HomeMy WebLinkAboutOrdinance 0030 ORD I NANCE NO. -..:J- 0 AN ORDINANCE ESTABLISHING THE OFFICES OF TREASURER, SECRETARY, CITY ATTORNEY, MARSHAL, ASSESSOR AND COLLECTOR OF TAXES AND CITY ENGINEER, PROVIDING FOR THEI R APPOINTMENT BY THE MAYOR SUBJECT TO CON- FIRMATION BY THE COUNCIL, FIXING THEIR TERMS OF OFFICE, DEFINING THEIR DUTIES, REQUIRING BONDS, FIXING QUALIFICATIONS, PROVIDING CERTAIN CONTROLS, PROVIDING FOR REMOVAL OF ANY OFFICER, PROVIDING THAT SUCH OFFICERS OR ANY OF THEM MAY BE APPOINTED OR THE OFFICE LEFT VACANT WITHIN THE DISCRETION OF THE COUNCIL, AND PROVIDING FOR THE FIXING OF SALARIES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: OFFICES Section 1. The following offices and officers are hereby establ ished: Treasurer, Secretary, City Attorney, a pol ice officer to be designated as Marshal, deputy pol ice officers to be known as G-eputy m'lr,,¡¡..:<IS, ·Assessor and Collector of 1¡~t:s~, and City Engineer. TREASURER DUTIES Section 2. --- The treasurer shall give bond in favor of the city in such amount, and in such form as the City Council may require, with sufficient security to be approved by the City Council, condi- tioned for the faithful discharge of his duties. He shall receive and securely keep all moneys belonging to the city, and make all payments for the same upon the order of the mayor, attested by the secretary under the seal of the corporation. No order shall be paid unless the said order shall show upon its face that the City Council has directed its issuance, and for what purpose. He shall render a full and correct statement of his receipts and payments to the Ci ty Council, at their first regular meeting in every quarter and when- soever, at other times, he may be required by them so to do. At the end of every half year he shall cause to be publ ¡shed, at the expense of the city, a statement showing the amount of receipts and expenditures for the six months next preceding, and the general condition of the treasury. He shall do and perform such other acts and ~uties as the City Council may require. He shall receive such compensation as the City Council shall fix. ... SECRETARY DUTIES Section 3. The ~ityJiecretary shall attend every meeting of the city council, and keep accurate minutes of the proceedings thereof in a book to be provided for that purpose, and engross and enroll all laws, resolutions and ordinances of the city council, keep the corporate seal, take charge of and preserve and keep in order all the books, records, papers, documents and files of said . >, ,,~ , '~ .~ ~;: ~, - .~ v. ... i \~ council, countersign all commissions issued to city officers, and 1 ~ licenses issued by the mayor, and keep a record or register thereof, 't '\ .... and make out all notices required under any regulation or ordinance '''[ ~... ~ t-· 'S '\:"' of the city. He shal I draw all the warrants on the treasurer and 1 ~ c&¡;.~; ~n4~~:e. ;:::".~"1t~eel&/~;. a1lw~~~te~(a~~~;~~<~:'~.~h~i~~o~Jø~u~t,~~ JJ',~ provided for the purpose.A He shall be the gene~al accountant of the corporation, and shall keep in books regular accounts of the receipts and disbursements for the city, and separately, under prop~ heads, each cause of receipt and disbursement, and also accounts with each person including officers who have money transactions with the city, crediting accounts allowed by proper authority and specifying the particular transaction to which such entries apply. He shall keep a register of bonds and bills issued by the city, and all evidence of debt due and payable to it, noting the parti- culars thereof, and all facts connected therewith, as they occur. He shall carefully keep all contracts made by the city council; and he shall perform all such other duties as may be required of him by law, ordinance, resolution or order of the êity eouncil. CITY ATTORNEY DUTIES Section 4. The City Attorney shall be the chief legal officer of the City, who shall be a 1 icensed attorney with at least five (5) years of experience in the active practice of law, and at the request of the Mayor or any Councilman, the City Secretary, the Treasurer and the Assessor and Collector of Taxes shall give them written advise upon any questions touching the public inter,est or concerning their official duties. He shall represent the City in all lit igat ion in the D istr ict and Appellate Courts of the state. -2- MARSHAL:APPOINTIVE:DUTIES, Section 5. The office of Marsha] as an elective office is hereby dispensed with and the office of Marshal as an appointive office and as ex-officio Qhief of ~o] ice is created~ who may appoint one or more deputies, subject to the approval of the Counci1. The Marshal as ex-officio <èhief of Bo1 ice shal], in person or by deputy, attend upon the corporat ion court while in session, and promptly and faithfully execute a)l writs and process issued from said court. He shall have 1 ike power, with the sheriff of the county, to execute warrants; he shall be active in quell ing riots, disorder and distru- bance of the peace within the city 1 imits and shall take into custody al] persons so offending against the peace of the city and shall have authority to take suitable and sufficient bail for the appearance before the corporation court of any person charged with an offense against the ordinance or laws of the city. It shal] be his duty to arrest, without warrant, a]l violators of the pub] ic peace, and all who obstruct or interfere with him in the execution of the duties of his office or who shall be guilty of any disorderly conduct or dis- turbance whatever; to prevent a breach of the peace or