Home My WebLink AboutOrdinance 0080 I . . .- ORDINANCE NO. 80 -- AN ORDINANCE REGULATING HOUSE MOVING CONTRACTORS OPEfu\TING ON THE STREETS OF THE CITY OF NORTH RICHLAND HILLS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS THAT in addition to any ordinances now in effect regulating house moving contractors, the following shall be passed, approved and adopted by the City Council of North Richland Hills, Texas. SECTION 1. LICENSE AND BOND. No person, firm or corporation, except a licensed house mov'er, shatl move any building or structure over, across or along any street, public way or public place within the corporate limits of the City of North Richland Hills except as herein- after specifically provided: A. Every person, firm or corporation shall, before engaging in moving a building or structure, make application to the City Secretary for a license and such license shall have been approved and issued for the current year. Fee for such license shall be TEN ($10.00) DOLLARS, payable on the first day of January of each year, or at time of issuance. . B. Before such license is issued, the applicant shall file with the City Secretary a surety bond in the amount of TWO THOUSAND DOLLARS ($2,000.00), saving and protecting the City of North Rich1and Hills harmless from any and all damages and to pay for any and all damages to public property, that may arise from the use of any of the streets, alleys, boulevards or other public places in the moving of any building or structure. Such bond shall contain a provision for a ten day written notice to the City of cancellation by the surety. C. Before such license is issued, the applicant shall file with the City Secretary a pUblic liability and property damage insurance policy certificate naming the applicant as the assured and providing for the payment of any liability imposed by law upon such applicant to the extent of TEN THOUSAND DOLLARS ($10,000.00), for each person for bodily injury and FIFTY THOUSAND DOLLARS ($50,000.00), for bodily injury liability for each accident and FIVE THOUSAND DOLLARS ($5,000.00), for property damage liability for each accident. . D. Upon execution of said bond and certificate of insurance and their approv~l by the City Secretary, the Chief òf Police shall inspect, or cause to be inspected, the equipment and facilities to be used, by the house moving contractor and shall determine that the size, desig~ and safety factors of any vehicle or vehicles and other equipment usea in the moving of any building or structure, are such that their operatio~ on public property shall not cause damage to the pavement or other public equipment, the payment of the license fee, the license shall be issued to the person, firm or corporation applying therefore, and he shall there- after be known as a lice,~o,;-~:e.~:~o~¥taiiìtractor. SECTION III. PERMIT. No person, firm or corporation shall move any building or structure over, across, or along any street, public way or public place within the corporate limits of the City of North Richland Hilla until a permit for such work has been issued as provided herein: . I e . . . '. A. Such licensed house mover shall in each case before moving or preparing to move any building or structure, apply to the City Secretary by written application for a permit to do so, in which application the bUilding or structure to be moved shall be described with the extreme dimensions of its width, length, and heighth, present location, the place to which it is proposed to be moved, and tho location on the lot at the destination. B. Before such application for permits is made, the house mover shall notify the public utilities, railroads, and other persons, firms, or corporations whose facilities are involved in such movement. C. Before such application for permits is made, the house mover shall notify the police department and fire department, and shall obtain proper clearance from each of these departments in writing. Thia clear- ance shall specify the day of the week, hour of the day, the moving is to take place. The route to be taken shall be at the discretion of the pOlice department. D. If it becomes temporarily necessary to leave the building on public property, there shall be placed around the building or structure, and all equipment, red lanterns, flares or other warning devices. No building or structure under any condition shall be allowed to remain in or on the streets, public ways or public places for more than twenty- four hours except week-ends. Any building or structure which occupies or moves along or across any portion of public property after sundown shall have sufficient lights and flares continually burning for the pro- tection of the public. E. Nothing herein contained shall require a license or bond for the movement of oversized equipment, or buildings or structures of a temporary nature, when such equipment, building, or structures are with- in the legal road limit as required by the State Statutes. SECTION IV. ESCORT. No person or corporation shall move a building or structure across or along any street, public way or public place within the city limits of North Richland Hills unless accompanied or escorted by a uniformed officer if required by the police department; provided, however, that if the building or structure is within the legal road limit as fixed by State statutes no escort shall be required; and provided further that if such escort is required, the moving contractor shall pay to the City t~e sum of $5.00 per man hour for the time necessarily requir- ed to provide such escort and shall at the time of making written appli- cation for a permit as provided in Section III A hereof deposit with the City Secretary a sum in cash sufficient to cover the fulJ estimated time to make such movement. Any excess of such deposit shall be refunded by the City and any deficiency shalJ be immediately payable to the City. SECTION V. PENALT;Y. Any person, firm or corporation, duly lic¢nsed by the City of North Richland Hills as a house moving contractor, violating any of the provisions of this ordinance or part thereof, shall be deemed guilty of a misdemeanor, and each violation shall be punishable by fine not to exceed ONE HUNDRED DOLLARS ($100.00) and the suspension of such personts license for thirty days or both. Any person, firm or corporation violating Section I of this ordinance shall be deemed guilty of a mis- demeanor, and each violation shall be punishable by a fine not to exceed TWO HUNDRED DOLLARS ($200.00). SECTION VI. If any clause, section, sentence or phrase of this ordinance is for any reason held to be invalid or unconstitutional by the courts, sucþ decision or decisions shall not affect the validity or constitution- ality of the remaining portions of this ordinance, and the City Council of the City of North Richland Hills hereby declares that it would have passed this ordinance and each section, sentence, clause or phrase thereof irrespective of the fact that anyone or more of the other sections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION VII. This ordinance being of urgent importance to the public peace, health and safety of the City of North Richland Hills, the same be in full force and effect thirty (0) days after 1 ts pas6age by the City Council and signature of the Mayor, as made and provided by the Charter of the City of North Richland HilJs. - 2- I e .. .. . ..
