DISCUSSION
No questions.
Mayor Brown advised this was the second part
of the agreement with B.I.S.D. The City was
fronting the money and would be immediately
reimbursed.
Assistant City Manager Cunningham reminded
the Council of the June 21 Mid-Year Budget
Review at 6:00 p.m. Councilman Sibbet
advised he would be unable to make the
meeting.
Assistant City Manager Shiflet advised that
City Manager Sanford would have a meeting
with the City Manager of Watauga on
Wednesday on several items of importance to
both cities.
Mayor Brown advised the Council that Laidlaw
was wanting a change in their contract. He felt
the City should tell Laidlaw that the contract
would be left like it is and the City would go out
for bids in 1996.
Agenda Item #16 - Councilman Sibbet asked
that the Airport Trust Fund be included in this
resolution. Mayor Brown advised all
transportation was included. Attorney
McEntire explained this was a different
situation from the airoort tax

Mr. Howard Wadley, 6720 Hewitt, spoke in opposition of the request.
There being no one else wishing to speak Mayor Brown closed the Public Hearing.
Councilwoman Sansoucie moved, seconded by Councilman Garvin, to approve
Ordinance No. 2047 with the stipulation of 1,800 square foot homes.
Motion carried 5-0.

GN 95-73 PUBLIC HEARING - DECLARATION OF A
NUISANCE IN KINGSWOOD ESTATES
Mayor Brown opened the Public Hearing and called for anyone wishing to speak to
come forward.
Ms. Terri Mace, 7605 Aubrey Lane, appeared before the Council. Ms. Mace advised
this project had been going on for about a year. The neighbors had to put up with
blowing red dust and red mud in streets when it rained. Ms. Mace showed pictures of
the area.
Mr. John Owens, representing J.D.M. Construction, 1905 Industrial, Colleyville,
appeared before the Council. Mr. Owens stated they had several problems at this site.
Lot gradings had to be changed, drainage reworked and their equipment was
vandalized. Mr. Owens stated they would be ready to start construction in six weeks.
There being no one else wishing to speak Mayor Brown closed the Public Hearing.
Councilman Garvin moved, seconded by Councilman Sibbet, to place GN 95-73 under
advisement.
Motion carried 5-0.

Mr. Paul Young, Appraiser, gave a report on the Enhancement Study.
Mayor Brown opened the Public Hearing and called for anyone wishing to speak to
come forward.
Mr. Jeff Wooley, Attorney, representing Allen Sammuels, appeared before the Council
and spoke against the project. Mr. Wooley did not feel the improvements would
enhance their property.
Mr. Allen Young, representing Alan Young Buick, appeared before the Council and
spoke against the project and assessment. Mr. Young did not feel that the road would
benefit their business.

Developer of that certain portion
of Kingswood Estates described as
Section Three, Block 21 R (as shown on Exhibit A)
There are allegations by persons owning property and/or residing within 500 feet of the
above described portion of Kingswood Estates in North Richland Hills, Tarrant County,
Texas that the development of and/or failure to go forward with development of such
section constitutes a nuisance.
Inspection of the premises in question shows that persons living within 500 feet of said
Block 21 R are deprived of reasonable use and enjoyment of their homes by the
conditions in said Block 21 R in that blowing dust from the unfinished portion of the
subdivision infiltrate the homes and yards of adjacent properties and the red-sandy soil
from this site is being washed off-site along the west gutter of Red Oak Street between
Oak Park Drive and Starnes Road. Inspection by the Public Works Department further
shows that such conditions have been present for a period of time in excess of 180
days and that the conditions described above constitute a nuisance to persons residing
within 500 feet of said Block 21 R, Kingswood Estates, North Richland Hills, Tarrant
County, Texas.
The City Council will hear such allegations and determine whether a public nuisance
exists and whether or not the nuisance should be abated under order of the City
Council The hearing will be held on the / j.çJf day of June, 1995, at 7: 30 p. m. in the
City Council Chambers of the City Hall at 7301 N. E. Loop 820, North Richland Hills,
Texas.
You are invited to appear and offer evidence at such public hearing. A copy of this

Notice will be posted in three public places within the City. All persons wishing to
present evidence are invited to appear before the City Council at said time.
If the City Council finds that a nuisance exists for the reasons set out in the allegations
above, it may pass an ordinance requiring the owner to abate the nuisance, with both
criminal and civil penalties in the event the nuisance is not abated.
