ORDINANCE NO. 169
AN ORDINANCE DETERMINING THE NECESSITY FOR AND ORDERING
AND PROVIDING FOR THE IMPROVEMENTS OF A fORTION OF THE NORTH
AND SOUTH SERVICE ROADS OF INTERSTATE LOOP 820 FROM RUFE
SNWW DRIVE TO HOLIDAY LANE IN NORTH RICHLAND HILLS, TEXAS 1
LETTING A CONTRACT TO THE TEXAS STATE HIGHWAY DEPARTMENT
FOR THE CONSTRUCTION OF SUCH IMPROVEMENTS AND' AUTHORIZING
ITS EXECUTION1 MAKING PROVISIONS FOR THE PURPOSE OF PAYING
THE INDEBTEDNESS THEREBY INCURRED1 MAKING PROVISIONS FOR
THE LEVYING OF ASSESSMENTS AGAINST ABUTTING PROPERTIES

A NOTICE OF THE ADmPTION OF THIS ORDINANCE WITH THE COUNTY
CLERK OF TARRANT COUNTY, TEXAS 1 DECLARING THAT THIS ORDIN-
ANCE AND ALL SUBSEQUENT PROCEEDINGS RELATIVE TO SAID STREET
IMPROVEMENTS ARE AND SHALL BE PURSUANT TO ARTICLE 1105b
OF VERNON*S TEXAS CIVIL STATUTES1 DIRECTING THE CITY
SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING
THE CAPTION OF SAME IN THE MINUTE BOOKS OF THE CITY COUNCIL
AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE
ORDINANCE RECORD OF THIS CITYr AND PROVIDING AN EFFECTIVE
DATEr
WHEREAS, it .is now apparent that a seevice road on the North
and the South side of Interstate Loop 820 between Rufe Snow Dr.ive
and Holiday Lane .in North Richland Hills, Texas is not only
des.irous, but necessary to future growth, and,
WHEREAS, the Texas Highway Department haB prepared plans
and specif.ications and est.imates of cost for the construct.ion
of the serv.ice roads of the hereinafter descr.ibed portions of
Interstate Loop 820 and the same having been exam.ined by the
City Council of the C,ity of North Richland Hills, Texas, and
found to be .in all matters and things proper, NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH
RICHLAND HILLS, TEXAS THAT:

I.
There ex.ists a publ.ic necessit~ for the construct.ion
of a service foad on the North and South sides of Zlaterstate
Loop 820, between Rufe Snow Dr.ive and Holiday Lane, being six-
tenths of one m.ilein le9gth,in North Richland H.ills, Tarrant
County, Texas.
II.
Each unit above described shall be and constitute a
separate and independent unit of improvementsand the assess-
ments here.in prov.ided for shall be made for the improvements
.in each un.it according to the cost of the improvements in that
unit and according to the benefits arising from the .improvements
.in that unit.
III¡.
The plans and specifications as promulgated by the
Texas Highway Department for the construction of the serv.ice
roads descr.ibed above are hereby approved and adopted.
IV.
Each of the above descr.ibedportions of streets and/or
service roads shall be improved by constructiog a service road
adjacent to and .immediately north of and a service road adjacent
to and immediately south of Interstate Loop 820, together with
combined concrete curbs and gutters and proper grade and line
where same are not already so constructed, together w.ith storm
sewers and drains and other necessary incidentals, and appurten-
anceS1 all of siid .improvements to be constructed as and where
shown on the pmans, and .in strict accordance with the plans
and spec.ifications as requ.ired by the Texas Highway Department.
V.
The Texas Highway Department has est.imated the construc-
tion cost of both serv.ice roads as heretofore part.icularly
described, to be $112,600.00 and have offered to build both
service roads for the C.ity if the City will furnish $24,000.00
of these construction costs. The City Manager and Secretary
are hereby directed to execute the said contract in the name
of the City of North Richland H.ills, Texas, and to impress the
corporate seal of the City thereon, at such times as the assess-
ment procedures aga.inst the abutting property holders have been
completed.
VI.
To provide for the payment of the indebtedness .in-

curred by the C.ity of North Richland Hills, Texas, by said
contract, the abutting property owners to said service roads
are to be assessed an amount sufficient to pay said .indebted-
ness ào incurred.
VII.
The cost of said improvements as here.in def.ined
shall be paid for as follows, to-wit:
(a) The real and true owners of the property abutt-
ing the respective service roads shall pay all of the costs of
curbs and gutters in front of their respective property and
not exceed.ing nmne-tenths of the estimated cost of the remainder
of the total construction of the service roads.
(b) The City of North Richland Hills shall pay over
to the Texas Highway Department the $24,000.00 after same has
been assessed aga.inst the respective property owners.
The amounts payable by the abutting properties and
the real and true owners thereof shall be assessed against such
properties and the real and true owners thereof and shall con-
stitute a f.irst and prior lien upon such properties and a
personal l.iability of the real and true owners thereof, and
shall be payable as follows, to wit:
When the improvements are completed and accepted by
the City on a particular unit, the sums assessed against pro-
perty abutt.ing upon such completed and accepted unit shall be
and become payable in five equal .installments, due respectively
on or before thirty (30) days one (I), two (2), three (3) and
four (4) years from the date of such completion and acceptance,
and the assessments against the property abutting upon the
remain.ing un.its shall be and become due and payable .in such
installments after the date of the completion and acceptance
of such respective unit. The entire amount assessed against
the part.icular parcels of property shall bear interest from
the date of such completion and acceptance of the improvements
of the unit upon which the particular property abuts at the
rate of eight per cent (8%) per annum, payable annually except
as to interest on the first installment, which shall be due
and payable on the date said installment matures, prov.ided
that any owner shall have the r.ight to pay any and all such
installments at any time before maturity by paying principal,
w.ith interest accrued to the date of payment, and further pro-
vided if default be made in the payment of any installment
promptly as the same matures, then at the option of the City
of North R.ichland Hills or .its ass.igns, the entire amount of
the assessment upon wh.ich default is made shall be and become
immediately due and payable 7 but it is specifically provided
that no assessment shall in any case be made aga.inst any pro-
perty or any owner thereof in excess of the special benef.i ts
to property .in the enhanced value thereof by means of said

