HomeMy WebLinkAboutOrdinance 0090 - ORDINANCE NO. 9JJ WHEREAS, there exists within the corporate limits of the City of North Richland Hills, Texas, a number of lots or tracts of land upon which weeds and grass are permitted to grow to an excessive height, and; WHEREAS, these weeds are deemed to be fire hazards and a hazard to the health, safety and welfare of the community; THEREFORE BE IT ORDAINED BY THE CITY OF NORTH RICHLAND HILLS THAT; I e On and after the effective date of this ordinance, it shall be unlawful for any owner, occupant, agent or employee in charge of any lot or tract of land within the corporate limits of the City of North Richland Hills and which said lot or tract of land is located or is partially located within lOO feet of a structure which is occupied either as a residence or as a commercial building to allow weeds or grass to grow thereon, where the average height of the said weeds or grass is twelve (l2) inches. Any grass or weeds so found in this city may be mowed at the expense of the city and the said expense shall be reported to the City Council of the City of North Richland Hills, Texas, for the necessary steps to be taken to make the necessary assessment on the above-described property to reimburse the city for the cost of cutting the grass and/or weeds. II It shall be the duty of the Chief of Police to enforce the above section of this ordinance, and it shall be further the duty of the Chief of Police to send a letter by registered mail to property owners or to the person or persons in charge of said property upon which weeds and grass are growing to an excessive height, notifying him of the cityts intention to cut the said grass or weeds within ten (10) days unless the property owner or manager cuts the grass or weeds, ~ In This ordinance is written and intended to be interpreted so that if any portion of it shall be held void or invalid, it shall not affect the remaining portions of the said ordinance. IV If this ordinance is in conflict with any statute of the State of Texas or the Federal Government, then this said ordinance shall Qive way to the said statute or Federal law. V The penalty for violation of this ordinance shall be not less than $5.00 nor more than $100.00; and each day shall constitute a separate offense under the above described conditions. ..
