HomeMy WebLinkAboutOrdinance 0113 ORDINANCE NO. #~ AN ORDINANCE FIXING, ESTABLISHING AND DETER- MINING A PORTION OF THE BOUNDAHY LINE BETWEEN THE CITY OF NOHTH HICHLAND HILLS, TEXAS, AND THE CITY OF HUHST, TEXAS, PUHSUANT TO AN AGREE- MENT BETWEEN THE GOVERNING BODIES OF THE TWO CITIES; DIRECTING THE PUBLICATION OF SAID ORDI- NANCE IN THE OFFICIAL NEWSPAPER OF THE CITY; PROVIDING THAT THE ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES AFFECTING THE LIMITS OF THE CITY WHEN NOT IN CONFLICT HEREWITH; PRESCHIBING A SAVINGS CLAUSE AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NOHTH RICHLAND HILLS, TEXAS: Section I That a portion of the boundary line between the City of North Richland Hills, Texas, and the City of Hurst, Texas, shall be fixed, established and determined as follows, to with: BEGINNING at a point in the present City limit line between the cities of North Hichland Hills and Hurst, said point being in the North line of the W. Wallace Survey Abstract 1706, 634.5 feet East of the North- west corner of said Wallace Survey, said point also being 1815 feet, more or less North of the present North R.O.W. line of Bedford-Euless Road; \ TH~NCE East along the North line of said W. W. Wallace Survey ,284.0 feet to a point; THENCE South 9 deg.·16 min. East 106.5 feet to the Northeast corner of Lot 7, Block 8, Woodcrest Addition to the City of North Rich1and Hills as recorded in Volume 388-32, page 4, Deed Records, Tarrant County, Texas, and continuing a total distance of 212.1 feet to a point; THENCE South 0 deg. 04 min. West 525 feet to the Southeast corner of Lot 2-R, Block 8, said Woodcrest Addition; THENCE South 30 deg.27 min. West 160.1 feet to a point; THENCE South 31 deg. 40 min. West 50.3 feet to a point, said point being the North- east corner of Lot 9, Block 9, Woodcrest Addit~on, section 2, as recorded in Volume 388-25, page 16, Deed Records, Tarrant County, Texas; THENCE.Soúth 4.0 deg. 53 min. West along the Eástern line of said Lot 9, 13$.0 feet to its ~outheast corner; THENCE South 30 deg. 13 min. West along the Easterly line of Lots $ and 7, Block 9, 173.0 feet to the Southeast corner of said Lot 7; THENCE South 9 deg. 29 min. West along the Easterly line of Lots 6 and 5, said Block 9, 1$0.0 feet to a point in the exist- ing city limit line between the cities of North Richland Hills and Hurst, said point being the Southeast corner of Lot 5, Block 9, said Woodcrest Addition, said point also being 447.0 feet North of the present North R.O.W. line of Bedford-Eùless Road. Section II This Ordinance shall be cumulative of all previous and prior ordinances adopted by the City Council of the City of North Richland Hills, Texas, relating to the matter of fixing, determining and establishing the territorial limits of the City and the annexation of territory to the City and all of those ordinances shall remain in full force and effect except in the instance or instances where the provisions of this ordinance are in direct conflict with the provisions of said previous and . prior ordinance or ordinances, and in such instance or instances, the provisions of the previous and prior ordinances are hereby expressly repealed, but only to the extent that the conflict or conflicts exist, and all remaining provisions of said ordinance or ordinances shall remain in full force and effect. . Section III- That this ordinance shall be published in the official newspaper of the City of North Richland Hills, Texas. Section IV The provisions of this ordinance are severable. If any section or portion of a section of this ordinance shall for any reason be declared)invalid, unconstitutional or in- operative by a court of competent jurisdiction, such decision or adjudication shall not affect the validity of any other section or portion of a section of this ordinance, but the remainder of the ordinance shall be given effect the same as if the invalid, unconstitutional or inoperative section or part of a section had not been included. It is the intention of the City Council in adopting this ordinance, to enact the valid portions distinct from any invalid portions, and they hereby declare that they would not have included any invalid, unconstitutional or inoperative provision in the ordinance had they known of the existence of such invalid, unconstitutional or inoperative provision at the time the ordinance was adopted. Section V This ordinance shall become effective and be in full force and effect from and after the date of its adoption and publication as by law provided. ADOPTED this.
