introduced the-íõilowing Ordinance calling an electien to
determine the quèstion:
ftShall a commission be chosen to frame a new charter?ft and if
a majority of the qualified voters, voting on said question
have voted in the'affirmative, providing for the election from
the City at large, a commission of fifteen members to be known'

The Ordinance:
WHEREAS, under the provJ.sJ.ons of Article 11, Section 5,
of the Constitution of-the State of Texas, and its enabling act,
Article 1166, Et. Seq., provides that cities having more than
5000 inhabitants may, by a majority vote of the qualified voters
of said City, at an election held for that purpose, adopt or
amend their charters, subject to such limitations as may be pres-
cribed by the Legislature; and that the governing body of such
City may, by a two-thirds vote of its members provide by ordinance
for the submission to the qualified voters of the City, of the
question:
"Shall a commission be chosen to frame a new charter.ft
and,
WHEREAS, in occordance with official U. S. Gover~ent
census of the City of North Richland Hills, taken in fJ,
the said Câty has more than 5000 inhabitants and theø~f 'ôuncil
deems it to the best interest of the City and its inhabitants
and their safety, health and general welfare by favoring the
qualified voters of the City with an opportunity to adopt or
reject said proposition;
NOW THEREFORE BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF NORTH RICH-
LAND HILLS, TEXAS:
I.
That it be and is hereby ordered that the proposition,
"Shall a commission be chosen to frame a new charter?" be sub-
mitted to the qualified voters of the City of North Richland
Hills, Texas, 'at an election to be held in~he Fire Hall, 4101
Morgan Circle, in said City on If""I:A !fit"'. 1963, from 7:00 A. M.
to 7:00 P. M. . and at the Smithfield Fire Hall.
II.
The ballot used in said election shall be in the form
as is required by the General Laws of Texas, relating to the
holding of elections of the instant class and shall be sustant-
ially as follows:

"'Yes"

Vote for fifteen (15) persons to constitute the Charter
Commission.
Those desiring to vote for the proposition:
"Shall a Commission be chosen to frame a new charter?ft shall
strike out the word "No, ft, and those desiring to vote against
the proposition: "Shall a Commission be chosen to frame a new
charter?ft shall strike out the word ftYes.ft
In either event the voter will then vote for a
Charter Commission of fifteen members to serve in case a
majority of the voters voting at this election have voted
in the affirmative. The above candidates have been selected
by the City Council as candidätèS for the Charter Commission
and should the voter desire to vote against any or all of
the above named persons, he may do so by scratching the name
of such person, provided that a failure to so name a Charter
Commission shall not invalidate the vote as to the question

III.
Tha~ should a majority of the qualified voters
voting at said election vote in the affirmative as to the
question ftShall a Commission be chosen to frame a new charter?ft,
then, after the Charter Commission has completed its work and'
submitted the new charter that a second election'will be held,
at the date designated by the Charter Commission, in conformity
with law, to determine whether the new Charter shall be adopted.
IV.
The following qualified voters of the City of North
Richland Hills, Texas, are hereby appointed as officers for the
holding of said election:

The election officers above named shall make their
delivery and returns of said election in triplicate, one being
retained by the Presiding Judge and one delivered to the Mayor
and one delivered to the G-ity Secretary. The ballot boxes and
other election records and supplies shall be delivered to the
City Secretary at the office of sàid City and shall be preserved
in said office as provided by law. The ballot stub box shall be
delivered to the District Clerk of Tarrant qounty at the Court
House in Fort Worth, Texa~.1J The City C.ounc.1.l w11l'meet at 7:30
otclosk, P.M. on the .:! ""'A. day of 7J~., 1963, being not
less than five nor more ·tl1an seven days after the date of said
election, for the purpose of canvassing returns thereof.
VI.
The City Secretary is hereby directed to give notice
of said election which shall be signed by the Mayor and City
Secretary and shall state the purpose of the election, the
officers to be elected, and the Chief of Police shall post a
properly certified executed copy of this ordinance at the poll-
ing place herein provided for a period of not less than thirty
(30) days before the date of said election.
VII.
Said election shall be held and conducted in accor-
dance with the laws of the State of Texas.
VIIr.
The City Secretary shall prepare thé necessary ballot
to be used in carrying out the provisions of this ordinance,
and shall preserve in his office for a period of two years all
applications, notice of objections and other related papers,
filed in connection therewith.
IX.
The City Secretary shall publish a certified copy
of this Ordinance once in the Daily News Texan, ,the official
publication of the City of North Richland Hills, Thirty (30) days
before said election date.
X.
The fact that the present charter of said City is
inadequate and the importance of the proposed ordinance creates
an emergency and an imperative public necessity for the suspension
of the rules requiring ordinances to be read upon more than'one
days, and for the immediate taking effect of this ordinance, and
such rules are hereby suspended and it is ordered that this ordi-
nance shall take effect immediately upon its passage and approval.
