HomeMy WebLinkAboutOrdinance 2210 ORDINANCE NO. 2210 AN ORDINANCE BY THE CITY OF NORTH RICH LAND HILLS, TEXAS, AMENDING ORDINANCE NUMBER 1874, THE COMPREHENSIVE ZONING ORDINANCE, TO AMEND THE MINIMUM DWELLING UNIT SIZE IN THE R·1, R·1·S, AND R·2 DISTRICTS, TO AMEND THE MINIMUM LOT WIDTH IN THE R-2 DISTRICT, AND TO ESTABLISH A MINIMUM DRIVEWAY ENTRANCE DISTANCE IN ALL RESIDENTIAL DISTRICTS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has determined the need to amend the minimum dwelling unit size in certain residential districts, and to amend the minimum lot width in certain residential districts, and to establish a minimum driveway entrance distance in all residential districts, and WHEREAS, after appropriate notice and public hearing, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for amendment of Ordinance No. 1874 by changing said Zoning Ordinance as set forth herein; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICH LAND HILLS, TEXAS: 1. THAT, Section 410,C,4, Minimum Dwelling Unit Size, be hereby amended as follows: A. R-1 District: 2,300 sq. ft. minimum dwelling unit size on lots platted after January 1, 1998. Platted lots existing prior to January 1, 1998 shall have a minimum dwelling unit size of 2,000 sq. ft. B. R-2 District: 2,000 sq. ft. minimum dwelling unit size on lots platted after January 1, 1998. Platted lots existing prior to January 1, 1998 shall have a minimum dwelling unit size of 1,800 sq. ft. 2. THAT, Section 420,C,6, Minimum Dwelling Unit Size, be hereby amended as follows: R-1-S District: 2,300 sq. ft. minimum dwelling unit size on lot platted after January 1, 1998. Platted lots existing prior to January 1 1998 shall have a minimum dwelling unit size of 2,000 sq. ft. 3. THAT, Section 41 0,C,2a, Minimum Lot Width, Interior Lots, be hereby amended as follows: Ord.2210 Page 1 The minimum lot width for an interior lot in the R2 District on lots platted after January 1, 1998 shall be 72.5 ft. 4. THAT, the minimum distance between a side or rear property line and a garage entry shall be 20.5 feet in all residential zoning districts or in any residential planned developments. 5. THAT, the required front yard set-back in the R-2 District shall be 20 feet. 6. THAT, Section 1100, Definitions, is hereby amended to insert the following: Rear Yard Open Space - An area reserved as an open space in the rear portion of a yard which extends from one side property line to another side property line and abutting the rear property line. The rear yard open space shall not protrude beyond the two most extreme corners of the main structure and no part of a residential dwelling unit may be constructed so as to occupy any portion of the rear yard open space. 7. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. 8. SAVINGS CLAUSE. That Ordinance Number 1874, the Comprehensive Zoning Ordinance of the City of North Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. 9.
