HomeMy WebLinkAboutOrdinance 0111 NO. / / / AN ORDINANCE CREATING A HEALTH DEPART MENT, GRANTING POVlER TO APPOINT A HEALTH OFFICER AND HEALTH INSPECTOR, SETTING FORTH THE DUTIES OF THE HEALTH OFFICER, REQUIRING REPORTING OF CONTAGIOUS DISEASE, MAKING IT UNLAÇ<lFUL TO SELL Um-ffiOLESOME FOOD, MAKING IT UNLAWFUL FOR PREMISES TO BE KEPT IN AN UN- CLEAN OR UNSANITARY CONDITION, FORBIDDING OBSTRUCTION OF A SOURCE OF WATER SUPPLY FOR THE CITY, DECLARING STAGNATE WATER A NUISANCE, MAKING IT UNLAWFUL TO Dm~ UNCOVERED RUBBISH, MAKING IT UNLAWFUL TO ESTABLISH A CEMETARY í\TITHIN THE CITY LIMITS OR \nTHIN A MILE THERE- OF, MAKING IT UNLAWFUL TO MAINTAIN COMMON DRI~~ING CUPS, REQUIRING UTENSILS FOR USE IN PUBLIC PLACES TO BE STERILIZED, FORBIDDING THE MAINTENANCE OF A NUISANCE, MMZING IT UN- LAHFUL TO SPIT ON A SIDEHALK OR ANY PUBLIC PLACE, PRESCRIBING THE PENALTY THEREFOR. I There is hereby created a Health Department for the City of North Richland Hills, and there is further appointed a Health Officer and as many Health Inspectors as may be deemed necessary by the City Council. II It shall be the duty of the Health Officer to enforce all provisions of this Health Ordinance, as well as any State, Federal or County regulations pertaining to health. III The Health Officer is hereby authorized to enter into all houses and other places, private or public, at all times in the discharge of his duties, having first asked permission of the owners or occupants. IV The owner, driver, conductor or person in charge of any stage, railroad car or public conveyance which shall enter the City, knowingly having on board any person sick of a malignant fever, or pestilential, contagious or infectious disease, unless such person become sick on the way and could not be left, shall, within three hours after the arrival of such sick person, report in writing the facts, with the name of such person and the house where he was put down in the City, to the Health Officero V Every keeper of a hotel, boarding or lodging house in the City, in which any inmate thereof shall be sick with any infectious or pestilential disease, shall upon such fact coming to his know- ledge, forthwith report the same to the Health Officero Every physician in the City shall report, under his hand, to the officer above named, the name, residence and disease of every patient whom he shall have sick of any infectious or pestilential disease, within six hours after he shall have visited such patient. VI It shall be unlawful to sell or offer for sale any unwholesome or polluted food or drink of any kind in the City. VII All premises used in the sale or storage of food or drink intended for human consumption shall be kept in a clean and sanitary condition. It shall be unlawful to permit any person who is afflicted with a contagious disease to handle any food or drink intended for human sale. Premises shall be kept free from flies and vérmin of all kinds. VIII It shall be unlawful and a nuisance for any person, firm or corporation to obstruct or pollute any watercourse or source of water supply in the City. IX Any stagnant pool of water in the City is hereby declared to be a nuisance. It shall be unlawful for any person, firm or corporation to permit any such nuisance to remain or exist on any property under his or its control. X It shall be unlawful for any person, firm or corporation to deposit anywhere in the City any uncovered piles of refuse, gar- bage, offal or carcasses of dead animals. Such refuse must be buried at least two feet below the surface of the ground or burned in properly constructed incinerators or otherwise properly dis- posed of. Any uncovered pile of refuse is hereby declared to be a nuisance. XI It shall be unlawful for any person, firm or corporation to establish a cemetery or to bury any person within the City limits, or within a mile thereof except in an established cemetery. XII It shall be unlawful to permit any building, structure or place, to remain in such a condition as to be dangerous to the public health in any way. Any such structure, building or place, is hereby declared to be a nuisance. XIII It shall be unlawful to commit or do any act which endangers the public health or results in annoyance or discomfort to the public. XIV It shall be unlawful to maintain any common drinking cup, or cups, dipper or other similar utensil, for the use of more than one person in any public hall, theater, store or other place fre- quented by the public. 1.'V Utensils for personal use in all places serving food or drink to the public shall be thoroughly cleaned and sterilized after each such usage. XVI It shall be unlawful for any person, firm or corporation to permit or maintain the existence of any nuisance on any property under his, her, or its control. The Chief of Police and the Health Officer are each hereby authorized to abate any such nuisance exist- ing in the City, whether such nuisance is specifically recognized by ordinance or not. XVII It shall be unlawful to spit or expectorate on any public sidewalk or other public place, or on the floor or walls of any store, theater, hall, public vehicle, or other place frequented by the public or to which the public is invited. XVIII Any person, firm or corporation violating any provision of this article shall be fined not less than ONE DOLLAR ($1.00) nor more than TllO HUNDRED DOLLARS ($200.00) for each offense; and a separate offense shall be deemed committed on each and every day during or on which a violation occurs or is permitted to continue.