improvements .in the unit upon which the particular property
abuts, as ascertained at the hearing provided by the law in
force in the City, nor shall any assessments be made .in any
case until after notice and hear.ing as provided by law. Said
assessments against the respect.ive lots and parcels of pro-
perty and owners thereof shall be evidenced by certificates
of special assessment which shall be executed in the name of
the C.i ty of North Richland Hills, PROVIDED however, that the
C.ity of North Richland Hills retains the right to authorize
payment of the sums assessed aga.inst property abutt.ing upon
such completed and accepted unit in a period of not more
than four years .in equal regular installments of not less
than $10.00 each, the first of such installmeat. to become
due and payable not more than thirty days after the completion
and acceptånce by the City of the particular unit~ PROVIDED
FURTHER, that such method of paymedks shall be authorized
only in instances where the owner or owners of property abutting
upon such completed and accepted unit shall have executed and
del.ivered to the City of North Richland Hills a lawful, valid
and bind.ing note and mechanic's and materialman's contract
upon forms supplied by the City granting a mechanic's lien
upon and conveying the said abutti9g property in trust to
secure the payments by said owner or owners acoording to the
terms thereof of the sums assessed against such property.
VIII.
The assessments against the respective lots and·
parcels of property and the owners thereof shall be ev.idenced
by certificates of special assessment, which shall be executed
in the name of the City by the Mayor of said City, and the
City Secretary shall attest the same and impress the corporate
seal of the City thereon, and which may have attached thereto
coupons in evidence of several installments, which the assess-
ment is payable, which certificates shall be issued to the
City of North Richland Hills, shall recite the terms and time
of payment, the amount of the assessment, the description of
the property, and the name of the owners, as far as known, and
shall conta.in such other recitals as may be pertinent thereto,
and shall fu~hàer recite substant.ially that all proceedings
with reference to the making of such .improvements have been
regularly had in compl.iance with law, and that pre-requ.isites
to the f.ix.ing of the assessment lien against the property
described in said certificates and the personal liability of
the owners thereof, have been regularly had, done and performed,
and such rec,itals shall be prima facie evidence of the matters
so recited, and no furtàer proof thereof shall be required in
any court, and the said certificates shall provide substantially
that if default be made in the payment of any installment
promptly as the sam. matures, then, at the opt.ion of the City
of North R.ichland Hills, or its assigns, bhe entire amount
of the assessment shall be and become immediately due and pay-
able, together with reasonable attorneys' fees and costs of
collect.ion, if incurred, all of which, as well as the principal
and interest on the assessment, shall be a f.irst and prior

lien aga.inst the property, superior to all other liens and claims
except State, County, School District and City ad valorem taxes.
No error or mistake in nam.ing any owner or in describing any
property or in any other matter or thing, shall invalidate
any assessment or any certificate ~ssued in evidence thereof,
and the omission of improvements on any particular uniE or in
front of any property exempt by law from the lien of spec.ial
assessment for street improvements shall not invalidate any
assessment levied. The certificates referred to need not contain
recitals in exactly the words above provided for, but the
substance thereof shall suffice, and they may contain other
and additional recitals pertinent thereto.
IX.
The City Manager of the City of North Richland Hills,
Texas, be and is hereby, ordered and directed to file w.ith the
City Council, ev.idence of the estimates of cost of such .improve-
ments as have been furnished by the Texas Highway Department.
X.
The City Secretary .is directed to prepare, sign and
file with the County Clerk of Tarrant County, Texas, a notice
in accordance with the provisions of Article 1220a of VernonJs
Texas C.ivil Statutes and amendme~s thereto.

XI.
The improvements provided for herein shall be made
and constructed, notice given hearing held and assessments
levied and all proceedings taken and had in accordance with
and under the terms of the powers and provisions of Chapter
106 of the Acts of the F.irst Called Session of the Fortieth
Legislature ef the State of Texas, now shown as Article 1l05b
of Vernon's Texas C.ivil Statutes, which law~has been adopted
as an amendment to and made a part of the Charter of the City
of North Richland Hills, Texas, and under which law these
proceddings are taken and hàd.
XII.
The City Secretary is hereby directed to engross and
enroll this ordinance by copying the caption of same in the
Minute Book of the City Council and by filing the complete
Ordinance in the appropriate Ordinance Records of this City.
XIII.
Th.is ordinance shall take effect and be in full force
and effect fÐom and after the date of its passage and it is so
ordained.

NOTICE
The City Council of the City of North Richland
Hills, Tarrant County, Texas, has heretofore passed an Ord.inance,
be.ing Ord.inance Number 169, on the 24 day of July, 1967,
declaring a Publ.ic Necessity for the construction of a
serv.ice road on the North side of Interstate Loop 820 and on
the South side of Interstate Loop 820, being approximately
six-tenths of one mile .in length, each, said service roads
to be constructed between Rufe Snow Drive and Hol.iday Lane in
the City of North R.ichland Hills. A portion of the cost of the
cost of the construction of the said service roads w.ill be
assessed as a lien upon the property of the real and true
owners of the property abutt~ng the service roads to be constructed.
The C.ity Secretary .is hereby directed to file this
notice with the County Clerk of Tarrant County, Texas.
