HomeMy WebLinkAboutOrdinance 2208 ORDINANCE 2208 AN ORDINANCE REZONING PROPERTY IN ACCORDANCE WITH ARTICLE 2, SECTION 200, OF ZONING ORDINANCE NUMBER 1874, PASSED, APPROVED AND ADOPTED BY THE CITY COUNCIL ON MARCH 22, 1993; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City has received a request for a change in zoning district boundaries; and WHEREAS, after appropriate notice and public hearing, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for amendment of Ordinance No. 1874 and the Official Zoning Map by rezoning certain property as set forth herein; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: 1. THAT, in Case Number PZ 97-20, the following described property shall be rezoned from R-3 Single Family Residential to C-2 Commercial. SITUATED in the City of North Richland Hills, Tarrant County, Texas and being a tract of land out of the M. Lynch Survey, Abstract No. 953, said tract being a portion of that parcel of land conveyed to Joyce E. Pennington by deed as recorded in Volume 10635, Page 2270 of the Deed Records of Tarrant County, Texas (D.R.T.C.T.), said tract being herein more particularly described by metes and bound as follows: BEGINNING at an iron rod set at the southwest corner of the said Pennington tract: THENCE, North 00 degrees 05 minutes 42 seconds East, along the westerly property line of the said Pennington tract and along an easterly property line of a tract of land conveyed to Richard Algood by deed as recorded in Volume 9282, Page 957 of the D.R.T.C.T., 105.54 feet to an iron rod set on existing southerly right-of-way line of Harmonson Road; THENCE, South 89 degrees 37 minutes 29 seconds East, along the said southerly right-of-way 549.86 feet to an iron rod set for corner; THENCE, South 44 degrees 40 minutes 11 seconds East, along the said right-of-way line, 14.15 feet to an iron rod set for corner; Ordinance No. 2208 Page 1 THENCE, South 00 degrees 17 minutes 08 seconds West, along the existing westerly right-of-way line of Rufe Snow Drive, 99.98 feet to a point on the southerly property line of the said Pennington tract and on a northerly line of the said Algood tract; THENCE, North 89 degrees 10 minutes 13 seconds West, along the said property lines, 559.53 feet to the POINT OF BEGINNING. 2. That the Official Zoning Map be redrawn to incorporate this zoning district boundary amendment and the herein described ordinance number be affixed to the property described herein. 3. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentencesJ clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clauseJ sentence, paragraph or section. 4. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage.
