HomeMy WebLinkAboutOrdinance 2565 ORDINANCE NO 2565 AN ORDINANCE OF THE CITY OF NORTH RICH LAND HILLS, TEXAS, AMENDING THE ZONING ORDINANCE TO ESTABLISH A PLANNED DEVELOPMENT DISTRICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has reviewed a rezoning request on a tract of land identified in Case Number PZ 2001-16; and WHEREAS, the developer has indicated an interest in establishing the proposed development as a Planned Development District under the guidelines of the North Richland Hills Zoning Regulations; and WHEREAS, the City Council has determined that the development conditions of this tract of land do not provide adequate opportunities for development under available existing zoning district regulations; and WHEREAS, after appropriate notice and public hearing, the City Council of the City of North Richland Hills has approved an amendment of the Zoning Ordinance by establishing a Planned Development District and by changing said Zoning Ordinance as set forth herein; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: 1. THAT, in Case Number PZ 2001-16, the following described property, attached as Exhibit A, Location Map, shall be rezoned from PD Planned Development and R-3 Residential to PD Planned Development with specific development regulations on 7.379 acres of land. 2. THA T, the purpose of this Planned Development District is to provide for a single family residential subdivision. The permitted uses and development regulations for this planned development district shall be as follows: Ordinance 2565 Page lof 4 1. Permitted Uses: Single family detached residences. Lots 1 and 22, Block 2, and Lot 1, Block 3 shall be used as common areas. 2. Minimum Lot Size: 3. Minimum Lot Width: 4. Minimum Lot Decth: 5. Front Setback: 6. Side Setback: 7. Rear Setback: 8. Size of Residence: 5,403 square feet 50' for interior lots, 55' for corner lots 110' 20' 5' for interior lots, 15' for side streets on comer lots 10' No more than eight (8) residences will be a minimum 1600 square feet in size with the remaining twenty-nine (29) lots having an overall minimum residence size of 1800 square feet. 9. Screenina: Construct a consistent stockade fence along the west side of the property from Lot 1-22, Block 2 at a 6' minimum height. No fence of any kind with the exception of a living fence on common block 1 of Lot 1, 2, and 3 along Glenview and no fence of any kind with the exception of a living fence on the west side of Lot 1. 10. Landscacina: Specific landscaping, signage and entryway features to be approved by Planning & Inspections Department. 11. Homeowners Association: Homeowners Association to maintain the fence along common lots and Glenview and Harmonson along with landscape and maintenance of all three common areas. 12. Homeowners Maintenance Homeowner's Maintenance Agreement to be Aareement: the same as Glenwyck and to be tied to the Homeowner's Association Agreement. 13. Drainaae Detention: Determination of a need for security fencing will be determined by city staff upon approval of the Final Plat. Ordinance 2565 Page 2 of 4 3. THAT, all provisions of the Zoning Regulations of the City of North Richland Hills, as amended, which are not in conflict with the terms of this Planned Development shall remain applicable on said property. 4. THAT, the Zoning Map of the City of North Richland Hills be amended to reflect this planned development district. 5. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. 6. SAVINGS CLAUSE. That the Comprehensive Zoning Ordinance of the City of North Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. 7. EFFECTIVE DATE. This ordinance shall be in full force from and after its passage.
