicable to all new swimming pools hereafter constructed, other than indoor pools, and shall apply to all existing pools whichhave a depth of 18 inches or more of water at any point. No person in pessession of land within the City,either as owner, purchaser, lessee, tenant, or licensee, upon which is situated a swimming pool having a depth of 18 inches or more of water at any point shall fail to provide and maintain such fence or wall as herein provided. -17- d. The Building Code Board of Adjustments and Appeals of the City may make modifications in individual cases, upon a showing of good cause with respect to the height, nature of location of the fence, wall gates or latohes, or the neoessity therefor, provided the protection as sought here- under is not reduced thereby. The Building Code Board of Adjustment and Appeals of the City may permit other protective devices or structures to be used so long as the degree of protection afforded by the substitute devices or structures is not less than the protection afforded by the substitute fence, gates and latoh described herein. The Building Official shall allow a reasonable period within which to comply with the requirements of this Section. e. The term tlswimming pooltas used herein shall mean a body of water in an.artifidial or semi- artificial receptacle or other container located outdoors, used or intended to be used for publicl1 semi-public, or private swimming by adults or children, or both adults and childrenl1 operated and maintained by any person, whether he be an owner, lessee, operator, licensee, or concessionaire, and shall include swim- mingpools used or inte~ded to be used solely by the vwner, friends invited to use it without payment of any fee; however, the requirement of this section shall not apply to a swimming pool constructed, operated, and maintained in conjunction with a motel, hotel, or private dormitor~, or like business which operates on a twenty-four (24) hour-per-day basis and which provides such pool for the use of its'tenantsand their guests.. Section 6.01. Repealing Clause. That all ordinances and parts of ordinances in conflict herewith be, and the same are hereby, repealed. -18- Section 7.01. Effective Date. That this ordinance shall becoMe effective immediately upon its passage and adoption and publication as required by law. Section 6.01. Repealing Clause. That all ordinances and parts of ordinances in conflict herewith be, and the same are hereby, repealed. Section 7.01. Effective Date. That this ordinance shall become effective immediately upon its passage and adoption and publication as required by law.