preserve quiet and good order, he shall have authority to close any theatre, ball room or other place or building of public resort. In the prevention and suppression of crime and arrest of offenders, he shall have, possess and execute 1 ike power, authority, and jurisdiction as the .sher iff. He sha]l perform such other dut ies and possess such other powers and authority as the ~ity E~uncil may by ordin- ance require and confer, not inconsistent with the Constitution and laws of this State. He shall receive a salary or fees of office, or both, to be fixed by the ~ity GounciJ. ASSESSOR-COLLECTOR DUTIES Section 6. The As~essor and Collector of Taxes shall perform all the duties with respect to assessing property for the purpose of taxation and of collecting taxes, as may be prescribed by the City Council. -3- ,TY ENGINEER DUTIES Section 7. (a) The City Engineer shall be a 1 icensed civil engineer, with at least five (5) years practical experience. He shall be the custodian of and responsible tor all maps, plans, profiles, field notes and other records belonging to the city per- taining to his office and the work thereof, all of which he shall keep in proper order and condit ion, with indexes thereof. (b) The ~ity ingineer shall be ex-officio superintendent of streets. He shall have charge of the planning, opening, construc- tion, paving, maintenance and repair of all streets, boulevards, alleys, sidewalks and publ ic ways. He shall have supervision over the sewers and sewer system, the corporation yard and warehouse, the cleaning and sprinkl ing of streets and the levees within the city. He shall have charge of the construction, maintenance, repair and operation of all publ ic buildings belonging to or used by the city; of the construct ion and maintenance of fire and pol ice alarm systems; of the inspection of all electric wires for furnish- ing heat, 1 ight or poweç, and of the wiring of all buildings here- after in the city; and of the inspection of all buildings and the issuing of permits for building operations in accordance with the rules and regulations which may be prescribed by ordinances of the city. He shall have the administrative control and operation of the electric 1 ighting system of the city. He shall have charge of the inspection of all plumbing within the city and shall enforce all the rules and ordinances of the city respecting the same. He shall have charge of the execution of the ordinances, contracts and regu- lat ions of the city with regard to the disposal of the city's garbage. He shall also perform such other duties relating to his department as may be required of him by the City Councilor by city ordinance. (c) The fity ~ngineer shall, when cal led upon by the City Council cause to be made a full and complete set of water system records consisting of maps, plats, notes and other records of the city water pipe system, showing and giving the location and size of all mains, laterals, pipes, hydrants, house-taps, air-valves, blow-offs and other fixtures and connections, using the existing -4- duties are herein prescribed, and to define and prescribe the powers and duties of all officers appointed or elected to any office by resolution, clearly defining such duties, duly adopted and filed in the office of the City Secretary. WHEN APPOINTMENT MADE Section 12. The City Council shall not by the adoption~ of this ordinance, except as to those offices and officers hereto- fore appointed, which appointments are now confirmed, be required to appoint any officer to any office herein created until such time as the City Council shall determine, in its exclusive discretion, that such office should be activated by appointment of an officer to fill any such office and until such determination has been made by resolution duly adopted and filed in the office of the City Secretary and such appointment thereafter made and confirmed by the City Council, the same shall remain vacant. VACANCY Section 13. In case of a vacancy in any of the offices herein created, the Mayor shall fill such vacancy by appointment, to be confirmed by the City Council, subject to the provisions of Section 12 hereof. RES IDENCE Section 14. No person shall be appointed to any office herein created~unless he (or she) shall be a qualified voter within the city and shall have resided within the corporate 1 imits of the city for six (6) months and within the State of Texas for one (I) year next preceding the date of appointment; provided, however, that the City Council may, in its exclusive discretion~ waive this require- ment in the appointment of the Marshal;. b-ttt further provided that no such w~¡ver shall be effective unless such proposed appointee has been a bona fide resident of Tarrant County, Texas, for not Jess than two (2) years next preceding the date of the appointment. BONDS Section 15. In addition to the officers herein specifically required to give bond, the City Council may, in the exercise of its discretion, require any other officer or officers to give bond in -6- such amount as the City Council deems necessary for the protection of the city and the publ ic interest; by resolution duly adopted and filed in the office of the City Secretary. REPEALS Section 16. Any ordinance or part thereof heretofore adopted which may be in confl iet herewith is hereby expressJy repealed. CUMULATIVE Section 17. The foregoing sections of this ordinance are hereby declared to be cumulative of any laws that may now or here- after be passed by the Legislature regulating and governing cities and towns incorporated under the general Jaws of this State.
