HomeMy WebLinkAboutOrdinance 0171 ORDINANCE NO. 171 AN ORDINANCE ESTABLISHING A BOARD OF EQUALIZATION FOR THE CITY OF NORTH RICHLAND HILLS, TEXASr PROVIDING FOR THE QUALIFICATION OF THE MEMBERS AND THE METHOD OF SELECTING A CHAIRMAN AND SECRETARY, DEFINING A QUORUMr -AND FURTHER PROVIDING FOR THE COMPEN- SATION TO BE PAID THE MEMBERSr FOR THE PROVIDING FOR THE MEETING DATE OF SAID BOARDr FURTHER DEFINING THE DUTIES OF SAID BOARD AND THE NOTICES TO BE GIVEN TO THE AFFECTED PROPERTY OWNERSr PROVID- ING FOR A SAVING CLAUSE AND AN EFFECTIVE DATE. WHER~AS, pursuant to the provisions of the Charter of the City of North Richland Hills, County of Tarrant, State of Texas, the City Council of said city deems it advisablè to establish a BOARD OF EQUALIZATIONr NOW, THEREFORE¡ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, COUNTY OF TARRANT, TEXAS: SECTION I MEMBERSHIP: The original Board of Equalization is hereby appointed and shall be composed of three members, each of whom shall be a qualified voter and real property owner in the City of North Richland H.ills, Tarrant County, Texas, none of whom shall be members of the C.ity Council. SECTION II CHAIRMAN AND SECRETARY: The Board of Equalization shall~choose from its membership a chariman and a secretary, ne.ither of whom shall be the Assessor-Collector of Taxes for said city. SECTION III QUORUM: A majority of the members of said Board shall constitute a quorum for the transaction of business. SECTION IV COMPENSATION TO MEMBERS: The amount of compensation to be pa.id the members of said Board shall be determined by the City Council from t.ime to time. SECTION V BOARD MEETING DATES: The first meet.ing of said Board of Equalization shall be held on the first day of September, 1967 at 7:00 P.M., and the regular Annual Meeting shall be the second Monday in May of each year. After the first meeting, the Board may reconvene and adjourn from time to time, as long thereafter as may be necessary to transact the business under the jurisdiction of said Board, provided that said Board shall be finally adjourned by the last day of the month in which the meeting was specially or regularly called. SECTION VI NOTIFICATION OF AFFECTED PROPERTY OWNERS: Whenever the Board of Equalization f.inds it their duty to raise the value of any property appearing on the tax list or tax records of said City, it shall, after having examined such lists and records and corrected all errors therein, adjourn to a day not less than ten däys nor more than fifteen days from the date of adjournment, and shall cause the secretary of sàid Board to g.ive written notice to the owner or owners of such property or all others claim.ing any interest therein, which may reasonably be determined from official records, or to the person rendering same at the time the said Board adjourned, and that such owners, interested person or persons rendering said property may at the t.ime of sa.id hear.ing appear and show cause why the value of sá~d property should not be raised. SECTION VII NOTICE: Notice shall be sufficient if made by deposit- ing sa.id notice, properly addressed and posted, in the United States Mail. SECTION VIII "'"' POWERS AND DUTIES: It shall be the duty of such Board to examine and, .if necessary, revise the assessments as returned by the City Assessor-Collector, to the end that all property within the City shall be assessed as fairly and as uniformly as possible. The Board of Equalization shall also have the power to: (I) Rev.iew on complaint of property owners assessments for the purpose of taxation of both real and per- sonal property within the City made by the City Assessor- Collector1 (2) Administer oaths1 (3) Take testimonYT (4) Hold hear.ings1 (5) Adopt regulations regarding the procedure of assessment rev.iewT (6) Compel the production of all books, documents, and other papers pertinent to the investigation of the taxable values of any person, firm or corporation having or own.ing property with.in the corporate limits of the City subject to taxation. .;s " J -2- SECTION IX RECORDS AND ROLLS: The Board shall be requ.ired to keep an accurate record of all its proceedings, which shall be available for public inspection. Immediately upon comple- tion of its work, the Board shall certify its approval of the assessment rolls, whlãh shall be returned to the City Council, which shall thereupon approve the said rolls as returned to it and thereupon adopt the same as the assessment rolls to be used for the collect.ion of taxes for the current year. SECTION X SAVING CLAUSE: It is the intent.ion of the City Counc.il that each separàte provision of this Ordinance shall be deemed independent of all other provisions herein, and it is further the intent.ion of the City Council that if any provision of this ordinance is declared invalid, all other provisions thereof shall remain valid and enforceableo SECTION XI EFFECTIVE DATES: This Ordinance shall become effective and valid on the 14th day of Auqust , 1967.
