HomeMy WebLinkAboutOrdinance 0089 ~ . e ORDINANCE NO. /9 WHEREAS, the City Council of the City of North Richland Hills, Texas, has found that swimming pools of a depth of more than three (3) feet are a nuisance and are a danger to the health, safety and welfare of the children and the people of the City of North Richland Hills; and WHEREAS, it has been determined by the City Council of the City of North Richland Hills that a fence of at least five (5) feet in height lessens the inherent dangers of swimming pools; THEREFORE BE IT ORDAINED BY THE CITY OF NORTH RICHLAND HILLS THA T: I On and after the effective date of this ordinance, it shall be unlawful for any person to own, maintain, erect, lease or rent a swimming pool of three feet in depth or more, unless there is around said pool a fense of at least five feet in height. II This ordinance is written and intended to be interpreted so that if any portion of it shall be held void or invalid, it shall not affect the remaining portions of the said ordinance. In If this ordinance is in conflict with any statute of the State of Texas or the Federal Government, then this said ordinance shall give way to the said statute or Federal law. IV The penalty for violation of this ordinance shall be not less than $2.00 nor more than $200.00, and each day shall constitute a separate offense under the terms of this act. \ f iii" ~ ',.
