AN ORDINANCE AMEND ING SECTION 14 OF ORDINANCE
NO. 30 BY ELIMINATION OF THE SECOND PROVISO OF
SAID SECTION OF SAID ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
Section I. Section 14 of Ordinance No. 30 IS hereby
amended by el iminat ing therefrom the second proviso of said sect ion t.,

Section 14. No person shal 1 be appointed to any
office herein created unless he (or she) shal J be a
qual ¡fied voter within the city and shal] have resided
within the corporate limits of the city for six (6)
months and within the state of Texas for one (l) year
next preceding the date of appointment; provided,
however, that the City Council may, jn its exclusive
d~scr,¡¡.tion, waive this requirement in the appointm~nt
of ~ MarshaJ. who shall hereafter be known as Chief
of Police. '
Section 2. This ordinance shall be effective from and
after its passage.
PASSED on this 25th day of July, 1960, by a vob':of four
for, against none, absent one.

Gentlemen:
Your Petitioner herein, O. & P. Corporation, a corporation, actinß by and through
its President, would show and represent as follo~s:
That your Petitioner has heretofore maòe and filed for record the Plat and Dedica-
t50n of Snow Heights Addition, Second Filing, to the Town of North Jdchland Hills,
Tarrant County, Texas, as is ShO'l-.111 by the Hap or Plat of record in Vol. .'388-22, pg.
68, Plat or Deed Records, Tarrant County, Texas, and has also made and filed for record
the Plat and Dedication of Snow Heights Addition, Third Filing, to t.he Town of North
Richland Hills, Tarrant County, Texas, as Shov111 by the Map or Plat of record in Vol.
388-22, pg. 70, Plat or Deed Records, Tarrant County, Texas.
That subsequent to the
making and filing of each of said above described Plats and Dedications, the State of
Texas, acting by and through the State Highway Commission, has deemed it necessa~ to
acquire for the purposes of facilitating the construction, maintenance and operation
of a Controlled Access Highway Facility the following described property from your
Petitioner for public highway and road purposes, to-wit:
Situated in Tarrant County, 'T'exas, and being:
PARCEL 1:
A tract of land in the ͡v. v.!. \ATALLACE SURVEY, Abst. No. 1606, being a part of that
portion of said Wallace Survey, deeded to the 0.& P.Corporation as rec. in Vol. 33l4,pg.
87 of the Deed Records, Tarrant County, Texas, and more particularly described by metes and
bounds as follows:
BEGINNING at a point on the existing east right of way line of Rufe Snow Drive, said
point being on the proposed south right of way line of proposed Loop Highway 217 opposite
to center line Sta. 890+35.92, and being N 0 deg. 04 min. W 261 ft. along EL of Rufe Snow
Drive from the ~NC of tract described in deed to O. & P. Corporation, Vol. 33l4,pg. 87,
Deed Records, Tarrant County, Texas;
THENCE N 0 deg. 35 min. E along the existing east right of way line of Rufe Snow Dr. a
distance of 390.oL ft. crossing the highway center line at Sta. 890+38.61 to a point on
the existing east right of way line of said Rufe Snow Drive, said point also being on the
proposed north right of way line of said proposed highVJay, opposite to center line Sta.
890+41.30;

30.0 ft. to a point opposite to center line sta. 890+71.30;
THENCE S 45 deg. 12 min. East a distance of 28.28 ft. to a pt. on the proposed North
right of way line that is 175.0 ft. normal from the center line of said highway at Sta.
890+91.30;
THENCE N 89 deg. 48 min. E along the proposed North right of way line a distance of
672.73 ft. to a point opposite center line Sta. 897+64.03, said point also being the
beginning of a circular curve to the right having a radius of 5904.58 feet;
THENCE Southeasterly along said curve through a central angle of 16 deg. 33 min. 21
sec. a distance of 1706.15 ft. to a point in the east property line of said o. & p. Corp.
tract, said point being on the proposed north right of way line opposite to center line

THENCE South 0 deg. 16 min. 39 sec. west a distance of 365.21 ft. along the said east
propeDty line, crossing the proposed highway center line at Sta. 914+70.12 to a point on
the proposed south right of way line opposite to center line Sta. 915+ 23.94, said point
lying 41.47 ft. N 0 deg. 16 min. 39 sec. E from a re-entrant corner of C. & P. Corpora-
tion t s property;
THENCE in a northwesterly direction on the proposed south right of way line of said
highway on a circular curve to the left having a radius of 5S54.58 ft., through a central

south right of way line opposite to center line Sta. 897+64.03;

right of way line that is 195.0 ft. normal from the center line of said highway at Sta.

