ORDINANCE NO. 142
AN ORDINANCE AMENDING ORDINANCE NO. 136, SECTION
V. AND FURTHER AMENDING SAID ORDIllANCE BY PROHIBIT-
ING THE PARKING AND LEAVING UNATTENDED, MOTOR VEHICLES
ON DRIVE-IN RESTAURANT OR ABUTTING PROPERTY, mE CRUISING,
RACING OR USING OF DRIVE-IN, OR ABUTTING PROPERTY AS A
SHORT CUT AND PROHIBITING THE LOITERING AT ANY LOCATION
ON A DRIVE- IN RESTAURANT OR ABUTTING PROPERTY.
SECTION V.
The following act or con4uct of any person or persons while
upon the premises of any drive-in restaurant, property adjacent thereto
or property adjacent to a public street or highway separating aaid drive-
in restaurant and adjacent property are hereby declared to be unlawful
and any persons found guilty of any such act shall be guilty of a mis-
demeanor and upon conviction shall be fined as provided by this ordinance;
(a) Leaving any motor ..hicle of any description unattended
without getting the consent of the operator of said restaurant or property
adjacent thereto as above described; in which event said vehicle may be
impounded subject to the usual impounding fees;
(b) While upon the premises of the aforesaid drive-in restaurant,
or property adjacent thereto, public highway or street adjacent thereto, or
property adjacent to a public street or highway separating said drive-in
restaurant and adjacent property, and operating a motor vehicle of any kind,
cruise or race said motor vehicle upon the afore described premises, or
utalize said premises as a short cut to any other street or adjacent property,
or to annoy or endanger any other person or property situated upon said
premises j
(c) For three (3) or more persons to congre8ate on t he premises
and linger or loiter" at any location on the premises of any drive-in res-
taurant or abutting property other than in the restaurant building or in
a legally parked motor vehicle.
Any motor vehicle found unattended upon any of the afore described
premises in violation of this ordinance, in the absence of actual knowledge
of the identity of the person responsible for leaving said motor vehicle
thereon unattended, shall be presumed to have been left unattended by the
person in whose name such motor vehicle is registered or by any person having
been observed operating said motor vehicle on more than one occasion within
a period of time not more than one week preceding said violation, and such
person or persons shall be held prima facie responsible for such violation.