THENCE S 89 deg. L8 min. W a distance of 30.0 ft. to the place of beginning and
containing 19.574 acres, more or lass.
PARCEL 4:
A tract of land in the W. W. Wallace Survey, Abstract No. 1606, being a part of
that portion of said Wallace Survey deeded to the O. & P. Corporation as recorded in
Vol.3314, pg. 81 of the Deed Records, Tarrant County, Texas, and more particularly des-
cribed by metes and bounds as follows:
BEGINNING at the northeast corner of the O. & P. Corporation property and also being
the southeast corner r:L a tract of land deeded to Corinne Bogart Jackson as rec. in Vol.
3160, pg. 150, Deed R3COrdS, Tarrant County, Texas;
THENCE SOUTH 0 deg. 04 min. 1¡,T a distance of 261.98 ft. along the Eastþ1"opérty line
of the O. & P. Corporation to a point on the proposed south right of way line opposite to
center line Sta. 923+74.07;
THENCE in a Northwesterly direction on the proposed south right of way line along a
circular curve to the left having a radius of 5554.58 ft. through a central angle of 7 deg.
07 min. 11 sec. a distance of 690.23 ft. to a point on the O. & P. Corporation's North
property line opposite to center line Sta. 916+61.83;
THENCE S 89 deg. 59 min. E along said north line a distance of 638.29 ft. to the
point of beginning and containing 1.806 acres of land, more or less.
That said above described property deemed necessary and being acquired by the State of
Texas from your Petitioner for road or highway purposes crosses and is upon a portion of
Blocks 9, 11 and 20 of Snow Heights Addition, Second Filing, to the Town of North
Richland Hills, Tarrant County, Texas, and is upon and crosses a portion of Blocks 20,
23, 24, 25, 26, 27, 26 and a portion of the area marked and reserved for community
center, Snow Heights Addition, Third Fïling, to the Town of North Richland Hills, Tarrant
County, Texas, and also includes and covers that portion of the streets and the area
marked and reserved for the construction and maintenance of public utilities which are
within the right of way area being so acquired by the State of Texas as hereinabove
described.
That none of the area platted and dedicated on either the above described Map or
Plat of Snow Heights Addition, Second Filing, or the above described Map or Plat of Snow
Heights Addition, Third Filing, either as a road, street or public highway or as an
easement for the construction and maintenance of public utilities has ever been laid
out on the ground or grad~d, improved or used by any person as such public street, road
or highway and no utilities, whatsoever, have ever been erected or constructed upon, over,
across or under any portion of the area so designated or reserved on either of said two
Maps or Plats as easements for the construction and maintenance of public utilities.
WHEREFORE, your Petitioner respectfully requests that by proper ordinance by the City
of North Richland Hills vacate and close as a public road, street or thorough-fare any
and all portion of those streets, roads or thorough-fares as platted and dedicated in

said Snow Heights Addition, Second Filing, as shown by Map or Plat of record in Vol.
388-22, pg. 68, Deed Records, Tarrant County, Texas, and in Snow Heights Addition,
Third Filing, as shown by Map or Plat of record in Vol. 388-22, pg. 70, Deed Records,
Tarrant County, Texas, insofar, as said streets, roads or highways are within the area
of the hereinabove described property being acquired by the state of Texas for road or
highway purposes, and that the area shown and dedicated on each of said two plats or maps
reserved
of Snow Heights Addition as easement/for public utilities, insofar, as same are includ-
ed in the above described area being acquired by the State of Texas, be abandoned and
terminated as such easements.
